‘Toamend,onatemporarybasis,theJuvenileCurfewActof1995toauthorizetheMayortoextendthejuvenilecurfewhoursintheDistrictwhenappropriatetoprotectpublicsafetyorpublicorprivateproperty,toauthorizetheChiefofPolicetoestablishextendedjuvenilecurfewhourzonesinspecifiedcircumstances,tostartthejuvenilecurfewhours
at[1pam.everyday,andtoextendtheapplicabilityofthejuvenilecurfewto17-yearolds;-andto-amendtheVolunteerServicesClarificationTemporaryAmendmentActof2025tomakeconformingchanges.
BE ITENACTED BY THE COUNCIL OF THE DISTRICTOF COLUMBIA, Thatthis
actmay be citedas the“JuvenileCurfew Second Temporary Amendment Act of 2025”.
Sec.2.The JuvenileCurfew Act of 1995,effectiveSeptember 20, 1995 (D.C.Law 11-48;
D.C. OfficialCode § 2-1541 etseq.),isamended as follows:
(a)Section3(D.C.OfficialCode§2-1542)isamendedasfollows:
(1)Paragraph(1)isamendedtoreadasfollows:
“(1)“Chiefof Police”means theChiefof theMetropolitanPoliceDepartment.”.
(2)A newparagraph(1A)isaddedtoreadasfollows:
(LA)“Curfewhours”means:
“(A)From11:00p.m.everydayuntil6:00a.m.onthefollowingday;
“(B)ExtendedcurfewhoursestablishedbytheMayorpursuanttosection
3a;and
“(C) Extended curfew hoursinextendedjuvenilecurfew zones established
by theChiefof Policepursuanttosection3b.”.
(3)Paragraph(5)isamendedbystrikingthephrase“undertheageof17 years”
andinsertingthephrase“undertheageof18years”initsplace.
(4)A newparagraph(6A)isaddedtoreadasfollows:
(6A)“Noticeofviolationofcurfew”meansaverbalwarning,authorizedbyan
officialthatinformsa groupsofjuvenilesthattheyareviolatingthetermsofa curfew,thatthey

maybearrestediftheycontinuetoviolatethecurfew,andidentifiesreasonablestepsthattheycantaketoleavetheareatoavoidarrest.”.
(b)Newsections3aand3bareaddedtoreadasfollows:
“Sec,3a,Temporaryextensionsofjuvenilecurfewhours.
“(a)TheMayormay,byissuanceofan administrativeorderpursuanttosection422(11)oftheDistrictofColumbiaHomeRuleAct,effectiveDecember24,1973(87Stat.790;D.C.OfficialCode§1-204.22(11)),extendthejuvenilecurfewhoursintheDistrict,oranypartoftheDistrict,beyondthehoursestablishedinsection3(1A)(A),(B),and(C),iftheMayordeterminesthatsuchanextensionisappropriatetoprotectpublicsafetyorpublicorprivateproperty.“(b)AnadministrativeorderissuedbytheMayorundersubsection(a)ofthissectionshall:
“(1)Statethebasisfortheextensionofthejuvenilecurfewhours;2) StatethelocationsintheDistrictwheretheextendedjuvenilecurfewhoursshallapplyorstatethattheextendedjuvenilecurfewhoursshallapplythroughouttheDistrict;and
““()Statethedaysandhoursduringwhichtheextendedjuvenilecurfewhoursshallbeineffect;provided,thattheextendedjuvenilecurfewhours:
(A)Shallnotbeginearlierthan8:00p.m.,norextendpast6:00am.,onanyday;
“(B)Shallnotremainineffectformorethan4consceutivedays,exceptasprovidedinsubsection(e)ofthissection;and
“(C)Shallnotapplytogroupsof8orfewerindividuals.
“(¢)Exceptwhereemergencycircumstances,asdeterminedbytheMayoranddescribed
intheadministrativeorderissuedundersubsection(a)ofthissection,warrantotherwise,
extendedjuvenilecurfew hoursimposed underthissectionshallnot takeeffectuntilatleast24
hoursaftertheissuanceof theadministrativeorder.
“(d)Noticeofthe issuanceof eachadministrativeorderissuedunderthissectionshallbe
promptlypostedon themain websiteoftheDistrictgovernmentand on thewebsiteofthe
MetropolitanPoliceDepartment.
“(e)The Mayor may extendthedurationof thedesignationof an extended juvenile
curfewhourszoneto30daysbyissuingasubsequentorderextendingthedurationofthe
designation.
“()IfmembersoftheMetropolitanPoliceDepartmentdiscoverjuvenilesinthe
designatedextendedjuvenilecurfewhourszoneduringthehoursofcurfew,theMetropolitanPoliceDepartmentshall:
“(1)Wherethere:
“(A)Isnotanimminentdangerofbodilyinjuryofsignificantdamagetoproperty,issueatleast2 clearlyaudibleand understandablenoticesofviolationofcurfew; or

“(B)Isimminentdangerofbodilyinjuryorsignificantdamagetoproperty,issueatleastoneclearlyaudibleandunderstandablenoticeofviolationofcurfew;“(2)Providejuvenilesareasonableandadequatetimetodisperse;and“(3)Captureonbody-worncameraeachcomponentoftheordertoreturnhomedescribedinparagraph(1)ofthissubsection.
“Sec.3b.Temporarydesignationsofextendedjuvenilecurfewhourzones.“(a)TheChiefofPolicemaydesignateanyareaoftheDistrictasanextendedjuvenilecurfewhourszone,inwhichextendedjuvenilecurfewhoursdeterminedbytheChiefofPoliceshallapply,iftheChiefofPolicedeterminesthatthedesignationoftheextendedjuvenilecurfewhourszoneisappropriatetoprotectpublicsafetyorpublicorprivatepropertyintheextendedjuvenilecurfewhourszone.“(b)Todesignateanextendedjuvenilecurfewhourszone,theChiefofPoliceshallissueanorderthatincludes:
“(1)Thebasisforthedesignationoftheextendedjuvenilecurfewhourszone;“(2)Theboundariesoftheextendedjuvenilecurfewhourszone;and“(3)Thedaysandhoursoftheextendedjuvenilecurfewhoursintheextended‘juvenileCurfewhoutsZone:provided,thattheextendedjuvenilecurfewhoursintheextendedjuvenilecurfewhourszone:
“(A)Shallnotbeginearlierthan8:00p.m.,norextendpast6:00a.m.,onanyday; “(B)Shallnotremainineffectformorethan4consecutivedays,exceptasprovidedinsubsection(e)ofthissection;and
“(©Shallnotapplytogroupsof8 orfewerindividuals.
“(c)Indeterminingwhethertodesignateanextendedjuvenilecurfewhourszone,theChiefofPoliceshallconsiderthefollowing:
“(1)Withinthepreceding30days,theoccurrenceof:
“(A)Juvenilecurfewviolationsintheproposedextendedjuvenilecurfewhourszone;
“(B)Policereportsofdisturbancesofthepublicpeacedescribedinsection1ofAnActToconferconcurrentjurisdictiononthepolicecourtoftheDistrictofColumbiaincertaincases,approvedJuly16,1912(37Stat.192;D.C.OfficialCode§22-1301),sections6,3,9,or16ofAnactforthepreservationofthepublicpeaceandtheprotectionofpropertywithintheDistrictofColumbia,approvedJuly29,1892(27Stat.323:D.C.OfficialCode§§22-1307,22-1309,22-1312,or22-1318),section211oftheDistrictofColumbiaLawEnforcementActof1953,approvedJune29,1953(67Stat.98;D.C.OfficialCode§22-1321),orsection901ofAnActrelatingtocrimeandcriminalprocedureintheDistrictofColumbia,approvedDecember27,1967(81Stat.742;D.C.OfficialCode§22-1322),intheproposedextendedjuvenilecurfewhourszone;

“(©Policereportsofdangerouscrimes,asthattermisdefinedinD.C.OfficialCode§23-1331(3),intheproposedextendedjuvenilecurfewhourszone;“(D)Policereportsofcrimesofviolence,asthattermisdefinedinD.C.OfficialCode§23-1331(4),intheproposedextendedjuvenilecurfewhourszone;or
“(E)Policereportsofdestructionofordamagetopublicorprivatepropertyintheproposedextendedjuvenilecurfewhourszone;“(2)Intelligenceorverifiableinformationindicativeofanintentof9ormorejuvenilestogatherintheproposedextendedjuvenilecurfewhourszoneinsuchamannerthatislikelytoresultinsubstantialharmtothepublicsafety,thesafetyofthosegathering,orsubstantialdamagetopublicorprivateproperty;and
“@3)AnyotherverifiableinformationfromwhichtheChiefofPolicemayascertainthatpublicsafetyorpublicorprivatepropertyintheproposedextendedjuvenilecurfewhourszoneislikelytobeendangeredbythepresenceofunaccompaniedjuvenilesintheextendedjuvenilecurfewhourszones.
“(d)Uponthedesignationofan extendedjuvenilecurfewhourszonetheChiefofPoliceshallpostnoticeofthedesignationonthewebsiteoftheMetropolitanPoliceDepartmentandshallpostsignsintheimmediateareaoftheextendedjuvenilecurfewhourszone.“(¢)TheChiefofPolicemayextendthedurationofthedesignationofan extendedjuvenilecurfewhourszoneto30daysbyissuingasubsequentorderextendingthedurationofthedesignation.
“(f)IfmembersoftheMetropolitanPoliceDepartmentdiscoverjuvenilesinthedesignatedextendedjuvenilecurfewzoneduringthehoursofcurfew,theMetropolitanPoliceDepartmentshall:
“(1)Wherethere:
“(A)Isnotanimminentdangerofbodilyinjuryorsignificantdamagetoproperty,issueatleast2clearlyaudibleandunderstandablenoticesofviolationofcurfew;or
“(B)Isimminentdangerofbodilyinjuryorsignificantdamagetoproperty,issueatleastoneclearlyaudibleandunderstandablenoticeofviolationofcurfew:“2)Providejuvenilesareasonableandadequatetimetodisperse;and“(3)Captureonbody-worncameraeachcomponentoftheordertoreturnhomedescribedinparagraph(1)ofthissubsection.
“(g)(1)AnAdvisoryNeighborhoodCommission,businessimprovementdistrict,orMainStreetorganizationmaypetitiontheChiefofPolicetoestablishanextendedjuvenilecurfewhourszoneinanareacoveredby,oradjacenttotheareacoveredby,suchentity.SuchpetitionshallbeapprovedbyaformalvoteofthemembersoftheAdvisoryNeighborhoodCommission,themembersoftheboardofthebusinessimprovementdistrict,orthemembersoftheboardoftheMainStreetorganization.
“(2)Apetitionsubmittedpursuanttothissubsectionshallincludethefollowing
