BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
actmay be citedasthe“FiscalYear 2026 Local Budget Act of 2025”.
Sec.2.AdoptionofthelocalportionoftheFiscalYear2026budget.Thefollowingexpenditurelevelsareadoptedpursuanttosection446(a)oftheDistrictofColumbiaHomeRuleAct,approvedDecember24,1973(87Stat.801;D.C.OfficialCode§1-204.46(a)),asthelocalportionofthebudgetforthegovernmentoftheDistrictofColumbiaforthefiscalyearendingSeptember30,2026.

beverages,nottoexceed$30peremployeeperday,toemployeesoftheDistrictofColumbia
governmentwhilesuchemployeesaredeployedinresponsetoorduringadeclaredsnowor
otheremergency;providedfurther,thatlocalfundsandotherfundsappropriatedunderthisact
maybeexpendedbytheMayortoprovidefoodandlodging,inamountsnottoexceedthe
GeneralServicesAdministrationperdiemrates,foryouth,youngadults,andtheirparentsor
guardianswhoparticipateinaprogramoftheDistrictofColumbiagovernmentthatinvolves
overnighttraveloutsidetheDistrictofColumbia;providedfurther,thatnotwithstandingany
otherprovisionoflaw,localfundsareappropriated,withoutregardtofiscalyear,totheextent
such funds arecertifiedas availableby theChiefFinancialOfficerof the Districtof Columbia, to
pay terminationcostsof multiyearcontractsenteredintoby theDistrictof Columbia duringthis
fiscalyear,todesign,construct,improve,maintain,operate,manage, or financeinfrastructure

projectsprocuredpursuanttothePublic-PrivatePartnershipActof2014,effectiveMarch11,
2015 (D.C. Law 20-228;D.C. OfficialCode § 2-271.01etseq.),including,by wayof example
and not limitation,a projectforthereplacementand modernizationof theDistrictof Columbia’s
streetlightsystemandaprojectfortherehabilitationandmodernizationoftheHenryJ.Daly
Building,andsuchterminationcostsmaybepaidfromappropriationsavailableforthe
performanceof suchcontractsorthepaymentofterminationcostsorfromotherappropriations
thenavailableforanyotherpurpose,notincludingtheemergencycashreservefund(D.C.
OfficialCode§1-204.50a(a))orthecontingencycashreservefund(D.C.OfficialCode§1-
204.50a(b)),which,onceallocatedtothesecosts,shallbedeemedappropriatedforthepurposes
ofpayingterminationcostsofsuchcontractsandshallretainappropriationsauthorityandremain
availableuntilexpended;providedfurther,thatnotwithstandinganyotherprovisionoflaw,local
fundsareappropriated,withoutregardtofiscalyear,totheextentsuchfundsarecertifiedas
availableby theChiefFinancialOfficerof theDistrictof Columbia, topay termination,transfer,
orchangeofownershipcostsofmultiyearcontractsenteredintobytheDistrictofColumbia
duringthisfiscalyear,todesign,construct,improve,maintain,operate,manage,andfinance
infrastructureprojectsforthepurposeofon-sitegenerationanddistributionofenergy,including,
bywayofexampleandnotlimitation,aprojectontheSt.Elizabethscampusfortheconstruction
and operationof an energyresourcesmicrogrid,and such termination,transfer,or change of
‘ownershipcostsmaybepaidfromappropriationsavailablefortheperformanceofsuchcontracts
orthepaymentoftermination,transfer,orchangeofownershipcostsorfromother
appropriationsthenavailableforanyotherpurpose,notincludingtheemergencycashreserve
fund(D.C.OfficialCode§1-204.50a(a))orthecontingencycashreservefund(D.C.Official
Code § 1-204.50a(b)),which,once allocatedtothesecosts,shallbe deemed appropriatedforthe
purposesofpayingtermination,transferorchangeofownershipcostsofsuchcontractsandshall
retainappropriationsauthorityandremainavailableuntilexpended;providedfurther,thatduring
FiscalYear 2026,notwithstandingany otherprovisionof law,theDistrictof Columbia may
enterintoannualandmultiyearagreementswiththeNationalParkServiceforthepurposesof
planning,designing,constructing,maintaining,improving,andoperatingDistrictofColumbia
transportationinfrastructureandrelatedappurtenancesonNationalParkServicelandinthe
DistrictofColumbia,andmayincachfiscalyearofsuchagreementexpendsuchfundsto
implementtheagreementasmaybeappropriatedandavailableinthatfiscalyearforsuch
purposes;providedfurther,thatnotwithstandingSubchapterIVofChapter3ofTitle47ofthe
Districtof Columbia OfficialCode, amounts appropriatedfrom fundsreceivedfrom thefederal
governmentundertheAmericanRescuePlanAct,approvedMarch11,2021(Pub.L.No.117-2;
135Stat.4)(“ARPA”)ortheCoronavirusAid,Relief,andEconomicSecurityAct,approved
March 27,2020 (Pub.L. No. 116-136;134 Stat.281) (“CARES Act”) may be transferredor
reprogrammedbetweenappropriatedfunds,consistentwiththerequirementsoftheARPA and
theCARESActandconsistentwiththepurposeforwhichthefundsareappropriatedunderthis
act,upon therequestof theMayor to theChiefFinancialOfficerand certificationof the

availabilityofthefundsbytheOfficeoftheChiefFinancialOfficer,andsuchamounts,oncetransferred,shallretainappropriationauthorityconsistentwiththeprovisionsofthisact;providedfurther,thatamountsappropriatedfromfundsreceivedfromthefederalgovernmentundertheARPAandtheCARESActshallbeavailableuntilexpended,providedthatsuchfundsareexpendedforthesamepurposeforwhichthefundsareappropriatedunderthisact;provided
further,thattheamountsappropriatedfromfundsreceivedfromthefederalgovernmentundertheEmergencyRentalProgrammaybeincreasedbysuchadditionalamountsasmaybereceivedpursuanttothatprogramduringFiscalYear2026;providedfurther,thatanyunspentamountremaininginanon-lapsingfundlistedintheappropriationsbelowattheendofFiscalYear2025istobecontinuallyavailable,allocated,andappropriated,andmaybeexpended,forthepurposes
ofsuchfundinFiscalYear2026inadditiontoanyamountsdepositedinandappropriatedtosuchfundinFiscalYear2026;providedfurther,thatnofundsshallbeobligatedorexpendedontheMayor’sArtsAwards;providedfurther,thatnoneofthefundscontainedinthisactforthedevelopmentoftheRFKcampusforthepurposesofa stadiummaybeexpendedexceptinaccordancewiththeRobertF.KennedyCampusRedevelopmentActof2025,passedonIst
readingonAugust1,2025(EngrossedversionofBill26-288),includinganyamendmentsthereto;providedfurther,thattheChiefFinancialOfficershalltakesuchstepsasarenecessarytoassurethattheforegoingrequirementsaremet,includingtheapportioningbytheChiefFinancialOfficeroftheappropriationsandfundsmadeavailableduringFiscalYear2026:
