Public Benefits Security Amendment Act of 2026

This law requires the Department to issue new EBT cards with security chips by October 1, 2027, and allows recipients to get up to two months of stolen benefits restored if they report fraud within six months.

What This Bill Does

  • Requires the Department of Human Services to issue updated EBT cards with EMV chip technology by October 1, 2027.
  • Allows the Department to restore up to two months of correctly issued public assistance for recipients who lose benefits due to theft by fraudulent means.
  • Sets a rule that recipients must report stolen benefits within six months of the incident to qualify for restoration.
  • Extends the Flexible Rent Subsidy Pilot Program by one year through Fiscal Year 2027.
  • Defines terms such as cloning, phishing, and skimming in relation to EBT card theft.

  • The Department of Human Services
  • Participants in the Flexible Rent Subsidy Pilot Program

Cloning

Phishing
A technique where the person asking for information pretends to be someone else to steal sensitive data like EBT details.
