BEITENACTEDBYTHECOUNCILOFTHEDISTRICTOFCOLUMBIA,ThatthisActmaybecitedasthe“AssociationMeetingFlexibilityCongressionalReviewEmergencyAmendment Act of 2025”.
Sec.2.Section303oftheCondominiumActof1976,effectiveMarch29,1977(D.C.Law 1-89;D.C, OfficialCode § 42-1903.03),isamended as follows:
(a)Subsection(b)isamendedbyrepealingparagraph(4).(b)A newsubsection(f)isaddedtoreadasfollows:“(®)Notwithstandinganylanguagecontainedinthisactorinthecondominium
instruments:
“(1)Meetings of the unitowners’ association,executiveboard,or committees
maybeconductedorattendedbytelephoneconference,videoconference,orsimilarelectronicmeans.Ifameetingisconductedbytelephoneconference,videoconference,orsimilar
electronicmeans,theequipmentorsystemusedmustpermitanyunitownerinattendancetohearandbeheardby,andtocomprehendwhatissaidby,allotherunitownersparticipatinginthe‘meeting.Anyunitowner,boardmember,orcommitteememberattendingsuchmeetingshallbedeemedpresentforquorumpurposes.“(2)A linkorinstructionsonhowtoaccessanelectronicmeetingshallbeincludedinthenoticerequiredundersubsection(a)ofthissection.“(3)Anymattersrequiringavoteofthe unitowners’associationatanannualor
regularmeetingmaybesetbytheexecutiveboardfora vote,andaballotmaybedeliveredwith

thenoticerequiredundersubsection(a)ofthissection.Theexecutiveboardmaysetareasonabledeadlineforaballottobereturnedtotheassociation.“(4)Theexecutiveboardmayauthorizeunitownerstosubmitvotesbyelectronictransmissionupto7daysbeforethescheduleddateofanymeetingoftheunitowners,andunit‘ownerswhosubmitvotesduringsuchperiodshallbedeemedtobepresentandvotinginpersonatsuchmeeting.”.
