‘Toamend,onantemporarybasis,theCriminalBackgroundChecksfortheProtectionof.ChildrenAct of 2004 to expand the definitionofa covered childor youth services
providertoincludeemployeesorvolunteersofhostemployersparticipatinginsummeryouthprogramsadministeredbytheDepartmentofEmploymentServices;and,toamendtheYouthEmploymentActof1979toauthorizetheDepartmentofEmploymentServicestoconductbackgroundchecksandmotorvehiclerecordchecksofemployeesorvolunteersofa hostemployerorgranteewithdirectcontactorunsupervisedaccessto
youthparticipatinginyouthemploymentprograms.
BE IT ENACTED BY THE COUNCIL DISTRICT OF COLUMBIA, Thatthisactmay be
citedasthe“Youth WorkforceDevelopmentProgramsTemporary Amendment Actof 2025”.
Sec.2.Section202(3)oftheCriminalBackgroundChecksfortheProtectionofChildrenActof2004,effectiveApril13,2005(D.C.Law15-353;D.C.OfficialCode§4-1501.02(3)),isamendedtoreadasfollows:“(3)“Coveredchildoryouthservicesprovider":“(A)MeansanyDistrictgovernmentagencyprovidingdirectservicestochildrenoryouthandanyprivateentitythatislicensedbyorcontractswiththeDistricttoprovidedirectservicestochildrenoryouth,orforthebenefitofchildrenoryouth,thataffectthehealth,safety,andwelfareofchildrenoryouth,includingindividualandgroupcounseling,therapy,case‘management,supervision,ormentoring.“(B)Theterm“coveredchildoryouthservicesprovider”doesnotincludefosterparentsorgrantees.
“(C)Notwithstandingsubparagraph(B)ofthisparagraph,theterm“coveredchildoryouthservicesprovider”includesanemployeeorvolunteerofahostemployerorgranteeparticipatinginprogramsestablishedpursuant(osection2aofthe YouthEmploymentActof1979,
effectiveJanuary5,1980(D.C.Law3-46;D.C,OfficialCode§32-242),whohasdirectcontact,withorunsupervisedaccesstoyouthparticipatinginsuchprograms.”.

(2)Paragraph(2)isrepealed.(3)Paragraph(3)isamendedbystrikingthephrase“closingceremony”andinsertingtheword“activities”initsplace.(b)A newsubsection(i)isaddedtoreadasfollows:
“(iTheDepartmentofEmploymentServicesisauthorizedtoperformcriminalbackgroundchecksandtrafficrecordchecksforemployeesandvolunteersofhostemployersorgranteesparticipatinginprogramsestablishedpursuanttothissectioninaccordancewiththeCriminal
BackgroundChecksfortheProtectionofChildrenActof2004,effectiveApril13,2005(D.C.Law15-353;D.C.OfficialCode§4-1501.01erseq.).”.
