Dear Chairman Mendelson:
Enclosed for consideration and adoption by the Council of the District of Columbia is legislation entitled
“Proposed Closing of a Public Alley in Square 3524, S.O. 23-06402, Act of 2025”,
“Proposed Closing of a Public Alley in Square 3524, S.O. 23-06402, Temporary Act of 2025”,
“Proposed Closing of a Public Alley in Square 3524, S.O. 23-06402, Emergency Act of 2025”, and
“Proposed Closing of a Public Alley in Square 3524, S.O. 23-06402, Emergency Declaration Resolution
of 2025”.
The purpose of this legislation is to allow for the consolidation of several lots around an excess portion
of the alley system in Square 3524 to be closed to create allow for the development of 27 residential
units that will be sold as a combination of two-family townhouses and single-family homes in Ward 5.
Pursuant to D.C. Official Code § 9-202.02, the Surveyor drew a draft plat showing the portion of the
alley proposed to be closed and the lot to which title of the proposed alley closing would revert and
provided notice to relevant parties. The affected District agencies and public utilities responded either in
support of, or not objecting to, the proposed alley closing, although the District Department of
Transportation included two conditions in its letter of no objection. Advisory Neighborhood Commission
5F submitted a resolution in support of this application.
I urge the Council to take prompt and favorable action on the enclosed legislation.

18 BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may
19 be cited as the "Closing ofa Portion of a Public Alley in Square 3524, S.O. 23-06402, Act of2025."
20 Sec. 2. Pursuant to Section 201 of the Street and Alley Closing Acquisition Procedures Act of
21 1982, effective March 10, 1983 (D.C. Law 4-20 I; D .C. Official Code §9-202.01 et seq) ("Act") the
22 Council finds that the portion of the public alley in Square 3524 shown on the Surveyor's plat filed under
23 S.O. 23-06402 is unnecessary for alley purposes and orders it closed, with title to the land to vest as
24 shown on the Surveyor's plat. The approval of the Council for the alley closing is contingent upon the
25 satisfaction of all the conditions set forth in the official S.O. 23-06402 file, including that prior to the
26 recordation of the plat by the Surveyor, the District Department of Transportation ("DDOT") shall
27 confirm that:
28 (a) DDOT has received from the owner of Lot 53 in Square 3524 the $4,265 cost of removing the
29 existing street lighting on the portion of the alley to be closed; and
30 (b) A Tree Protection Plan for the Special Tree located on the portion of the alley to be closed or a
31 permit to remove that Special Tree has been approved by DDOT's Urban Forestry Division.

OVERVIEW
BrianBrown(the“Applicant”seekstocloseanexistingpublicalleywithinSquare3524tofacilitatethedevelopmentof26residentialunits.ThisdevelopmentprojectisunderreviewbytheZoningCommission(ZC)forPlannedUnitDevelopment(PUD)approval(ZCCaseNo.23-24).ThedevelopmentsiteisboundedbyMckinleyTechnologyHighSchooltothenorth,publicalleystothewestandsouth,and FirstStreetNEtotheeast.
OPERATIONS
Thesitecurrentlycontainsa20-footdead-endpublicalleythatrunsnorth-southfromtheretainingwallatthesouthernedgeoftheMcKinleyTechnologyHighSchoolcampustotheeast-westalleythatformsthesouthernborderofthedevelopmentsite.Duetothisretainingwallandagradedifferenceofroughlyeight(8)feet,thealleydoesnotprovidevehicularorpedestrianaccesstotheschoolcampus.ThealleyservesfourpropertiesinSquare3524:Lots52,53and802,whichareownedbytheApplicant,andLot54,whichisnotownedbytheApplicant.

SpecialTreesarebetween44inchesand99.99inchesincircumference.SpecialTreesmayberemovedwithapermit.However,ifaSpecialTreeisdesignatedtoremainbyUrbanForestryDivision,aTreeProtectionPlan(TPP)willberequired.
