Pursuant to section 451 of the District of Columbia Home Rule Act (D.C. Official Code § 1 -
204.51) and section 202 of the Procurement Practices Reform Act of 2010 (D.C. Official Code §
2-352.02), enclosed for consideration and approval by the Council of the District of Columbia is
proposed contract CW120023 with Advance Network Consulting, Inc. in the not -to-exceed
amount of $10,000,000. The contract’s period of performance is one year from the date of the
award.

Under the proposed contract, Advanced Network Consulting, Inc., shall provide temporary support
services.

(C) The goods or services to be provided, the methods of delivering goods or services, and
any significant program changes reflected in the proposed contract:

The purpose of the DC Supply Schedule (DCSS) program is to serve as the primary contract
action for all District agencies to acquire support for their recurring requirements. The
contract is for the provision of services under information technology equipment and
software. This particular schedule is designed to provide information technology equipment
and software. The social and economic impact of the program is to allow District Certified
Business Enterprises (CBEs) the opportunity to conduct business with the District of
Columbia, thus creating additional jobs for city residents.

In accordance with paragraph one of the DCSS terms and conditions, the District of Columbia
receives a one percent discount based on the volume of services provided under the DCSS.
This fee is based on the invoice amount and provides revenue to the District.

(D) The selection process, including the number of offerors, the evaluation criteria, and the
evaluation results, including price, technical or quality, and past performance
components:

DCSS solicitations are open on a continuous basis for information technology equipment and
software. The solicitation for information technology equipment and software was issued on
July 31, 2017. Advanced Network Consulting, Inc., submitted its application number
ITES202429 on August 2, 2024.

Advanced Network Consulting, Inc. was selected for an award based on achieving the
following requirements as outlined in the solicitation process:

a. Accepting the DCSS Terms and Standard Contract Provisions and for the District of
Columbia Government Supplies and Services Contracts, July 2010.

b. Identifying and offering prices that are no greater than those of an identified Federal
Supply Schedule that provides services or supplies consistent with the scope of the DCSS
solicitation.

c. Submitting a minimum of three satisfactory customer references demonstrating
the contractor’s ability to satisfactorily provide the services or products as identified in the
scope of the solicitation.

d. Submitting a written certification that all personnel proposed on individual task orders shall
meet the minimum education/experience requirements as stipulated in the federal contract
being used to establish the DCSS contract.

Advanced Network Consulting, Inc., submitted its online application on August 2, 2024. The
application was reviewed and evaluated by the Office of Contracting and Procurement (OCP).
After review and evaluation of the application, the contracting officer determined that
Advanced Network Consulting, Inc. had offered an appropriate multiple award schedule
consistent with the scope of the solicitation. OCP also established that the pricing proposed by
Advanced Network Consulting, Inc. was reasonable based on Advanced Network Consulting,
Inc. offering of pricing at or below the respective federal contract pricing.

(E) A description of any bid protest related to the award of the contract, including whether
the protest was resolved through litigation, withdrawal of the protest by the protestor, or
voluntary corrective action by the District. Include the identity of the protestor, the
grounds alleged in the protest, and any deficiencies identified by the District as a result
of the protest:

There are no bid protests related to the award of the contract.

(F) A description of any other contracts the proposed contractor is currently seeking or
holds with the District.

• Mission Oriented Business Integrated Services (DCSS) CW83903; awarded
11/20/2020 with a contract amount of $10,000,000.
• Temporary Support Services (DCSS) CW90568; awarded 2/11/2022 with a contract
amount of $10,000,000.

(G) A summary of the subcontracting plan required under section 2346 of the
Small, Local, and Disadvantaged Business Enterprise Development and Assistance Act of
2005, as amended, D.C. Official Code § 2-218.01 et seq. (“Act”), including a certification that
the subcontracting plan meets the minimum requirements of the Act and the dollar volume of
the portion of the contract to be subcontracted, expressed both in total dollars and as a
percentage of the total contract amount:

Advanced Network Consulting, Inc., is a CBE certified vendor and therefore, it is not required
to have a subcontracting plan associated with this contract.

(H) Performance standards and the expected outcome of the proposed contract:

The purpose of the DCSS program is to serve as the primary contract vehicle for all District
agencies to acquire support for their recurring requirements. This contract is for provision of
services under information technology equipment and software.

(I) The amount and date of any expenditure of funds by the District pursuant to the
contract prior to its submission to the Council for approval:

There have been no expenditures against this contract.

(J) A certification that the proposed contract is within the appropriated budget authority
for the agency for the fiscal year and is consistent with the financial plan and budget
adopted in accordance with D.C. Official Code §§ 47-392.01 and 47-392.02:

The Agency Fiscal Officer has certified that funds for the minimum quantity of $10 are
available for FY 2024 and that minimum-quantity funds for FY 2025 have been budgeted by
the agency.

(K) A certification that the contract is legally sufficient, including whether the proposed
contractor has any pending legal claims against the District:

The Attorney General for the District of Columbia has reviewed and approved the subject
contract for legal sufficiency. Advanced Network Consulting, Inc., has no pending legal
claims against the District.

(L) A certification that the Citywide Clean Hands database indicates that the proposed
contractor is current with its District taxes. If the Citywide Clean Hands Database
indicates that the proposed contractor is not current with its District taxes, either: (1) a
certification that the contractor has worked out and is current with a payment schedule
approved by the District; or (2) a certification that the contractor will be current with its
District taxes after the District recovers any outstanding debt as provided under D.C.
Official Code § 2-353.01(b):

The Citywide Clean Hands report indicates Advanced Network Consulting, Inc. is current with
its District taxes dated August 20, 2024.

(M) A certification from the proposed contractor that it is current with its federal taxes, or
has worked out and is current with a payment schedule approved by the federal
government:

The Contractor has certified that Advanced Network Consulting, Inc., is in compliance with
federal tax requirements.

(N) The status of the proposed contractor as a certified local, small, or disadvantaged
business enterprise as defined in the Small, Local, and Disadvantaged Business
Enterprise Development and Assistance Act of 2005, as amended; D.C. Official Code § 2-
218.01 et seq.:

(O) (1) A certification that the proposed contractor has been determined not to be in violation
of section 334a of the Board of Ethics and Government Accountability Establishment and
Compensation Ethics Reform Amendment Act of 2011, D.C. Official Code § 1-1163.34a.

DELIVERY AND PERFORMANCE
TERM OF CONTRACT
Thetermofthecontractshallbeforaperiodofoneyearfromdateofawardspecifiedonthecoverpageofthe contract.
OPTION TO EXTEND THE TERM OF THE CONTRACT
a. TheDistrictmayextendthetermofthiscontractforamaximumoffour(4),one-year
optionperiods,or fractionsthereof,by writtennoticeto theContractorbeforethe
expirationofthecontract;providedthattheDistrictwillgivetheContractora
preliminarywrittennoticeof itsintenttoextendatleastthirty(30)days beforethe
contractexpires.The preliminarynoticedoesnotcommit theDistricttoan extension.
TheContractormaywaivethethirty(30)daypreliminarynoticerequirementby
providinga writtenwaivertotheContractingOfficerpriortotheexpirationof the
contract.

IftheContractorand/oritssubcontractorsmaintainbroadercoverageand/orhigherlimitsthantheminimumsshownbelow,theDistrictrequires,andshallbeentitledto,thebroadercoverageand/orthehigherlimitsmaintainedbytheContractorand/or
subcontractors.AnyavailableinsuranceproceedsinexcessofthespecifiedminimumlimitsofinsuranceandcoverageshallbeavailabletotheDistrict.

1. Commercial GeneralLiabilityInsurance (CGL). The Contractorshallmaintaina
CGLpolicy,writtenonanoccurrence(notclaims-made)basis,onISOformCG00010413(oranotheroccurrence-basedformwithcoverageatleastasbroad),coveringliabilityforallongoingandcompletedoperationsoftheContractor,
includingongoingandcompletedoperationsunderallsubcontracts,andcoveringclaimsforbodilyinjury,includingwithoutlimitationsickness,diseaseordeathofanypersons,injurytoordestructionofproperty,includinglossofuseresultingtherefrom,personalandadvertisinginjury,andincludingcoverageforliabilityarisingoutofaninsuredcontract(includingthetortliabilityofanotherassumedinacontract)andactsofterrorism,whethercausedbyaforeignordomesticsource.Suchcoverageshallhavelimitsofliabilityofnotlessthan$1,000,000each

Alldry-houseactivitiesinvolvingpropellantsor explosives.Demilitarization,modification,renovation,demolition,andmaintenanceoperationson sensitiveordnance,explosivesandincendiarymaterials.Alloperationsinvolvingre-gradingandcleaningof artilleryranges.
A 4 percentdifferentialisapplicableto employeesemployedin a positionthatrepresentsa lowdegreeof hazardwhenworkingwith,or in closeproximitytoordnance,(oremployeespossiblyadjacentto)explosivesandincendiarymaterialswhichinvolvespotentialinjurysuchas lacerationof hands,face,or armsof theemployeeengagedintheoperation,irritationof theskin,minorburnsandthelike.

operationsinvolving,unloading,storage,andhaulingof ordnance,explosive,and
incendiaryordnancematerialotherthansmallarmsammunition.Thesedifferentials

** UNIFORMALLOWANCE**
Ifemployeesarerequiredtowearuniformsintheperformanceofthiscontract(eitherbythetermsoftheGovernmentcontract,bytheemployer,bythestateorlocallaw,etc.),thecostoffurnishingsuchuniformsandmaintaining(bylaunderingordrycleaning)suchuniformsisanexpensethatmaynotbebornebyanemployeewheresuchcostreducesthehourlyratebelowthatrequiredbythewagedetermination.TheDepartmentofLaborwillacceptpaymentinaccordancewiththefollowingstandardsascompliance:
Thecontractororsubcontractorisrequiredtofurnishallemployeeswithanadequatenumberofuniformswithoutcostortoreimburseemployeesfortheactualcostoftheuniforms.Inaddition,whereuniformcleaningandmaintenanceismadetheresponsibilityoftheemployee,allcontractorsandsubcontractorssubjecttothiswagedeterminationshall(intheabsenceofa bonafidecollectivebargainingagreementprovidingfora differentamount,orthefurnishingofcontraryaffirmativeproofastotheactualcost),reimburseallemployeesforsuchcleaningand maintenance at a rate of $3.35 per week (or $.67 cents per day). However, in

ConformanceProcess:
Thecontractingofficershallrequirethatany classof serviceemployeewhichis
notlistedhereinandwhichis to be employedunderthecontract(i.e.,theworkto
be performedis notperformedby anyclassificationlistedin thewage
determination),be classifiedby the contractorso as to providea reasonable
relationship(i.e.,appropriatelevelof skillcomparison)betweensuchunlisted
classificationsandthe classificationslistedin thewagedetermination(See29 CFR
4.6(b)(2)(i)).Suchconformingproceduresshallbe initiatedby the contractor
priortotheperformanceofcontractworkbysuchunlistedclass(es)ofemployees(See29CFR4.6(b)(2)(ii)).TheWageandHourDivisionshallmakea finaldeterminationofconformedclassification,wagerate,and/orfringebenefitswhichshallbepaidtoallemployeesperformingintheclassificationfromthefirstday‘ofworkonwhichcontractworkisperformedbythemintheclassification.Failuretopaysuchunlistedemployeesthecompensationagreeduponbytheinterestedpartiesand/orfullydeterminedbytheWageandHourDivisionretroactivetothedatesuchclassofemployeescommencedcontractworkshallbea violationoftheAct
andthiscontract.(See29CFR4.6(b)(2)(v)).Whenmultiplewagedeterminationsare
includedin a contract,a separateSF-1444shouldbe preparedforeachwage
determinationto whicha class(es)is to be conformed.
Theprocessforpreparinga conformancerequestisasfollows:
1) When preparing the bid, the contractor identifies the need for a conformed
occupation(s)andcomputesa proposedrate(s).
2)Aftercontractaward,thecontractorpreparesa writtenreportlistinginordertheproposedclassificationtitle(s),a Federalgradeequivalency(FGE)foreach
proposedclassification(s),jobdescription(s),andrationaleforproposedwagerate(s),includinginformationregardingtheagreementor disagreementof theauthorizedrepresentativeof theemployeesinvolved,orwherethereis no authorized
representative, the employees themselves. This report should be submitted to the
contractingofficernolaterthan3@daysaftersuchunlistedclass(es)ofemployees
performsanycontractwork.
3) Thecontractingofficerreviewstheproposedactionandpromptlysubmitsa report
of theaction,togetherwiththeagency'srecommendationsandpertinentinformationincludingthepositionof thecontractorandtheemployees,to theU.SDepartmentof Labor,WageandHourDivision,forreview(See29 CFR4.6(b)(2)(ii))
4) Within30 daysof receipt,theWageandHourDivisionapproves,modifies,ordisapprovestheactionviatransmittalto theagencycontractingofficer,or
notifiesthecontractingofficerthatadditionaltimewillbe requiredto processtherequest.
5) The contractingofficertransmitstheWageandHourDivision'sdecisionto the
contractor.
6)Eachaffectedemployeeshallbefurnishedbythecontractorwitha writtencopyofsuchdeterminationoritshallbepostedasa partofthewagedetermination(See
29CFR4.6(b)(2)(iii)).
InformationrequiredbytheRegulationsmustbesubmittedonSF-1444orbondpaper.
Whenpreparinga conformancerequest,the “"ServiceContractActDirectoryof
Occupations*"shouldbe usedto comparejobdefinitionsto ensurethatduties
requestedare notperformedby a classificationalreadylistedin thewage
determination.Remember,it is notthe jobtitle,butthe requiredtasksthat
determinewhethera classis includedin an establishedwagedetermination.
Conformancesmaynotbe usedto artificiallysplit,combine,or subdivide
classificationslistedin thewagedetermination(See29 CFR4.152(c)(1)).”

TheLivingWageActof2006,D.C.Code§§2-20.01—2-220.11,providesthatDistrictofColumbiagovernmentcontractorsandrecipientsofgovernmentassistance(grants,loans,taxincrementfinancing),intheamountof$100,000ormore,shallpayaffiliatedemployeeswagesatnolessthanthecurrentlivingwagerate.
EffectiveJanuary 1,2024 untilJune 30,2024,thelivingwage rateis$17.05
perhour.
EffectiveJuly1,2024,theDistrict’sMinimumWageandLivingWagewill
increaseto $17.50 per hour.
SubcontractorsofD.C.governmentcontractors,whoreceive$15,000ormorefromthecontract,andsubcontractorsoftherecipientsofgovernmentassistance,whoreceive$50,000ormorefromtheassistance,arealsorequiredtopaytheiraffiliatedemployeesnolessthanthecurrentlivingwagerate.
“Affiliatedemployee”meansanyindividualemployedbyarecipientwhoreceivescompensationdirectlyfromgovernmentassistanceoracontractwiththeDistrictofColumbiagovernment,includinganyemployeeofacontractororsubcontractorofa recipientwhoperformsservicespursuanttogovernmentassistanceoracontract.Theterm“affiliatedemployee”doesnotincludethoseindividualswhoperformonlyintermittentorincidentalserviceswithrespecttothegovernmentassistanceorcontract,orwhoareotherwiseemployedbythecontractor,recipientorsubcontractor.
Exemptions —The followingcontractsandagreementsareexemptfromtheLivingWage Act:

5.Contractsorotheragreementsthatprovidetraineeswithadditionalservicesincluding,butnotlimitedto,casemanagementandjobreadinessservices,providedthatthetraineesdonotreplaceemployeessubjecttotheLivingWageAct;

THE LIVING WAGE ACT OF 2006
D.C.Code§§2-220.01-2-220.11Recipientsofnewcontractsorgovernmentassistanceshallpayaffiliatedemployeesandsubcontractorswhoperformservicesunderthecontractsnolessthanthecurrentlivingwage.EffectiveJanuary1,2024,untilJune30,2024,thelivingwagerateis$17.05perhour.EffectiveJuly1,2024,theDistrict’sMinimumWageandLivingWagewillincreaseto$17.50.
