IN THE COUNCIL OF THE DISTRICT OF COLUMBIA.

Toamend,onanemergencybasis,theHomelessServicesReformActtoestablishgroundsforanextensiontoparticipateintheFamilyRe-HousingStabilizationProgramthatwould
requiretheDepartmentofHumanServices,oritsdesignee,toconsiderthetotalityoftheparticipant'scircumstances,includingtheparticipant’progressincasemanagementandeligibilityforaffordablehousing.

BEITENACTEDBYTHECOUNCILOFTHEDISTRICTOFCOLUMBIA,Thatthisactmaybecitedasthe“FamilyRe-HousingStabilizationProgramProtectionEmergencyAmendment Act of 2025”,
Sec.2.Section7(b)(4)(B)oftheHomelessServicesReformAct,effectiveOctober22,2005(D.C.Law 16-35;D.C.OfficialCode§4-753.01(b)(4)(B)),isamendedasfollows:
(a)Theexistingtextisdesignatedassub-subparagraph(i).(b)Newsub-subparagraphs(ii),(ii),and(iv)areaddedtoreadasfollows:“Gi)Notwithstandinganyotherlaw;provided,thatfundingisavailablewithintheFamilyRe-HousingStabilizationProgram(“FRSP”)toimplementthissub-subparagraphandsub-subparagraphs(ii)and(iv)ofthissubparagraph,theDepartment,ortheDepartment’sdesignee,shallconsiderrequestsforFRSPassistanceextendingpast12monthsif:“())Theparticipanthasrequestedanextensioninwriting;
(I) Theparticipanthasmadea goodfaitheffort
towardstheachievementofgoalssetforthinanindividualizedplanwiththeaimofa targetedprogressiontowardexitfromthesupportsofFRSP,asobservedbyaserviceprovideratconsistentintervals,butcannotyetsustainhousingstabilityindependentlyofFRSP;and“(UD)Theparticipanthasnotyetbeenapprovedforpermanentlyaffordablehousing.
“Gii)WhenmakingadeterminationofwhethertograntaparticipantinFRSPanextensionbeyond12months,theDepartment,ortheDepartment'sdesignee,shall:

“()Considerthetotalityofthecircumstances:and
“(1 Grantextensionsoftimeinincrementsnot
greaterthan6months,withformalreviewsevery3monthstoensurethatparticipantsaregiventhesupportnecessarytoexitFRSPwithstablehousing.
“(iv)Ifa requestedextensionofFRSP assistanceby a
participantisdenied,theparticipantshallbegiven30dayswrittennoticepriortothefinalsubsidy
paymentexplicitlysettingforththereasonforthedenialofadditionalassistanceandinformingthe
participantthattheparticipanthasaright to:
“()Appealthedeterminationthroughafair
hearingandadministrativereview,includingdeadlinesforrequestinganappeal;and
“(Q) The continuationof FRSP services
pendingtheoutcomeof any fairhearingrequestedwithin15 days of receiptof a writtennoticeof
atermination.”.
Sec.3.Applicability.
ThisactshallapplyasofJuly10,2025.

‘TheCounciladoptsthefiscalimpactstatementoftheBudgetDirectorasthefiscalimpactstatementrequiredbysection42oftheGeneralLegislativeProceduresActof1975,approvedOctober16,2006(120Stat.2038;D.C.OfficialCode§1-301.47a).
Sec.5.Effectivedate.
ThisactshalltakeeffectfollowingapprovalbytheMayor(orintheeventofvetobytheMayor,actionbytheCounciltooverridetheveto),andshallremainineffectfornolongerthan90days,asprovidedforemergencyactsoftheCounciloftheDistrictofColumbiainsection
