Toamend,onanemergencybasis,duetocongressionalreview,theJuvenileCurfewActof1995toauthorizetheMayortoextendthejuvenilecurfewhoursintheDistrictwhenappropriatetoprotectpublicsafetyorpublicorprivateproperty,toauthorizetheChiefofPolicetoestablishextendedjuvenilecurfewhourzonesinspecifiedcircumstances,tostartthejuvenilecurfewhoursat11p.m.everyday,andtoextendtheapplicabilityofthejuvenilecurfewto17-yearolds;andtoamendtheVolunteerServicesClarification‘TemporaryAmendmentActof2025tomakeconformingchanges.
BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
actmaybecitedasthe“JuvenileCurfewCongressionalReviewEmergencyAmendmentActof2026”.
Sec.2.TheJuvenileCurfewActof1995,effectiveSeptember20,1995(D.C.Law11-48;D.C.OfficialCode§2-1541efseq.),isamendedasfollows:(a)Section3(D.C.OfficialCode§2-1542)isamendedasfollows:
(1)Paragraph(1)isamendedtoreadasfollows:
“(1)“ChiefofPolice”meanstheChiefoftheMetropolitanPoliceDepartment.”.(2)A newparagraph(1A)isaddedtoreadasfollows:
“(1A)“Curfewhours”means:“(A)From11:00p.m.everydayuntil6:00a.m.onthefollowingday;
“(B)ExtendedcurfewhoursestablishedbytheMayorpursuanttosection3a;and “(©ExtendedcurfewhoursinextendedjuvenilecurfewzonesestablishedbytheChiefofPolicepursuanttosection3b.”.
(3)Paragraph(5)isamendedbystrikingthephrase“undertheageof17years”andinsertingthephrase“undertheageof18years”initsplace.
(4)A newparagraph(6A)isaddedtoreadasfollows:

“(6A) “Noticeof violationof curfew”means a verbalwarning,authorizedby an
officialthatinformsagroupsofjuvenilesthattheyareviolatingthetermsofa curfew,thatthey
may be arrestedif theycontinuetoviolatethecurfew,and identifiesreasonablestepsthatthey
cantaketoleavetheareatoavoidarrest.”.
(b)New sections3aand3bareaddedtoreadasfollows:
“Sec.3a.Temporaryextensionsofjuvenilecurfewhours.
“(a)The Mayor may, by issuanceof an administrativeorderpursuanttosection422(11)
of theDistrictof Columbia Home Rule Act,effectiveDecember 24,1973 (87 Stat.790;D.C.
OfficialCode§1-204.22(11)),extendthejuvenilecurfewhoursintheDistrict,oranypartofthe
District,beyondthehoursestablishedinsection3(1A)(A),(B),and(C),iftheMayordetermines
thatsuchanextensionisappropriatetoprotectpublicsafetyorpublicorprivateproperty.
“(b)An administrativeorderissuedbytheMayorundersubsection(a)ofthissection
shall:
“(1)Statethebasisfortheextensionofthejuvenilecurfewhours;
“(2)StatethelocationsintheDistrictwhere theextendedjuvenilecurfew hours
shallapplyorstatethattheextendedjuvenilecurfewhoursshallapplythroughouttheDistrict;
and
“(3)Statethedaysandhoursduringwhichtheextendedjuvenilecurfewhours
;provided,thattheextendedjuvenilecurfewhours:
“(A) Shallnotbeginearlierthan8:00p.m.,norextendpast6:00 a.m.,on
shallbe ineffe¢

anyday;
“(B)Shallnotremainineffectformorethan4consecutivedays,exceptas
providedinsubsection(¢)ofthissection;and
*(C)Shallnotapplytogroupsof8 orfewerindividuals.
“(c)Exceptwhereemergencycircumstances,asdeterminedbytheMayoranddescribed
intheadministrativeorderissuedundersubsection(a)ofthis section,warrantotherwise,
extended juvenilecurfewhours imposed underthissectionshallnottakeeffectuntilatleast24
hoursaftertheissuanceofthe administrativeorder.
“(d)Noticeof the issuanceof each administrativeorderissuedunder thissectionshallbe
promptlypostedonthemainwebsiteoftheDistrictgovernmentandonthewebsiteofthe
MetropolitanPoliceDepartment.
“(e)TheMayormayextendthedurationofthedesignationofan extendedjuvenile
curfewhourszoneto30daysbyissuingasubsequentorderextendingthedurationofthe
designation.
“(£)Ifmembers of theMetropolitanPoliceDepartmentdiscoverjuvenilesin the
designatedextendedjuvenilecurfew hourszone duringthehoursof curfew,theMetropolitan
PoliceDepartmentshall:
(1)Wherethere:

“(A)Isnotanimminentdangerofbodilyinjuryofsignificantdamagetoproperty,issueatleast2clearlyaudibleandunderstandablenoticesofviolationofcurfew;or
“(B)Isimminentdangerofbodilyinjuryorsignificantdamagetoproperty,issueatleastoneclearlyaudibleandunderstandablenoticeofviolationofcurfew;
“(2)Providejuvenilesareasonableandadequatetimetodisperse;and
“(3)Captureonbody-worncameraeachcomponentoftheordertoreturnhomedescribedinparagraph(1)ofthissubsection.
“Sec.3b.Temporarydesignationsofextendedjuvenilecurfewhourzones.
“(a)TheChiefofPolicemaydesignateanyareaoftheDistrictasanextendedjuvenile
curfewhourszone,inwhichextendedjuvenilecurfewhoursdeterminedbytheChiefofPoliceshallapply,iftheChiefofPolicedeterminesthatthedesignationoftheextendedjuvenilecurfewhourszoneisappropriatetoprotectpublicsafetyorpublicorprivatepropertyintheextendedjuvenilecurfewhourszone.
“(b)Todesignateanextendedjuvenilecurfewhourszone,theChiefofPoliceshallissueanorderthatincludes:
(1)Thebasisforthedesignationoftheextendedjuvenilecurfewhourszone;
“(2)‘Theboundariesoftheextendedjuvenilecurfewhourszone;and
“@)Thedaysandhoursoftheextendedjuvenilecurfewhoursintheextendedjuvenilecurfewhourszone;provided,thattheextendedjuvenilecurfewhoursintheextendedjuvenilecurfewhourszone:
“(A)Shallnotbeginearlierthan8:00p.m.,norextendpast6:00a.m.,onanyday;
“(B)Shallnotremainineffectformorethan4consecutivedays,exceptasprovidedinsubsection(e)ofthissection;and
“(©Shallnotapplytogroupsof8orfewerindividuals.
“(c)Indeterminingwhethertodesignateanextendedjuvenilecurfewhourszone,theChiefofPoliceshallconsiderthefollowing:
“(1)Withinthepreceding30days,theoccurrenceof:
“(A)Juvenilecurfewviolationsintheproposedextendedjuvenilecurfewhourszone;
“(B)Policereportsofdisturbancesofthepublicpeacedescribedinsection,
1ofAnActToconferconcurrentjurisdictiononthepolicecourtoftheDistrictofColumbiaincertaincases,approvedJuly16,1912(37Stat.192:D.C.OfficialCode§22-1301),sections6,3,9,of16ofAnactforthepreservationofthepublicpeaceandtheprotectionofpropertywithintheDistrictofColumbia,approvedJuly29,1892(27Stat.323;D.C.OfficialCode§§22-1307,22-1309,22-1312,or22-1318),section211oftheDistrictofColumbiaLawEnforcementActof
1953,approvedJune29,1953(67Stat.98;D.C.OfficialCode§22-1321),orsection901ofAnActrelatingtocrimeandcriminalprocedureintheDistrictofColumbia,approvedDecember27,

“(©Policereportsofdangerouscrimes,asthattermisdefinedinD.C,
OfficialCode§23-1331(3),intheproposedextendedjuvenilecurfewhourszone:
“(D) Policereportsof crimesofviolence, as thatterm isdefinedinD.C.
OfficialCode § 23-1331(4),intheproposedextendedjuvenilecurfew hourszone;or
“(E)Policereportsofdestructionofor damagetopublicorprivate
propertyintheproposedextendedjuvenilecurfewhourszone;
“(2)Intelligenceor verifiableinformationindicativeof an intentof 9 or more
juvenilestogatherintheproposedextendedjuvenilecurfewhourszoneinsuchamannerthatis
likelyto resultinsubstantialharm tothepublicsafety,thesafetyof thosegathering,or
substantialdamagetopublicorprivateproperty;and
“(3)Any otherverifiableinformationfrom which theChiefof Police may
ascertainthatpublicsafetyorpublicorprivatepropertyintheproposedextendedjuvenile
curfewhourszoneislikelytobeendangeredbythepresenceofunaccompaniedjuvenilesinthe
extendedjuvenilecurfewhourszones.
“(d)UponthedesignationofanextendedjuvenilecurfewhourszonetheChiefofPolice
shallpostnoticeofthedesignationonthewebsiteoftheMetropolitanPoliceDepartmentand
shallpostsignsintheimmediateareaof theextendedjuvenilecurfew hourszone.
“(e)The Chiefof Policemay extendthedurationofthe designationof an extended
juvenilecurfewhourszoneto30daysbyissuingasubsequentorderextendingthedurationof
thedesignation.
“(®IfmembersoftheMetropolitanPoliceDepartmentdiscoverjuvenilesinthe
designatedextendedjuvenilecurfewzoneduringthehoursofcurfew,theMetropolitanPolice
Departmentshall:
“(1)Wherethere:
“(A)Isnotanimminentdangerofbodilyinjuryorsignificantdamageto
property,issueatleast2clearlyaudibleandunderstandablenoticesofviolationofcurfew;or
“(B)Isimminentdangerofbodilyinjuryorsignificantdamageto
property,issueatleastoneclearlyaudibleandunderstandablenoticeofviolationofcurfew;
“(2)Providejuvenilesa reasonableand adequatetime todisperse;and
“(3)Captureonbody-worncameraeachcomponentoftheordertoreturnhome
describedinparagraph(1)ofthissubsection.
*(g)(1)AnAdvisoryNeighborhoodCommission,businessimprovementdistrict,orMain
Streetorganizationmay petitiontheChiefof Police toestablishan extendedjuvenilecurfew
hourszone inan areacoveredby,or adjacenttotheareacoveredby, such entity.Such petition
shallbe approved by a formalvoteof themembers of theAdvisory Neighborhood Commission,
themembers of theboardofthe businessimprovement district,or themembers of theboardof
theMainStreetorganization,

(2)A petitionsubmittedpursuanttothissubsectionshallincludethefollowinginformation:
“(A)Theproposedboundariesoftheextendedjuvenilecurfewhourszone:
“(B)Theproposedhoursoftheextendedjuvenilecurfew;
“(C)Theproposedduration,indays,oftheproposedextendedjuvenilecurfewhours;
“(D)ThereasonswhytheAdvisoryNeighborhoodCommission,businessimprovementdistrict,orMainStreetorganizationisrequestingthedesignationofanextendedjuvenilecurfewhourszone;and
“(B)SuchotherinformationastheChiefofPolicemayrequire.
“(3)Considerationofapetitionsubmittedunderthissection,andthedeterminationofwhethertodesignateanextendedjuvenilecurfewhourszoneinresponsetothepetition,shallbeatthesolediscretionoftheChiefofPolice.”.
Sec.3.TheVolunteerServicesTemporaryAmendmentActof2025,effectiveDecember18,2025(D.C.Law26-61;72DCR 175),isamendedasfollows:
