Dear Chairman Mendelson:
Enclosed for consideration and approval by the Council of the District of Columbia is a proposed
resolution entitled the "Medical Cannabis Retailer Craft Preparation Endorsement Act of 2025."
The proposed legislation would create a new medical cannabis retailer craft preparation
endorsement, and to establish specific requirements that must be satisfied for the Alcoholic
Beverage and Cannabis Board to approve and issue a craft preparation endorsement to the holder
of a medical cannabis retailer license. Specifically, the legislation revises Chapter 16B of Title 7
of the D.C. Official Code by creating a new section titled "Craft Preparation Endorsement."

15 To amend the Legalization of Marijuana for Medical Treatment Initiative of 1999 to create a new
16 medical cannabis retailer craft preparation endorsement, and to establish specific
17 requirements that must be satisfied for the Alcoholic Beverage and Cannabis Board to
18 approve and issue a craft preparation endorsement.

20 BE IT ENACTED BY THE COUNCIL OF TH E DISTRICT OF COLUMBIA , That this
21 act may be cited as the "Medical Cannabis Retailer Craft Preparation Endorsement Amendment
22 Act of 2025".
23 Sec. 2. The Legalization of Marijuana for Medical Treatment Initiative of 1999, effective
24 February 25, 2010 (D.C. Law 13-315; D.C . Official Code§ 7-1671.01 et seq.), is amended as
25 follows:
26 (a) Section 7 (D.C. Official Cod e § 7-1671.01) is amended by adding a new paragraph
27 (15B) to read as follows:
28 "(15B) "Preroll" means a cigarette containing raw or dried cannabis flower or
29 other material from the cannabis plant wrapped in rolling paper or other material.
30 (b) A new section 7g is added to read as follows:
31 "Sec. 7g. Craft preparation endorsement.
32 "(a) A holder of a retailer license shall be eligible to apply to the ABC Board for a craft
33 preparation endorsement.

“(b) A holder of a craft preparation endorsement may prepare the following types of 34
medical cannabis products at their licensed premises for sale to qualifying patients and 35
caregivers: 36
“(1) Baked goods, beverages, chocolates, confections, and other edibles, provided 37
that the cannabis products are made using cannabis oil, butter, or from other products purchased 38
from a licensed manufacturer; 39
“(2) Lotions, soaps, ointments, and other products intended to be applied to the 40
skin; and 41
“(3) Prerolls. 42
“(c)(1) Medical cannabis products prepared under a craft preparation endorsement shall 43
be prepared, tested, packaged, and labeled in accordance with the requirements of this act and 44
rules issued by the Mayor. 45
“(2) All medical cannabis product prepared under a craft preparation endorsement 46
shall be shelf-stable and shall not require refrigeration to avoid spoilation. 47
“(3) A holder of a craft preparation endorsement shall not prepare or manufacture 48
transdermal patches. 49
“(d)(1) Medical cannabis products prepared under a craft preparation endorsement may 50
be sold only to qualifying patients and their caregivers. 51
“(2) A holder of a craft preparation endorsement that also holds a delivery 52
endorsement may deliver medical cannabis products prepared under the endorsement to 53
qualifying patients and their caregivers. 54
“(3) A holder of a craft preparation endorsement shall not distribute or sell 55
medical cannabis products to retailers, internet retailers, manufacturers, or unlicensed 56

establishments or other persons and entities engaged in the resale, direct sale, or wholesale of the 57
product.”. 58
“(e ) A holder of a craft preparation endorsement may devote no more than 20% of the 59
gross floor area of its licensed premises to the preparation of medical cannabis products. 60
“(f) (1) A holder of a craft preparation endorsement may store no more than 2 kilograms 61
of medical cannabis flower and no more than 1 liter combined of cannabis oil and tincture for the 62
purpose of preparing medical cannabis products. 63
“(2)(A) Cannabis flower stored pursuant to this subsection shall be sourced only 64
from licensed cultivation centers. 65
“(B) Cannabis oil or tincture stored pursuant to this subsection shall be 66
sourced only from licensed manufacturers. 67
“(g) In the preparation of medical cannabis products, a holder of a craft preparation 68
endorsement shall not extract cannabinoids from cannabis plant material or use butane or 69
explosive gas. 70
“(h) A holder of a craft preparation endorsement shall not prepare, sell, or distribute 71
medical cannabis products that are not prepared, tested, packaged, and labeled in accordance 72
with the requirements of this act and rules issued by the Mayor. 73
“(i) A holder of a craft preparation endorsement shall not permit odor, smoke, or by-74
products from its preparation of medical cannabis products to be detectable by sense of smell in a 75
separate residence or property, whether located on the same lot as the holder’s licensed premises 76
or a separate lot. 77

“(j) A holder of a craft preparation endorsement shall not permit the consumption or use 78
of medical cannabis products at its licensed premises unless it holds a safe-use treatment facility 79
endorsement for the licensed premises where the consumption or use will occur.”. 80
Sec. 3. Fiscal impact statement. 81
The Council adopts the fiscal impact statement of the Chief Financial Officer as the fiscal 82
impact statement required by section 4a of the General Legislative Procedures Act of 1975, 83
approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a). 84
Sec. 4. Effective date. 85
This act shall take effect following approval by the Mayor (or in the event of veto by the 86
Mayor, action by the Council to override the veto), and a 30-day period of congressional review 87
as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 88
24, 1973 (87 Stat. 813; D.C. Official Code § 1-206.02(c)(1)). 89
