IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

Toamend,onantemporarybasis,theUniversalPaidLeaveAmendmentActof2016toprohibitprivatedisabilityinsuranceprovidersfromreducingshort-termdisabilitybenefitsbased(onactualorestimatedpaidleavebenefitsto whichaneligibleindividualmaybeentitledtofromtheDistrict,regardlessofthejurisdictioninwhichtheinsurancepolicywasissuedorwritten;andtoamendtheInsuranceTradeandEconomicDevelopment‘AmendmentActof2000tomaketheprohibitiononoffsettingorreducingbenefitsunderaprivatemarketshort-termdisabilityinsurancepolicybasedonestimatedoractualbenefitsreceivedundertheUniversalPaidLeaveAmendmentActof2016enforceableunderthatlaw,regardlessofthejurisdictioninwhichtheinsurancepolicywasissuedorwritten.

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, Thatthis
actmay be citedasthe“Short-TermDisabilityInsuranceBenefitProtectionClarification
‘TemporaryAmendment Act of2025”.
Sec.2.Section107()(1)oftheUniversalPaidLeaveAmendmentActof2016,effectiveApril7,2017(D.C.Law21-264:D.C.OfficialCode§32-541,07())(1)),isamendedtoreadasfollows:
“@)(1)Noinsurermayoffsetorreducebenefitsorincomeavailabletoaneligibleindividualunderanindividualorgrouppolicyfortemporaryorshort-termdisabilityinsurancebasedonestimatedoractualbenefitstheeligibleindividualmayordoesreceiveunderthisact,regardlessofthejurisdictioninwhichsuchpolicywasissued,executed,written,ordelivered.”.

Sec.3.Section120aoftheInsuranceTradeandEconomicDevelopmentAmendmentActof2000,effectiveNovember13,2021(D.C.Law24-45;D.C.OfficialCode§31-2231.208),isamendedasfollows:(a)Subsection(a)isamendedtoreadasfollows:(a)Noinsurermayoffsetorreducebenefitsorincomeavailabletoaneligibleindividualunderatemporaryorshort-termdisabilityinsurancepolicy,basedonestimatedoractualbenefits

(b)Subsection(c)isamendedtoreadasfollows:“(©)Forthepurposesofthissection,theterm:“(1)“Eligibleindividual”shallhavethesamemeaningasprovidedinsection101(6)oftheUniversalPaidLeaveAmendmentActof2016,effectiveApril7,2017(D.C.Law21-264;D.C.OfficialCode§32-541.01(6)).“(2)“Self-insuredemployer”shallhavethesamemeaningasprovidedinsection101(19A)oftheUniversalPaidLeaveAmendmentActof2016,effectiveApril7,2017(D.C.Law21-264;D.C.OfficialCode§32-541.01(19A)).”.

ThisactshallapplyasofMay1,2025.
