Toamend,onanemergencybasis,theJuvenileCurfewActof1995toauthorizetheMayortoextendthejuvenilecurfewhoursintheDistrictwhenappropriatetoprotectpublicsafetyorpublicorprivateproperty,toauthorizetheChiefofPolicetoestablishextendedjuvenilecurfewhourzonesinspecifiedcircumstances,tostartthejuvenilecurfewhours
at11pam.everyday,andtoextendtheapplicabilityofthejuvenilecurfewto17-yearolds;andtoamendtheVolunteerServicesClarificationTemporaryAmendmentActof2025tomakeconformingchanges.
BEITENACTEDBY THECOUNCILOFTHEDISTRICTOFCOLUMBIA,Thatthisactmaybecitedasthe“JuvenileCurfewSecondEmergencyAmendmentActof2025”.
Sec.2.TheJuvenileCurfewActof1995,effectiveSeptember20,1995(D.C.Law11-48;D.C,OfficialCode§2-1541etseq.),isamendedasfollows:
(a)Section3(D.C.OfficialCode§2-1542)isamendedasfollows:
(1)Paragraph(1)isamendedtoreadasfollows:
“(1)“ChiefofPolice”meanstheChiefoftheMetropolitanPoliceDepartment.”
(2)A newparagraph(1A)isaddedtoreadasfollows:
“(1A)“Curfewhours”means:
“(A)From11:00p.m.everydayuntil6:00a.m,onthefollowingday;
“(B)ExtendedcurfewhoursestablishedbytheMayorpursuanttosection3a;and
“(C)ExtendedcurfewhoursinextendedjuvenilecurfewzonesestablishedbytheChiefofPolicepursuanttosection3b.”.
(3)Paragraph(5)isamendedbystrikingthephrase“undertheageof17years”andinsertingthephrase“undertheageof18years”initsplace.
(4)A newparagraph(6A)isaddedtoreadasfollows:
“(6A)“Noticeofviolationofcurfew”meansaverbalwarning,authorizedbyan
officialthatinformsagroupsofjuvenilesthattheyareviolatingthetermsofa curfew,thatthey

may be arrestedifthey continueto violatethecurfew,and identifiesreasonablestepsthatthey
can taketo leavetheareatoavoidarrest.”.
(b)New sections3aand3bareaddedtoreadasfollows:
“Sec,3a.Temporaryextensionsofjuvenilecurfewhours.
“(a)The Mayor may, by issuanceof an administrativeorderpursuantto section422(11)
of the Districtof Columbia Home Rule Act,effectiveDecember 24, 1973 (87 Stat.790; D.C.
OfficialCode § 1-204.22(11),extendthejuvenilecurfew hoursintheDistrict,or any partofthe
District,beyondthehoursestablishedinsection3(1.A)(A),(B),and(C),iftheMayordetermines
thatsuch an extensionisappropriatetoprotectpublicsafetyorpublicor privateproperty.
“(b)An administrativeorderissuedbytheMayorundersubsection(a)ofthissection
shall:
“(1)Statethebasisfortheextensionofthejuvenilecurfewhours;
“(2)StatethelocationsintheDistrictwhere theextendedjuvenilecurfew hours
shallapplyorstatethattheextendedjuvenilecurfewhoursshallapplythroughouttheDistrict;
and
““(3)Statethedays and hours duringwhich theextendedjuvenilecurfew hours
shallbeineffect;provided,thattheextendedjuvenilecurfewhours:
“(A) Shallnotbegin earlierthan8:00p.m.,nor extendpast6:00 a.m.,on
anyday;
“(B)Shallnotremainineffectformorethan4consecutivedays,exceptas
providedinsubsection(e)ofthissection;and
“(C)Shallnotapplytogroupsof8 orfewerindividuals.
“(c)Exceptwhereemergencycircumstances,asdeterminedbytheMayoranddescribed
intheadministrativeorderissuedunder subsection(a)of this section,warrantotherwise,
extendedjuvenilecurfew hours imposed under thissectionshallnottakeeffectuntilatleast24
hours aftertheissuanceof theadministrativeorder.
“(d)Noticeof the issuanceof each administrativeorderissuedunderthissectionshalibe
promptlypostedon themain websiteoftheDistrictgovernmentandon thewebsiteofthe
MetropolitanPoliceDepartment.
“(@)TheMayormayextendthetimeperiodduringwhichextendedjuvenilecurfewhours
imposedbythissectionshallremainineffectbyissuingsubsequentMayor’sordersextending
thetime period;provided,thateach such extensionof the time periodshallnotexceed 30 days.
“(f)IfmembersoftheMetropolitanPoliceDepartmentdiscoverjuvenilesinthe
designatedextendedjuvenilecurfew hours zone duringthehoursof curfew,theMetropolitan
PoliceDepartmentshall:
“(1)Where there:
*(A)Isnotanimminentdangerofbodilyinjuryofsignificantdamageto
property,issueatleast2 clearlyaudibleand understandablenoticesofviolationof curfew;or

“(B)Isimminentdangerofbodilyinjuryorsignificantdamageto
property,issueatleastone clearlyaudibleand understandablenoticeofviolationofcurfew;
“(2)Providejuvenilesareasonableandadequatetimetodisperse;and
“(3)Captureon body-worn camera each component of theorderto returnhome
describedinparagraph(1)ofthissubsection.
“Sec.3b.Temporarydesignationsofextendedjuvenilecurfewhourzones.
“(a)The Chiefof Policemay designateany areaof theDistrictas an extendedjuvenile
curfew hourszone,inwhich extendedjuvenilecurfew hoursdeterminedby theChiefof Police
shallapply,iftheChiefofPolicedeterminesthatthedesignationoftheextendedjuvenilecurfew
hourszoneisappropriatetoprotectpublicsafetyorpublicorprivatepropertyintheextended
juvenilecurfewhourszone.“(b)To designatean extendedjuvenile curfew hourszone,theChiefof Police shallissue
an orderthatincludes:
“(1)Thebasisforthedesignationoftheextendedjuvenilecurfewhourszone;
““(2)The boundariesof the extendedjuvenilecurfew hourszone;and
“(3)The days and hoursof the extendedjuvenilecurfew hoursintheextended
juvenilecurfewhourszone;provided,thattheextendedjuvenilecurfewhours intheextended
juvenilecurfewhourszone:
“(A)Shallnotbeginearlierthan8:00p.m.,norextendpast6:00a.m.,on
anyday;
“(B) Shallnot remain ineffectformore than4 consecutivedays,exceptas
providedinsubsection(¢)ofthissection;and
“(C)Shallnotapplytogroupsof8orfewerindividuals.
“(c)In determiningwhether todesignatean extendedjuvenilecurfew hourszone,the
Chief of Policeshallconsiderthefollowing:
“(1)Withinthepreceding30days,theoccurrenceof:
“(A)Juvenilecurfewviolationsintheproposedextendedjuvenilecurfew
hourszone;
“(B)Policereportsofdisturbancesofthepublicpeacedescribedinsection
1 ofAn Act To conferconcurrentjurisdictionon thepolicecourtof theDistrictof Columbia in
certaincases,approved July 16,1912 (37 Stat.192;D.C. OfficialCode § 22-1301),sections6,3,
9,or16ofAn actforthepreservationofthepublicpeaceandtheprotectionofpropertywithin
theDistrictof Columbia,approved July29, 1892 (27 Stat.323; D.C. OfficialCode §§ 22-1307,
22-1309,22-1312,or 22-1318),section211 of theDistrictof Columbia Law EnforcementAct of
1953,approved June 29, 1953 (67 Stat.98; D.C. OfficialCode § 22-1321),or section901 of An
Act relatingtocrime and criminalprocedureintheDistrictof Columbia, approvedDecember 27,
1967 (81 Stat.742;D.C. OfficialCode § 22-1322),intheproposedextendedjuvenile curfew
hourszone;

“()Policereportsofdestructionofordamagetopublicorprivate
propertyintheproposedextendedjuvenilecurfewhourszone;
“(2)Intelligenceorverifiableinformationindicativeof an intentof 9 ormore
juvenilestogatherintheproposedextendedjuvenilecurfewhourszoneinsuchamannerthatis,
likelytoresultinsubstantialharmtothepublicsafety,thesafetyofthosegathering,or
substantialdamagetopublicorprivateproperty;and
“(3)AnyotherverifiableinformationfromwhichtheChiefofPolicemay
ascertainthatpublicsafetyorpublicorprivatepropertyintheproposedextendedjuvenile
curfewhourszoneislikelytobeendangeredbythepresenceofunaccompaniedjuvenilesinthe
extended juvenilecurfewhourszones.
“(d)UponthedesignationofanextendedjuvenilecurfewhourszonetheChiefofPolice
shallpostnoticeofthedesignationonthewebsiteoftheMetropolitanPoliceDepartmentand
shallpostsignsintheimmediateareaoftheextendedjuvenilecurfewhourszone.
“(¢)TheChiefofPolicemayextendthedurationofthedesignationofanextended
juvenilecurfewhourszoneto30daysbyissuingasubsequentorderextendingthedurationof
thedesignation.
“(f)IfmembersoftheMetropolitanPoliceDepartmentdiscoverjuvenilesinthe
designatedextendedjuvenilecurfew zone duringthehoursof curfew,theMetropolitanPolice
Departmentshall:
“(1)Wherethere:
“(A)Isnotanimminentdangerofbodilyinjuryorsignificantdamageto
property,issueatleast2 clearlyaudibleand understandablenoticesofviolationof curfew;or
“(B)Isimminentdangerofbodilyinjuryorsignificantdamageto
property,issueatleastone clearlyaudibleand understandablenoticeof violationof curfew;
“(2)Providejuvenilesareasonableandadequatetimetodisperse;and
“(3)Captureonbody-worncameraeachcomponentoftheordertoreturnhome
describedinparagraph(1)ofthissubsection.
“(g)(1)An AdvisoryNeighborhoodCommission,businessimprovementdistrict,orMain
StreetorganizationmaypetitiontheChiefofPolicetoestablishanextendedjuvenilecurfew
hourszoneinanareacoveredby,oradjacenttotheareacoveredby,suchentity.Suchpetition
shallbeapprovedbyaformalvoteofthemembersoftheAdvisoryNeighborhoodCommission,
themembers of theboard ofthebusinessimprovement district,or themembers of theboard of
theMainStreetorganization.
“(2)A petitionsubmittedpursuanttothissubsectionshallincludethefollowing
information:

“(A)Theproposedboundariesoftheextendedjuvenilecurfewhourszone;
“(B)Theproposedhoursoftheextendedjuvenilecurfew;
“(C)Theproposedduration,indays,oftheproposedextendedjuvenilecurfewhours;
“(D)ThereasonswhytheAdvisoryNeighborhoodCommission,businessimprovementdistrict,orMainStreetorganizationisrequestingthedesignationofanextendedjuvenilecurfewhourszone;and
“(E)SuchotherinformationastheChiefofPolicemayrequire.
“(3)Considerationofapetitionsubmittedunderthissection,andthedeterminationofwhethertodesignateanextendedjuvenilecurfewhourszoneinresponsetothepetition,shallbeatthesolediscretionoftheChiefofPolice.”.
Sec.3.Amendatorysection3(1A)withinsection3(a)(2)oftheVolunteerServicesTemporaryAmendmentActof2025,enactedonOctober24,2025(D.C.Act26-175;_ DCR__),isamendedtoreadasfollows:
(LA)“Curfewhours”means:
“(A)From11:00p.m.everydayuntil6:00a.m,onthefollowingday;
“(B)ExtendedcurfewhoursestablishedbytheMayorpursuanttosection3a;and
“(©)ExtendedcurfewhoursinextendedjuvenilecurfewzonesestablishedbytheChiefofPolicepursuanttosection3b.”.
Sec.4.Fiscalimpactstatement.
The Counciladoptsthefiscalimpactstatementof the Budget Directorasthefiscalimpact
statementrequiredby section4a oftheGeneralLegislativeProceduresAct of 1975,approved
October 16,2006 (120 Stat.2038; D.C. OfficialCode § 1-301.47a).
Sec.5.Effectivedate.
‘ThisactshalltakeeffectfollowingapprovalbytheMayor(orintheeventofvetobytheMayor,actionbytheCounciltooverridetheveto)andshallremainineffectfornolongerthan
