Background Check Adjustment Amendment Act of 2026

This law allows the Mayor to authorize certain non-governmental youth service groups to perform their own criminal background checks and clarifies that individuals can agree to share those records with other states or areas.

What This Bill Does

  • Allows the Mayor to authorize a covered youth services provider (a non-governmental group) to conduct background check functions for its applicants, employees, and volunteers.
  • Requires authorized private groups to submit all records they obtain from these checks back to the Mayor.
  • Updates rules so that criminal history or traffic record information received by either the Mayor or an approved private entity can be used as required by law.
  • Clarifies that a person may consent to having their background check records released so another jurisdiction (like another state) can perform a criminal history or traffic records check.

Who It Names or Affects

  • Non-governmental covered youth services providers in the District of Columbia
  • Applicants, employees, and volunteers working with these authorized groups
  • The Mayor's office responsible for receiving background check records

Terms To Know

Covered youth services provider
A non-governmental entity that works with children or young people and is authorized by the Mayor to perform background checks.
Jurisdiction
Another city, state, or government area where a person might need a criminal history or traffic records check for work or volunteering.

Limits and Unknowns

  • The law does not define exactly which groups qualify as 'covered youth services providers' in this text.
  • It is unclear how long the Mayor must keep records sent by private entities before they are destroyed or archived, as that detail is not included here.
  • The text does not explain what happens if a person refuses to let their record go to another jurisdiction.
