Toamend,onanemergencybasis,theJuvenileCurfewActof1995toauthorizetheMayortoextendthejuvenilecurfewhoursintheDistrictwhenappropriatetoprotectpublicsafetyorpublicorprivateproperty,toauthorizetheChiefofPolicetoestablishextendedjuvenilecurfewhourzonesinspecifiedcircumstances,tostartthejuvenilecurfewhoursat11p.m,everydayinJune,July,andAugust2025,andtoextendtheapplicabilityofthejuvenilecurfewto17-yearolds.
BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, Thatthis
actmay be citedasthe“JuvenileCurfew Emergency Amendment Actof 2025”.
Sec.2.TheJuvenileCurfewActof1995,effectiveSeptember20,1995(D.C.Law11-48;
D.C.OfficialCode§2-1541etseq.),isamendedasfollows:(a)Section3(D.C.OfficialCode§2-1542)isamendedasfollows:
(1)Paragraph(1)isamendedtoreadasfollows:
“(1)“ChiefofPolice”meanstheChiefoftheMetropolitanPoliceDepartment.”(2)A newparagraph(LA)isaddedtoreadasfollows:
“(1A)“Curfewhours”means:“(A)DuringeverymonthexceptJulyandAugust:
“(i)From11:00p.m.oneverySunday,Monday,Tuesday,Wednesday,andThursday,until6:00a.m.onthefollowingday;and
“(i)From 12:01a.m.until6:00a.m.on everySaturdayand
Sunday;
“(B)DuringthemonthsofJulyandAugust,from12:01a.m.until6:00am.everyday;
*(C)Notwithstandingsubparagraphs(A)and(B)ofthisparagraph,duringthemonthsofJune,July,andAugust2025,from11:00p.m.oneverydayuntil6:00a.m.onthe
followingday; “(D)ExtendedcurfewhoursestablishedbytheMayorpursuanttosection
3a;and

“(E)Extended curfew hoursinextendedjuvenilecurfewzones established
bytheChiefofPolicepursuanttosection3b.”.
(3)Paragraph(5)isamendedbystrikingthephrase“undertheageof17years”
andinsertingthephrase“undertheageof18years”initsplace.
(4)A newparagraph(6A)isaddedtoreadasfollows:
(A) “Noticeofviolationofcurfew”meansaverbalwarning,authorizedbyan
officialthatinformsagroupofjuvenilesthattheyareviolatingthetermsofacurfew,thatthey
may be arrestedif they continuetoviolatethecurfew,and identifiesreasonablestepsthattheycan
taketoleavetheareatoavoidarrest.”.
(b)New sections3a and 3b areadded toreadas follows:
“Sec.3a.Temporaryextensionsofjuvenilecurfewhours.
“(a)TheMayormay,byissuanceofan administrativeorderpursuanttosection422(11)
of the Disirictof Columbia Home Rule Act,effectiveDecember 24, 1973 (87 Stat.790; D.C.
OfficialCode§ 1-204.22(11),extendthejuvenilecurfewhoursintheDistrict,oranypartofthe
District,beyondthehoursestablishedinsection3(1A)(A),(B),and(C),iftheMayordetermines
thatsuch an extensionisappropriatetoprotectpublicsafetyor publicor privateproperty.
“(b)An administrativeorderissuedby theMayor undersubsection(a)of thissection
shall:
“(1)Statethebasisfortheextensionofthejuvenilecurfewhours;
“(2)StatethelocationsintheDistrictwheretheextendedjuvenilecurfewhours
shallapplyorstatethattheextendedjuvenilecurfewhoursshallapplythroughouttheDistrict;
and
“(3)Statethedays and hoursduringwhich theextendedjuvenilecurfew hours
shallbe ineffect;provided,thattheextendedjuvenilecurfew hours:
“(A)Shallnotbeginearlierthan8:00p.m.,norextendpast6:00a.m.,on
anyday;
“(B)Shallnotremainineffectformorethan4consecutivedays,exceptas
providedinsubsection(c)ofthissection;and
“(C)Shallnotapplytogroupsof8 orfewerindividuals.
“(c)Exceptwhereemergencycircumstances,asdeterminedbytheMayoranddescribed
intheadministrativeorderissuedunder subsection(a)of thissection,warrantotherwise,
extendedjuvenilecurfew hoursimposed underthissectionshallnot takeeffectuntilatleast24
hoursaftertheissuanceof theadministrativeorder.
“(d)Noticeof theissuanceof each administrativeorderissuedunder thissectionshallbe
promptlypostedonthemainwebsiteoftheDistrictgovernmentandonthewebsiteofthe
MetropolitanPoliceDepartment.
“(¢)TheMayormayextendthetimeperiodduringwhichextendedjuvenilecurfewhours
imposedbythissectionshallremainineffectbyissuingsubsequentMayor'sordersextending
thetime period;provided,thateach such extensionofthe time periodshallnotexceed30 days.

“(6Ifmembersof theMetropolitanPoliceDepartmentdiscoverjuvenilesinthe
designatedextended juvenilecurfew hourszone duringthehoursof curfew,theMetropolitan.
PoliceDepartmentshall:
“(1)Wherethere:
«(A)Isnotanimminentdangerofbodilyinjuryorsignificantdamageto
property,issueatleast2clearlyaudibleandunderstandablenoticesofviolationofcurfew;or
*(B)Isimminentdangerofbodilyinjuryorsignificantdamagetoproperty,
issueatleastone clearlyaudibleand understandablenoticeof violationof curfew;
“(2)Providejuvenilesareasonableandadequatetimetodisperse;and
“(3)Captureonbody-worncameraeachcomponentoftheordertoreturnhome
describedinparagraph(1)ofthissubsection.
“Sec.3b.Temporarydesignationsofextendedjuvenilecurfewhourzones.
“(a)TheChiefofPolicemaydesignateanyareaoftheDistrictasanextendedjuvenile
curfewhourszone,inwhich extendedjuvenilecurfewhoursdeterminedby theChiefof Police
shallapply,iftheChiefof Policedeterminesthatthedesignationof theextendedjuvenilecurfew
hourszone isappropriatetoprotectpublicsafetyor publicor privatepropertyintheextended
juvenilecurfewhourszone.
“(b)To designatean extendedjuvenilecurfewhourszone,theChiefof Policeshallissue
an orderthatincludes:
“(1)The basisforthedesignationof theextendedjuvenilecurfew hourszone;
“(2)Theboundariesoftheextendedjuvenilecurfewhourszone;
“(3)The days and hoursof theextendedjuvenilecurfew hoursintheextended
juvenilecurfewhourszone;provided,thattheextendedjuvenilecurfew hoursintheextended
juvenilecurfewhourszone:
“(A)Shallnotbeginearlierthan8:00p.m.,norextendpast6:00a.m.,on
anyday;
“(B)Shallnotremain ineffectformore than4 consecutivedays,exceptas
providedinsubsection(e)ofthissection;and
“(C)Shallnotapplytogroupsof8 orfewerindividuals.
“(c)Indeterminingwhethertodesignatean extendedjuvenilecurfewhourszone,the
Chief of Policeshallconsiderthefollowing:
“(1)Withinthepreceding30days,theoccurrenceof:“(A)Juvenilecurfewviolationsintheproposedextendedjuvenilecurfew
hourszone:
“(B)Policereportsof disturbancesof thepublicpeacedescribedinsection
1 of An Act To conferconcurrentjurisdictionon thepolicecourtofthe Districtof Columbia in
certaincases,approvedJuly 16,1912 (37 Stat.192;D.C. OfficialCode § 22-1301),sections6,
3,9,or16of An actforthepreservationofthepublicpeaceandtheprotectionofpropertywithin
theDistrictof Columbia,approvedJuly29, 1892 (27 Stat.323; D.C. OfficialCode § 22-1307,§

“(D)Policereportsofcrimesofviolence,asthattermisdefinedinD.C.OfficialCode§23-1331(4),intheproposedextendedjuvenilecurfewhourszone;or
“(E)Policereportsofdestructionofordamagetopublicorprivatepropertyintheproposedextendedjuvenilecurfewhourszone;“(2)Intelligenceorverifiableinformationindicativeofanintentof10ormorejuvenilestogatherintheproposedextendedjuvenilecurfewhourszoneinsuchamannerthatis
likelytoresultinsubstantialharmtothepublicsafety,orthesafetyofthosegathering,orsubstantialdamagetopublicorprivateproperty;and“@)AnyotherverifiableinformationfromwhichtheChiefofPolicemayascertainthatpublicsafetyorpublicorprivatepropertyintheproposedextendedjuvenile
curfewhourszoneislikelytobeendangeredbythepresenceofunaccompaniedjuvenilesintheextendedjuvenilecurfewhourszones.“(d)UponthedesignationofanextendedjuvenilecurfewhourszonetheChiefofPoliceshallpostnoticeofthedesignationonthewebsiteoftheMetropolitanPoliceDepartmentandshallpostsignsintheimmediateareaoftheextendedjuvenilecurfewhourszone.
“(e)TheChiefofPolicemayextendthedurationofthedesignationofan extendedjuvenilecurfewhourszoneto30daysbyissuingasubsequentorderextendingthedurationofthedesignation.“(f)IfmembersoftheMetropolitanPoliceDepartmentdiscoverjuvenilesinthe
tatedextendedjuvenilecurfewhourszoneduringthehoursofcurfew,theMetropolitanDepartmentshall:“(1)Wherethere:
“(A)Isnotanimminentdangerofbodilyinjuryorsignificantdamagetoproperty,issueatleast2clearlyaudibleandunderstandablenoticesofviolationofcurfew;or“(B)Isimminentdangerofbodilyinjuryorsignificantdamagetoproperty,issueatleastoneclearlyaudibleandunderstandablenoticeofviolationofcurfews“(2)Providejuvenilesareasonableandadequatetimetodisperse:and“G)Captureonbody-worncameraeachcomponentoftheordertoreturnhomedescribedinparagraph(1)fothissubsection
“(g)(1)AnAdvisoryNeighborhoodCommission,businessimprovementdistrict,orMainStreetorganizationmaypetitiontheChiefofPolicetoestablishanextendedjuvenilecurfewhourszoneinanareacoveredby.oradjacenttotheareacoveredby,suchentity.Suchpetition

shallbeapprovedbyaformalvoteofthemembersoftheAdvisoryNeighbothoodCommission,
themembersoftheboardofthebusinessimprovementdistrict,orthemembersoftheboardof
theMainStreetorganization.
“(2)A petitionsubmittedpursuanttothissubsectionshallincludethefollowing
information:
“(A)Theproposedboundariesoftheextendedjuvenilecurfewhourszone:
“(B)Theproposedhoursoftheextendedjuvenilecurfew;“(C)Theproposedduration,indays,oftheproposedextendedjuvenile
curfewhours;
“(D)ThereasonswhytheAdvisoryNeighborhoodCommission,business
improvementdistrict,orMainStreetorganizationisrequestingthedesignationofanextended
juvenilecurfewhourszone;and
“(E)SuchotherinformationastheChiefofPolicemayrequire.
“(3)Considerationofa petitionsubmittedunderthissection,andthe
determinationofwhethertodesignateanextendedjuvenilecurfewhourszoneinresponsetothe
petition,shallbeatthesolediscretionoftheChiefofPolice.”

TheCounciladoptsthefiscalimpactstatementoftheChiefFinancialOfficerasthefiscalimpactstatementrequiredbysection4aoftheGeneralLegislativeProceduresActof1975.approvedOctober16,2006(120Stat.2038:D.C.OfficialCode§1-301.47a).

Sec.4.Effectivedate,
ThisactshalltakeeffectfollowingapprovalbytheMayor(orintheeventofvetobytheMayor,actionbytheCounciltooverridetheveto)andshallremainineffectfornolongerthan90days,asprovidedforemergencyactsoftheCounciloftheDistrictofColumbiainsection
