Temporary Changes to Pardon Waiting Rules

This bill temporarily allows the D.C. Clemency Board to skip a five-year waiting period for some pardon applicants if federal officials approve it, and delays the start date of another law until October 2027.

What This Bill Does

  • Allows the Clemency Board to waive the standard five-year waiting time before an applicant can seek a pardon in certain cases.
  • Requires that the Office of the Pardon Attorney or the President must first grant a waiver for this rule change to happen.
  • Stops the Board from granting these waivers if the person is currently on probation, parole, or supervised release.
  • Lets the Board ask applicants for more information or meet with them before deciding on their request.
  • Changes the start date of the Second Chance Amendment Act of 2022 to October 1, 2027.

Who It Names or Affects

  • People in Washington D.C. who are applying for a pardon from the Clemency Board
  • The District of Columbia Clemency Board members and staff

Terms To Know

Clemency Board

Limits and Unknowns

  • This law is temporary and will expire after it has been in effect for 225 days.
  • The Clemency Board can still say no to a waiver request even if the federal government approved one first.
  • The bill does not take effect until the Mayor approves it, Congress reviews it, and it is published officially.
