1998toexpandthemembershipofthePoliceComplaintsBoard,andtoallowtheOfficeofPoliceComplaints’ExecutiveDirectortoinitiatetheirowncomplaintiftheydiscoverevidenceofabuseormisuseofpolicepowersthatwasnotallegedintheoriginalcomplaint,includingthefailuretointerveneorreporttoasupervisorwhenanotherofficerusedexcessiveforce,engagedinotherformsofmisconduct,orviolatedaruleor
regulation;andtoamendChapter3ofTitle14oftheDistrictofColumbiaOfficialCodetoclarifythatcertainprovisionsonlyapplytoavictimwhoisundertheageof18.

Sec.2.TheOfficeofCitizenComplaintReviewEstablishmentActof1998,effective
March26,1999(D.C.Law12-208;D.C.OfficialCode§5-1101etseq.),isamendedasfollows:
(a)Section4(D.C.OfficialCode§5-1103)isamendedbyaddinganewparagraph(3B)
toreadasfollows:
“(3B)“MPD”meanstheMetropolitanPoliceDepartment.”.
(b)Section5(a)(D.C.OfficialCode§5-1104(a))isamendedbystrikingthephrase“ThereisestablishedaPoliceComplaintsBoard(“Board”).TheBoardshallbecomposedof5members,oneofwhomshallbeamemberoftheMPD,and4ofwhomshallhavenocurrentaffiliationwithanylawenforcementagency.”andinsertingthephrase“Thereisestablisheda
PoliceComplaintsBoard.‘TheBoardshallbecomposedof9members,whichshallincludeonememberfromeachWardandoneat-largemember,noneofwhom,aftertheexpirationofthetermofthecurrentlyservingmemberoftheMPD,shallbeaffiliatedwithanylawenforcement

“(g-1)(1)IftheExecutiveDirectordiscoversevidenceofabuseormisuseofpolicepowersthatwasnotallegedbythecomplainantinthecomplaint,theExecutiveDirectormay:
“(A)InitiatetheExecutiveDirector’sowncomplaintagainstthesubjectpoliceofficer;and
“@B)Takeanyoftheactionsdescribedinsubsection(g)(2)through(6)ofthissection.
“(2)Theauthoritygrantedpursuanttoparagraph(1)ofthissubsectionshallincludecircumstancesinwhichthesubjectpoliceofficerfailedto:
(A)Interveneinorsubsequentlyreportanyuseofforceincidentinwhichthesubjectpoliceofficerobservedanotherlawenforcementofficer,includinganMPD officer,utilizingexcessiveforceorengaginginanytypeofmisconduct,pursuanttoMPD GeneralOrder901.07,itssuecessordirective,orasimilarlocalorfederaldirective;or
“(B)ImmediatelyreporttotheirsupervisoranyviolationsoftherulesandregulationsoftheMPD committedbyanyotherMPD officer,andeachinstanceoftheiruseofforceorauseofforcecommittedbyanotherMPD officer,pursuanttoMPD GeneralOrder201.26,oranysuccessordirective.”,
(2)Subsection(h)isamendedbystrikingthephrase“subsection(g)”andinsertingthephrase“subsection(g)or(g-1)”initsplace,

Section2shallexpireontheapplicabilitydateofsection105oftheComprehensivePolicingandJusticeReformAmendmentActof2022,effectiveApril21,2023(D.C.Law24-345;70DCR953).
Sec.5.Fiscalimpactstatement.
TheCounciladoptsthefiscalimpactstatementoftheBudgetDirectorasthefiscalimpactstatementrequiredbysection4aoftheGeneralLegislativeProceduresActof1975,approvedOctober16,2006(120Stat.2038;D.C.OfficialCode§1-301.47a).
Sec.6,Effectivedate.
ThisactshalltakeeffectfollowingapprovalbytheMayor(orintheeventofvetobytheMayor,actionbytheCounciltooverridetheveto)andshallremainineffectfornolongerthan90days,asprovidedforemergencyactsoftheCounciloftheDistrictofColumbiainsection412(a)oftheDistrictofColumbiaHomeRuleAct,approvedDecember24,1973(87Stat.788;
D.C.OfficialCode§1-204.12(a)).
