Dear Chairman Mendelson:
Pursuant to D.C. Code §2-352.02 (b)(2), I have enclosed for consideration by the Council of the District of
Columbia (“Council”), the Council Contract Summary for a proposed contract, in the amount of One Million Four
Hundred Eight Thousand Nine Hundred Seventy and 60/00 Dollars ($1,408,970.60) between the District of
Columbia Housing Authority (“DCHA”) and The Keystone Plus Construction Corporation (“Keystone”). This
proposed contract is for emergency inspections and repairs at Claridge Towers and Horizon House located,
respectively, at 1221 M Street, NW and 1150 12th Street, NW , Washington, DC (the “Project”).
DCHA plans to enter into the contract wit h Keystone and finance the Project using an allocation of $1,408,970.60
in capital funds appropriated by the Council of the District of Columbia in the District of Columbia FY 2025 Approved
Budget and Financial Plan.
DCHA procured Keystone pursuant to DCHA Solicitation Number 0007-2019, a Request for Job Order Contractors.
Under a Job Order Contracting (“JOC”) contract, DCHA awards an approved contractor a Detailed Scope of Work and
the contractor prepares a cost proposal using a construction catalog, which contains a range of construction and
construction related tasks and prices. DCHA awarded Autumn a one-year contract with four (4) additional one-year
options. Pending approval by the Council, DCHA proposes to award to Autumn a contract to complete the Projects.

(2) Description of the Goods and Services to be provided:
Pursuant to D.C. Official Code § 2-352.02(b)(2), as amended, I have enclosed for
consideration
the contract for Emergency Inspections and Repairs at Claridge and
Horizon
, various DCHA properties in Washington, DC.
(3) A description of the selection process, including the number of offerors, the
evaluation criteria, the evaluation results, and the basis for selecting the proposed
contractor:
Physical condition of the District of Columbia Housing Authority (DCHA)
property portfolio is managed collaboratively by DCHA Property
Management Operations (PMO) that is responsible for property management,
maintenance, and upkeep and the DCHA Office of Capital Programs (OCP)
that is responsible for modernization and rehabilitation of existing properties,
development and construction
of new properties and portfolio design,
engineering, capital and master planning.
In March 2022, the U.S. Department of Housing and Urban Development
(HUD)
completed a DCHA On-Site Assessment and issued reporting with
findings, observations and recommendations in October 2022. The HUD
Assessment required DCHA response within 30 days and completion of all
corrective actions in response to the HUD Assessment by June 2023.
DCHA PMO and OCP require On-Call Construction, Repair and
Replacement (CRR) Services to complete immediate and ongoing repairs to
ensure safe, decent and habitable unit conditions portfolio-wide.
DCHA is an independent Government of The District of Columbia (District)
agency operating as the District’s public housing authority with all powers
necessary or appropriate to engage in providing and maintaining quality
public housing in the District of Columbia. To do so, DCHA has contracting
and procurement authority, independent of the District’s Chief Procurement
Officer and Office of Contracting and Procurement (OCP). However, HUD

authorizes contracting by Cooperative Agreement to simplify and expedite the
procurement process by relieving the Public Housing Authority (PHA) of
developing specifications or issuing solicitations provided that (1) the
agreement provides for greater economy and efficiency and is the most
economical and efficient procurement method, (2) the supplies and/or services
are common and routine in nature, (3) the soliciting agency’s procurement is
compliant with Title 2 of the Code of Federal Regulations (CFR) Part 200-
the Uniform Administrative Requirements, Cost Principles, and Audit
Requirements for Federal Awards, (4) the PHA contract file documents the
intergovernmental agreement and the evaluation of cost and availability and
(5) an agreement between the PHA and a state or local governmental exists.

o meet this need, DCHA intends to partner through Cooperative Business
Relationship with the District Department of General Services (DGS) to
purchase the necessary On-Call Construction, Repair and Replacement (CRR)
Services from Contractors selected for awards pursuant to DGS Request for
Qualifications (“RFQ”) No. DCAM-22-CS-RFQ-0001 for Construction
Projects. DGS issued the solicitation on October 14, 2021 with a solicitation
closing date of November 4, 2021. The RFQ was advertised by posting the
DGS website. The solicitation included a project information meeting on
October 19, 2022 and a Question period prospective Respondents with DGS
responses posted by addendum that included an extension of the proposal
submission deadline until November 10, 2021.

he RFQ invited Statements of Qualifications (“SOQs”) from Respondents
interested in performing construction projects at DCPS, DPR, and municipal
facilities (“Project Locations”) to include building repairs, upgrades, and
tenant-fit-out improvements including, but not limited to, patching and
plumbing, carpentry, masonry, electrical as well as small park and playground
type projects as may be necessary at DCPS, DPR and municipal sites,
building repairs and upgrades, fire alarm repairs, etc. and from time to time
construction projects that need to be completed quickly; these would
primarily be in response to emergency situations such as vandalism, structural
failures, or other life safety issues. The RFQ further stated the intent to
establish a roster of pre-qualified contractors that can quickly compete for
construction projects work for the Project Locations with work detailed and
released through competitive Task Order Agreements issued pursuant to
Indefinite Delivery/Indefinite Quantity (“IDIQ”) contracts awarded in
response to Requests for Task Order Proposals (RFTOP).

hirty-two (32) proposals were received in response to the solicitation. DGS
convened a 4-member Technical Evaluation Panel that reviewed proposals
both independently and by consensus based on the following criteria: (1) Past
Performance, Experience & References worth up to 25 Points; (2) Key
Personnel worth up to 25 points; (3) Project Management Plan worth up to 25
Points; and (4) Capacity worth up to 25 points. In addition to the technical

points, up to 12 additional points were available for each Offeror based on its
status as a Certified Business Enterprise (“CBE”) as determined by the
Department of Small and Local Business Development (“DSLBD”). The
DGS Contracting Officer reviewed the Technical Evaluation Panels
assessments and ratings for each Respondent.

ased on the results of the DGS evaluation process, DCHA determined that
Chiaramonte Construction Company LLC, Bennet Group, Keystone Plus
Construction Company, Kadcon and Protec Construction met the technical
requirements of the RFQ, have experience working on small to medium size
construction projects within the multifamily housing market that are
comparable in both scale and complexity to the upcoming projects at DCHA
and therefore qualified respondents capable of providing the required On-Call
Construction, Repair and Replacement (CRR) Services.
DC
HA determined that award by Cooperative Agreement pursuant to the DGS Request
for Qualification solicitation was reasonable and the most expedient means to award
services timely. DCHA further determined that the award of IDIQ contract establishes
the necessary Contractor capacity to provide services on an On-Call basis as services are
needed to complete immediate and ongoing repairs to ensure safe, decent and habitable
unit conditions portfolio-wide.

CHA will pay for such services with proceeds from the District of Columbia Public
Housing Rehabilitation Fund. Services will be awarded at the Task Order level as
services are required for a specific and detailed scope of work. DCHA will determine
the scope of work to include joint project scope walks with the Contractor as needed,
issue the project detailed scope of work with a Wage Determination to request
Contractor schedule and cost proposal. DCHA will issue a Task Order for the agreed
upon scope, schedule and cost proposal.
(4) Background and qualifications of the proposed contractor:
K
eystone Plus is a minority owned General contractor based in D.C. with substantial
experience in multi-family housing. They also offer a variety of in-house services such
as drywall installation, carpentry, plumbing, electrical work, painting, and flooring. This
in-house staff will allow Keystone to respond promptly to maintenance work orders and
general repairs that are expected to rise from the inspection process. Keystone’s
experience makes them a suitable contractor for the DC Housing Authority (DCHA),
project and this initiative.
(5) Performance standards and expected outcomes of the proposed contract:

CHA expects that projects will be constructed according to approved Task Order and
construction documents and consistent with all District code and building regulations.
The contractor is also responsible for meeting LSBDE subcontracting goals and
employment goals as required by DCHA and the District.

(6) Description of the funding source for the proposed agreement and a
certification that the proposed agreement is consistent with the
District's financial plan and budget:
The funding sources for the proposed contract are capital funds in the FY
2024 financial plan and budget adopted by the Council of the District of
Columbia and made available to DCHA to be administered in FY 2025.

1. Procurement Process
I have enclosed for consideration by the Council of the District of Columbia, the Council Contract Summary for a
proposed contract, in the amount of One Million Four Hundred Eight Thousand Nine Hundred Seventy and 60/00
Dollars ($1,408,970.60) between the District of Columbia Housing Authority (“DCHA”) and Keystone. This proposed
contract is for emergency inspections and repairs for DCHA’ s Claridge Towers and Horizon House project. DCHA plans
to enter into the contract with Keystone for emergency inspections and repairs for the Langston Terrace project using
capital funds appropriated by the Council of the District of Columbia in the FY25 Approved Budget and Financial
Plan.
DCHA partnered through a Cooperative Business Relationship wi th the District Department of General Services

-Call Construction, Repair and Replacement (CRR) Services from Contractors
selected for awards pursuant to DGS Request for Qualifications (“RFQ”) N o. DCAM-22-CS-RFQ-0001 for

2. Description of Proposed Contract
The proposed Contract number CA-XI-2023 betwe en DCHA and Keystone (“Contract”) is for emergency inspections
and repairs for DCHA’s Claridge Towers and Horizon House projects. The Contract will be up to a maximum amount
of One Million Four Hundred Eight Thousand Nine Hundred Seventy and 60/00 Dollars ($1,408,970.60). The length
of the
Contract will be a one year base contract. The scope of work in the Contract contains sufficient details and
plans. DCHA will fund the Contract with funds appropriated by the Council
of the District of Columbia in the FY25 Approved Budget and Financial Plan.
3. Legal Review
The DCHA Office of the General Counsel (OGC) has reviewed the proposed Contract with Keystone for legal
sufficiency. The re
view indicates that DCHA followed a competitive process in making the award to Keystone.
OGC’s review of the
Contract indicated that it is legally sufficient. In addition, we are not aware of any pending
legal claims of Keystone against DCHA.
The Contract te
rm is not to exceed one year and the Contract will be funded with an allocation from capital funds
appropriated by the Council of the Distri ct of Columbia in the District of Columbia FY 2025 Approved Budget and
Financial Plan. Accordingly, the Contract must be submitted to the District Council for review and approval in
accordance with D.C. Code § 2-352.02(a)(1).

WHEREAS, District of Columbia Housing Authority (DCHA) requires On -Call
Construction, Repair and Replacement (CRR) Services;

Group, Keystone Plus Construction Company, Kadcon Corporation and Protec Construction met
the technical requirements of the RFQ and have experience working on small to medium size
construction projects within the multifamily housing market that are comparable in both scale

TO AUTHORIZE THE EXECUTION
OF CONTRACTS FOR ON-CALL

WHEREAS, Contractor compliance with the District Department of Employment Services
(DOES) Employment Agreement for 51% District Resident New Hire and First Source with
DCHA Section 3 individuals having first access to job openings; Mandatory SBE/CBE
Subcontracting Plan, compliance and reporting; Hiring of District Residents as Apprentices and
Trainees and Affirmative Action are required prior to, as part of and a condition of contract award;
WHEREAS, DCHA performed a review of the Federal Systems Award Management and
the District’s Excluded Parties List on January 13, 2023, and has determined that Chiaramonte
Construction Company LLC, Bennet Group, Keystone Plus Construction Company, Kadcon
Corporation and Protec Construction do not appear on the respective lists.
NOW, THEREFORE, BE IT RESOLVED , that the Board of Commissioners of DCHA
hereby authorizes the Executive Director to establish a Qualified Bidders Listing with
Chiaramonte Construction Company LLC, Bennet Group, Keystone Plus Construction
Company, Kadcon Corporation and Protec Construction for On -Call Construction, Repair and
Replacement (CRR) Services for consideration of Indefinite Delivery Indefinite Quantity (IDIQ)
contract award for a minimum award amount of $50,000 up to a maximum award amount of
$15,000,000 in the aggregate amount not to exceed $75,000,000; subject to District Council
approval and the availability of funds.

DCHA Time and Materials for Work Orders Scope of Work

General Requirements:
1. All work shall be done per District of Columbia codes and all other applicable codes followed and
enforced by the District of Columbia in effect at the time of the installation.
2. All Work must be executed per the general terms and conditions of the specified JOC contract.
3. . The contractor shall adhere to DCHA protocols for working in occupied spaces as detailed in the
Additional General Conditions Section.
4. The contractor must not leave emergency repairs until work is completed and documented.
5. Contractor shall provide a supplemental modification to provide justification of all time and materials
spent during the emergency inspection repairs. The contractor shall provide detailed information,
tracking sheets and cost justifications via modification.
6. No work shall begin prior to 8:30am Monday through Friday. All work must end prior to 5pm.
7. Contractors will be required to use the DCHA work order system (Yardi), to track and document the
completion of work order items.
8. DCHA has the right to prioritize the work orders to be completed; that are populated from the Yardi
platform.

DCHA Work Order General Time and Materials scope:
1. Time and Materials for the repair of plaster and drywall related work order items
2. Time and Materials for painting related work order items.
3. Time and Material for the installation of smoke and CO2 detector work order items
4. Time and Material for all door, frame and hardware work order items. (Door shall be as specified by
DCHA. Hardware to include locksets, threshold, sweep, stop, peephole and weather-strip.)
5. Time and Material for the repair of the existing floor and/or the installation of new LVT. (Color to
match existing)
6. Time and Material for the replacement of kitchen cabinets, countertops, sink, bathroom vanity and
faucet as determined by DCHA (HUD severe use cabinets, new faucet shall be Delta. New sink shall be
single bowl satin finish by Elkay or approved equal.)
7. Time and Material for the installation of an access panel to shower/tub diverter and incoming water shut
off valves where none exist.
8. Time and Material for the installation of miscellaneous hardware work order items including towel bars,
shower curtain rod, toilet paper holder, soap dish, etc.
9. Time and Material for the replacement toilet and accessories. (wax ring, water supply line, toilet seat,
etc.)
10. Time and Material for the replacement and or glazing of tub and surround (where applicable)

Additional General Conditions:
1. DCHA will not be held responsible for any loss or damaged materials or equipment left on the site. Any
materials or equipment left on site should not impede ingress or egress, or create any hazard to the
residents. All construction and demolition debris shall be removed from the site daily, and all
construction areas must be left in a safe and secure manner for all the residents occupying the building
on a daily basis.
2. The Contractor shall protect the existing structure from any damages during the execution of this
contract. Any damages incurred shall be the responsibility of the contractor and must be reported to the
DCHA PMO contact and the Regional Maintenance Supervisor immediately. The damage(s) must be
promptly repaired to insure the continued effective operation of the system at no cost to DCHA. All
damages that occur to the property due to the Contractor’s negligence shall be repaired at no cost to
DCHA and all repairs must be acceptable to the DCHA PMO contact or Regional Maintenance
Supervisor.
3. All work shall be completed with the least possible disturbance and utility interruption to the residents of
the development. The Contractor shall notify the DCHA Property Manager and the DCHA PMO contact
of any interruptions in utility services to the residents at minimum seventy-two (72) hours in advance of
the interruption. Interruptions shall only occur after written consent from the Property Manager and shall
be coordinated to avoid repeated interruptions. All interruptions shall occur during off-peak hours and
shall be limited to a maximum of two (2) hours per interruption or at the discretion of the Property
Manager.
4. The Contractor at final walkthrough shall demonstrate the operation and the proper effective function of
the installed items and materials prior to acceptance by the DCHA PMO contact. The Contractor shall
also provide warranties as required for such equipment.
5. The Contractor shall provide a one (1) year warranty on all materials, equipment and labor provided
within the limits of this project. Warranty period begins at the time of final acceptance in writing by
DCHA PMO contact.

Work in Occupied Spaces:
1. The contractor shall prep all work areas prior to work and protect all areas that are not impacted directly
by the assigned task.
2. All work-related activities on the property must be coordinated through the Property Management
Office and Office of Capital Programs.
3. Contractor must take careful precautions to prevent damage to flooring, cabinets, hardware and other
surfaces not associated with assigned task
4. The Contractor agrees to rectify damage immediately upon notification from the Manger.

Services for Claridge Towers Apartments & Horizon House Apartments Solicitation Number QBL: RFP No. CA-XI-
2023.
Keystone Plus Construction is perfectly positioned to renovate and perform urgent repair needs and improving
safety and habitability at the seven (7) vacant units at Claridge Tower property; four (4) vacant units at the
Horizon property; ten (10) Emergency Repair Units at the Claridge Tower property; six (6) Emergency Repair
Units at the Horizon House property, as outlined in Exhibit A of the RFP, adhering to the District of Columbia
Housing Authority Office of Contracts & Procurement initiatives to create opportunities to improve the quality
of life for DCHA residents and provide livable housing to support healthy and sustainable Communities as
outlined on this QBL Request for Proposal (RFP) solicitation.
Keystone brings a seasoned team with a solid infrastructure and sound resources to handle task orders
ranging from $1,000.00 to $10,000,000.00+ in a time sensitive environment. The Keystone team is
accustomed to fast-tracking schedules and timelines, working in occupied facilities, phased projects and
emergency requests. Keystone can handle all types of building repairs of single family, multifamily,
multifamily mid-and-high-rise buildings such as minor repairs, roofing repairs, mechanical repairs, water
intrusion and fire damage, ground maintenance, playground repairs, interior demolitions, plumbing,
electrical, carpentry, masonry, fire alarm, life safety, access control, etc. We have never missed a
deadline and have demonstrated the ability and resources to work multiple shifts, expedite deliveries,
work, and meet the DCHA’s goals.
Keystone brings a highly qualified team comprising of experienced personnel including project manager,
superintendents/safety managers, engineers, foreman. In addition, Keystone has the infrastructure and
resources to handle small single, multifamily and facility work orders in a time-sensitive environment. Keystone
can handle all type of building repairs and upgrades including plumbing, electrical, mechanical, carpentry,
window replacement, window restoration, door and hardware replacement, painting, masonry, fire alarm, life
safety, access control, roofing, playgrounds and more. We are fortunate to have this unique combination of

of the contract award, Keystone will release the assigned Field and Management team for the implementation
of this Scope of Work.
We place a strong emphasis on diligent communications in the coordination of trades to make sure that scopes
of work are being implemented as designated in the plans and specifications, and that schedules are maintained.
Our deliverables plan will include the following:
• Project Schedule
• Procurement of long lead items
• Construct the work described in the Scope of Work
• Properly supervise and coordinate all work.
• Monitor the performance of Scope of Work to verify the project is on schedule and constructed in
accordance with the contract documents.
• Coordinate all aspects of the work with outside agencies involved in the project.
• Constantly review the adequacy of subcontractor supervision, manpower, equipment/material
deliveries and quality of work. Immediate remedial action will be taken for deficiencies.
• Remove and dispose of the existing materials being replaced, and other construction debris.
• Produce comprehensive reports of the progress of the project. This report includes an executive
summary, cost summary, schedule update, change management update, RFIs and progress photos
In addition to this deep-rooted relevant experience, Keystone’s liquidity, and financial strength, having the in -
house expertise to perform any service, Keystone also brings to the project, a teaming project management
approach and understanding of the myriad of requirements to deliver not only the scope of this package safely,
on time and within budget, but also delivering True and Meaningful Economic Inclusion for DC Residents
including Section 3, at risk hard to employ youth and returning citizens. KPC has successfully met the DC
Residency Workforce Participation and Hiring, DOES First Source Compliance, CBE Participation goals, as well as
maintained Apprenticeship Standards, on its projects where these requirements were mandated.

Schedule Approach
DCHA QBL RFP CA-X1-2023 ON-CALL CONSTRUCTION REPAIR/REPLACEMENT SERVICES
CLARIDGE TOWERS APARTMENTS & HORIZON HOUSE APARTMENTS
Claridge House and Horizon house . We plan on working with 6 crews . 3 crews for each building . We will
start from the top floor of each building and work our way down sequentially. The work scope varies, but we
will allow 3 days per unit to accomplish the work. The bar chart schedule shows our crews working in this
manner We will work 6 days per week. If we encounter any unexpected conditions or difficulties, we will work
extra hours and provide the necessary workforce and resources to maintain the schedule From Start to finish,
we will start on Monday October 23rd after notice of the award anticipated for October 20th. We will finish on
November 9th, 2023. Total duration of 3 weeks.
We will have a full-time supervisor assigned to the 2 properties and anticipate having 1 laborer for general
overall needs 50 % of the time. We have built in our general conditions which include a project manager, a
full-time superintendent, and a half-time general laborer, and an allotment for every unit getting a final
cleaning when we are done.
Clarifications - Bathtubs listed as needing to be reglazed will be replaced as per walk thru instructions. We
have included repainting entire units which are vacant . Occupied units will only receive painting as per scope
Lead safe work practices will be implemented . Keystone is a certified lead abatement contractor as well as a
lead renovator certified. We have trained workers and a certified lead supervisor. We have reviewed the
lead specs and scope.

exception. Alterations or substitutions to the specifications m ust be approved by the DCHA

ction 3 Program Overview
S
ection 3 of the Housing and Urban Development Act of 1968 (codified as amended at 12 U.S.C.
1701
u) (Section 3) was enacted to ensure that employment and other economic opportunities
generated by certain HUD financial assistance shall, to the greatest extent feasible, and consistent
with existing Federal, State and local laws and regulations, be directed to low- and very low-
income persons, particularly those who are recipients of government assistance for housing, and
t
o business concerns which provide economic opportunities to low- and very low-income
p
ersons; and

ection 3 covered opportunities include training, employment, contracting, and other economic
opportunities arising from development, operating and modernization funded by HUD
notwithstanding the amount of the contract or subcontract, and regardless of whether the activity

s fully or partially funded by HUD funds; and
“S
ection 3 Resident” means:
a. A public housing resident;
b. Other DCHA Voucher Program participant; or
c. An individual who resides in the District of Columbia metropolitan area and who is a

w- or very low-income person; and

ection 3 Business Concern” means a business concern that:
a. Is a business concern that is 51% or more owned by Section 3 residents; or
b. A business whose permanent, full-time employees include at least 30% current
Section 3 residents (or are within three years of the date of first employment as a

c. A business which provides evidence of a commitment to subcontract in excess of
25% or the dollar award of all subcontracts to businesses that meet the tests in (3)(a)
or (3)(b) above; and

ction 3 Hiring Requirements. Contractor agrees at least 30% of its new hires for the project
shall be Section 3 residents. The 30% minimum represents a safe harbor for hiring that meets the

or other economic opportunities the contractor attempted in efforts to reach the

5. S
ection 3 Reporting Procedures. Contractor agrees to submit monthly Section 3 reports in the
format specified by DCHA by the 5th of each month, reporting on Section 3 activities from the
prior month. The final report must be submitted by the earlier of the following events: the 5th of
the month following completion of the project or upon submission of the final pay request.
6. S
ection 3 Compliance Procedures. If a contractor fails to meet the Section 3 hiring and/or
contracting requirements, DCHA may determine it to be non-compliant. If DCHA determines that
a c
ontractor is non-compliant, DCHA shall follow the procedures below:
a. I
ssue a verbal warning and a date by which to correct. The contractor is responsible
f
or notifying any subcontractor who is not in compliance. If non-compliance is not
resolved by the date by which to correct, the Section 3 coordinator will proceed with
t
he next step.

a. DCHA will issue a written corrective plan with a prescribed means of correcting non-
compliance and a required meeting date and time. The contractor will be given at
l
east three business days’ notice for the meeting, and is expected to attend the

eeting with the Section 3 coordinator and any other appropriate representative from
DCHA.
b. If t
he contractor does not correct the deficiencies in the manner and timeframe
pr
escribed, the following sanctions may be prescribed.
1. Withholding payments on contracts; and/or
2. Canceling and suspending contracts; and/or
3. Placing contractor on list of contractors who fail to comply with the DCHA’s
Se
ction 3 requirements.
4. The contractor may also be subject to a fine up to 5% of the total contract
value.
7. S
ection 3 Clauses. The contractor understands the obligations of a Section 3 covered contract
and agrees to the following Section 3 Clauses:
a. T
he work to be performed under this contract is subject to the requirements of section 3
of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u
(
Section 3). The purpose of Section 3 is to ensure that employment and other economic
opportunities generated by HUD assistance or HUD-assisted projects covered by Section
3, shall, to the greatest extent feasible, be directed to low- and very low-income persons,
particularly persons who are recipients of HUD assistance for housing.
b. The parties to this contract agree to comply with HUD’s regulations in 24 CFR part 135,
which implement Section 3. As evidenced by their execution of this contract, the parties
t
o this contract certify that they are under no contractual or other impediment that would
pr
event them from complying with the part 135 regulations.
c. The contractor agrees to send to each labor organization or representative or workers with
which the contractor has a collective bargaining agreement or other understanding, if any,
a notice advising the labor organization or workers’ representative of the contractor’s
c
ommitments under this Section 3 clause, and will post copies of the notice in
c
onspicuous places at the work site where both employees and applicants for training and
em
ployment positions can see the notice. The notice shall describe the Section 3
preference, shall set forth minimum number and job titles subject to hire, availability of
apprenticeship and training positions, the qualifications for each; and the name and
l
ocation of the person(s) taking applications for each of the positions; and the anticipated
da
te the work shall begin.
d. The contractor agrees to include this Section 3 clause in every subcontract subject to
compliance with regulations in 24 CFR part 135, and agrees to take appropriate action, as
pr
ovided in an applicable provision of the subcontract or in this Section 3 clause, upon a
finding that the subcontractor is in violation of the regulations in 24 CFR part 135. The
contractor will not subcontract with any subcontractor where the contractor has notice or
knowledge that the subcontractor has been found in violation of the regulations in 24
CF
R part 135.
e. The contractor will certify that any vacant employment positions, including training
p
ositions, that are filled (1) after the contractor is selected but before the contract is
e
xecuted, and (2) with persons other than those to whom the regulations of 24 CFR part
135 require employment opportunities to be directed, were not filled to circumvent the
contractor’s obligations under 24 CFR part 135.

f. Noncompliance with HUD’s regulations in 24 CFR part 135 may result in sanctions,
termination of this contract for default, and debarment or suspension from future HUD
assisted contracts.
g. With respect to work performed in connection with Section 3 covered Indian housing
assistance, section 7(b) of the Indian Self-Determination and Education Assistance Act
(25 U.S.C. 450e) also applies to the work to be performed under this contract. Section
7(b) requires that to the greatest extent feasible (i) preference and opportunities for
training and employment shall be given to Indians, and (ii) preference in the award of
contracts and subcontracts shall be given to Indian organizations and Indian-owned
Economic Enterprises. Parties to this contract that are subject to the provisions of
Section 3 to the maximum extent feasible, but not in derogation of compliance with
section 7(b).
8. The parties further certify that the persons executing this Agreement have the authority to so bind
the parties to this Agreement.

Keystone Plus Construction (KPC) shares the District’s commitment to ensure maximum economic inclusion for
the Minority and Women-Owned Business Enterprises (“MWBE”). KPC has worked with D.C. Government
entities since the company started in 1989. Through its 34-y ear history of working with the D.C.
Government, KPC has developed an expertise in contract compliance mandates and is well equipped to
perform the same on this project. In such, KPC offers a vast network of constructlon related strategic
community partnerships for the benefit of this project. This includes CBE, Minority and Women-Owned
Business Enterprises and other subcontracting partners, workforce partners thru DOES and other local entities

RFP. Prior to finalization and award of a subcontract, subcontractors must submit to KPC a workforce
