Dear Chairman Mendelson:
Enclosed for consideration and enactment by the Council of the District of Columbia is an
emergency bill, the “Modification Nos. M02, M03, M03a, and M04 to Contract No. CW117619
with RCM of Washington, Inc. Approval and Payment Authorization Emergency Act of 2026,”
and the accompanying emergency declaration resolution.
The legislation will approve Modification Nos. M02, M03, M03a, and M04 to Contract No.
CW117619 with RCM of Washington, Inc., to provide residential services to citizens with
intellectual and developmental disabilities, and to increase the not-to-exceed amount for option
year one of the contract in the amount of $1,028,121. In addition, the legislation will approve
payment for the goods and services received and to be received under the modifications.

The Council adopts the fiscal impact statement of the Chief Financial Officer as the fiscal 34
impact statement required by section 4a of the General Legislative Procedures Act of 1975, 35
approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a). 36

(C) The goods or services to be provided, the methods of delivering goods or services, and any
significant program changes reflected in the proposed contract:
The service provider shall provide residential services in the base year to citizens with intellectual
and developmental disabilities. The residential expenses will be funded by local appropriations in
conjunction with residential habilitation or supported living occupancy-related residential expenses
funded by the Medicaid 1915(c) Home and Community Based Services Waiver. Except for
individuals not eligible for Medicaid, the HCA will cover room, board and other occupancy-related
expenses, while Medicaid covers direct care services including nursing services, basic meal
preparation, nutritional services, assessments, psychiatric services, psychological services, care and
maintenance of adaptive equipment, transportation to and from day programs, medical and court
appointments.
(D) The selection process, including the number of offerors, the evaluation criteria, and the
evaluation results, including price, technical or quality, and past performance components:
A request for qualifications was issued under PASS/ARIBA Doc702201 on March 18, 2024. The
closing date for applications was set for March 25, 2024. Thirty-two Medicaid Waiver providers
submitted applications in response to the FY 2024 request for qualifications.
The contracting officer certified the financial and professional responsibility of the service provider
for the option year based upon the criteria set forth in 27 DCMR §1905.4. Based upon the criteria
outlined in §1905.4, the ability to maintain the approval of its Medicaid waiver application by the
Department on Disability Services, Developmental Disabilities Administration, Office of Provider
Resource Management and the Department of Health Care Finance, and satisfactory completion of

provider certification reviews for supported living and residential habilitation services, the
contracting officer found the contractor maintained qualification to exercise the option year one of
the human care agreement.
(E) A description of any bid protest related to the award of the contract, including whether the
protest was resolved through litigation, withdrawal of the protest by the protestor, or
voluntary corrective action by the District. Include the identity of the protestor, the grounds
alleged in the protest, and any deficiencies identified by the District as a result of the protest:
None.
(F) A description of any other contracts the proposed contractor is currently seeking or holds
with the District:
None.
(G) The background and qualifications of the proposed contractor, including its organization,
financial stability, personnel, and performance on past or current government or private
sector contracts with requirements similar to those of the proposed contract:
(1) The service provider is a women-owned, certified small disadvantaged, for-profit business
providing services and supports in the District of Columbia (District) to people with
intellectual and developmental disabilities. Incorporated in the District on January 8, 1998,
RCM of Washington, Inc. services and supports afford those served with a conduit toward
empowering independence and revitalized membership and integration to the communities.
The provider utilizes an approach that offers services needed to set attainable goals and
develop action plans toward maintaining stable, safe and affordable housing, gaining
sustainable employment and living the lives of people that are served by DDS want, within
their community.
(2) The Department of Health Care Finance has determined the service provider qualified to
receive the Medicaid Waiver payments to provide residential habilitation and supported living
services based on the qualifications of staff identified as critical to organizational performance.
The Medicaid Waiver certification is a prerequisite to qualifying for the HCA that covers
occupancy-related expenses.
(3) The service provider has the necessary financial resources to perform the required supports
according to a review of its Dun and Bradstreet’s Risk Analytics report; dated March 27, 2026.
The report assigns a “high risk” rating to the “Data Depth Indicator,” which is one of three
categories that comprise the Viability Rating. The category represents the quantity and quality
of information Dun & Bradstreet has in its database regarding the Contractor. Despite the
assigned rating, the Contractor has been providing services for the agency since 2008 without
defaulting on any of its obligations. It continues to maintain its Medicaid waiver provider
agreement and receives satisfactory provider certification reviews that specifically examine
fiscal stability. Any risk associated with the aforementioned ratings is mitigated by the fact
that DDS has 72 additional active agreements to provide the same service.

(4) The service provider has a satisfactory record of performance on District contracts based on the
past performance evaluation, dated September 30, 2025, prepared by the contract
administrator, the ongoing provider performance, and provider certification reviews.
(H) The period of performance associated with the proposed change, including date as of which
the proposed change is to be made effective:

prior to its submission to the Council for approval:
The partial option M02, not-to-exceed $259,142.83, is in effect from March 1, 2026 through May
31, 2026. Mod. M03 extended the partial option period through June 30, 2026 with no increase to
the amount. Mod M03a extended the partial option period through July 31, 2026 with no increase to
the amount.
(S) A certification that the proposed contract is within the appropriated budget authority for the
agency for the fiscal year and is consistent with the financial plan and budget adopted in
accordance with D.C. Official Code §§ 47-392.01 and 47-392.02:
The Office of the Chief Financial Officer has certified that funding is consistent with the
applicable financial plan and budget.

(T) A certification that the contract is legally sufficient, including whether the proposed
contractor has any pending legal claims against the District:
The Office of the Attorney General has reviewed the proposed modification for legal sufficiency.
The RCM of Washington, Inc. has no legal claims pending against the District.
(U) A certification that the Citywide Clean Hands database indicates that the proposed contractor
is current with its District taxes. If the Citywide Clean Hands Database indicates that the
proposed contractor is not current with its District taxes, either: (1) a certification that the
contractor has worked out and is current with a payment schedule approved by the District;
or (2) a certification that the contractor will be current with its District taxes after the District
recovers any outstanding debt as provided under D.C. Official Code § 2-353.01(b):

9. Modification Details
A. The Government of the District of Columbia hereby exercises its option to extend the term of Human Care
Agreement No. CW117619, pursuant to Section F.2, Option to Extend Term of the Agreement, for the
remainder of option year one (OY1) period of performance July 1, 2026, through February 28, 2027.
B. The not-to-exceed amount of the reminder of OY1 is $768,978.17.
C. Effective January 1, 2026 until June 30, 2026, the Living Wage rate is $17.95 per hour. Effective July 1, 2026,
the District’s Minimum Wage and Living Wage rates will increase to $18.40 per hour.

D. Replace Section B.10.2, Price Schedule Option Year One (OY1), with the attached Section B.10.2, Price
Schedule, Option Year One (OY1).
E. Replace the U.S. Department of Labor Wage Determination No. 2015-4281, Revision No.26, dated
05/10/2023, hereby incorporated into this contract, with the U.S. Department of Labor Wage Determination
No. 2015-4281, Revision No.35, dated 12/03/2025.
