Contract: DCKA-2026-C-0900

This is to Certify that this Office has reviewed the above-referenced Contract. To the extent
OAG is being requested to review the contents of the contract action the contents are found to
be legally sufficient. The process used to enter in this contract violated the requirements of
DC Code § 2–352.02. (Criteria for Council review of multiyear contracts and contracts in
excess of $1 million) because the parties agreed the value of the base period of the contract
would potentially be more than $1,000,000 during a twelve-month period, before receiving
Council approval. Further, the letter contract violated 27 DCMR 2425.7 since the District’s
maximum liability under the letter contract exceeded fifty percent (50%) of the overall price
ceiling for the term of the anticipated definitive contract. The legislation included with this
contract action was written to remedy these deficiencies.
