IN THE COUNCIL OF THE DISTRICT OF COLUMBIA.
ToamendtheCriminalBackgroundChecksfortheProtectionofChildrenActof2004toallow
authorizedcoveredyouthservicesproviderstoperformbackgroundchecksonbehalfoftheiremployeesandtosimplifycross-jurisdictionalbackgroundchecks.BEITENACTEDBY THECOUNCILOFTHEDISTRICTOFCOLUMBIA,Thatthis
actmaybecitedasthe“BackgroundCheckAdjustmentsAmendmentActof2025”.
Sec.2.TheCriminalBackgroundChecksfortheProtectionofChildrenActof2004,
effectiveApril13,2005(D.CLaw15-353;D.C.OfficialCode§4-1501.01erseg.),isamended
asfollows:
(a)Section205(c)(3)(D.C.OfficialCode§4-1501.05(c)(3))isamendedbystrikingthe
phrase“Mayorofthe”andinsertingthephrase“Mayororthe”initsplace.
(b)A newsection206bisaddedtoreadasfollows:
“Sec.206b.Privateentitiesauthorizedtoconductbackgroundchecks.
“TheMayormayauthorizeaprivateentitythatisacoveredyouthservicesproviderto
performthebackgroundcheckfunctionsandproceduresdescribedinsections203(a)and205for
theentity’semployeesandvolunteers;provided,thattheentitysubmitsanyrecordsobtained
pursuantto such authorizationtothe Mayor forusesconsistentwith thisact.”.

Sec.3.Fiscalimpactstatement.
TheCounciladoptsthefiscalimpactstatementinthecommitteereportasthefiscal
impactstatementrequiredbysection4aoftheGeneralLegislativeProceduresActof1975,
approvedOctober16,2006(120Stat.2038;D.C.OfficialCode§1-301.47a).
Sec.4.Effectivedate.
ThisactshalltakeeffectfollowingapprovalbytheMayor(orintheeventofvetobythe
Mayor,actionbytheCounciltooverridetheveto)anda30-dayperiodofcongressionalreview
asprovidedinsection602(c)(1)oftheDistrictofColumbiaHomeRuleAct,approvedDecember
24, 1973 (87 Stat.813;D.C. OfficialCode § 1-206.02(c)(1)).
