Pursuant to section 451 of the District of Columbia Home Rule Act (D.C. Official Code § 1 -
204.51) and section 202 of the Procurement Practices Reform Act of 2010 (D.C. Official Code §
2-352.02), enclosed for consideration and approval by the Council of the District of Columbia is
proposed Modification No. M04 to Contract No. DCAM -21-NC-RFQ-0002S with Chiaramonte
Construction Company to exercise option year four of the contract in the not-to-exceed amount of
$10,000,000. The modification’s period of performa nce is from October 1, 2025, through
September 30, 2026.
Under the proposed contract modification, Chiaramonte Construction Company will continue to
provide various interior and exterior general maintenance and repair services related to
concentrated work order reduction efforts, including emergency response, ro utine services,
preventative maintenance services, and project-driven work.

Explanation of difference from base period:
Pursuant to Section 1.6 of the Contract, the Department is opting to exercise Option Year Four of
the Contract in a NTE value of $10,000,000. This increase in the Contract’s value from the base
period arises from the District's revised assessment of service requirements, primarily aimed at
supporting ongoing work order ticket response and facilitating the reduction of critical repair
needs for both municipal and D.C. Public School facilities.

(D) A statement that the Citywide Clean Hands database indicates that the proposed contractor
is current with its District taxes. If the Citywide Clean Hands Database indicates that the
proposed contractor is not current with its District taxes, either: (1) a certification that th e
contractor has worked out and is current with a payment schedule approved by the District;
or (2) a certification that the contractor will be current with its District taxes after the District
recovers any outstanding debt as provided under D.C. Official Code § 2-353.01(b):
The Citywide Clean Hands database indicates that the Contractor is current with its District taxes.

(E) A statement that the proposed contract is within the appropriated budget authority for the
agency for the fiscal year and is consistent with the financial plan and budget adopted in

The Office of the Chief Financial Officer has certified that the guaranteed minimum value of $50
of proposed Modification No. M04 is within the appropriated budget authority for the agency and
is consistent with the financial plan and budget adopted in accordance with D.C. Official Code §§
47-392.01 and 47 -392.02. The applicable Fiscal Sufficiency certification accompanies this
Council Package.
(F) (1) A certification that the proposed contractor has been determined not to be in violation of
section 334a of the Board of Ethics and Government Accountability Establishment and

‘Thecontractingofficershallrequirethatanyclassofserviceemployeewhichisnotlistedhereinandwhichistobeemployedunderthecontract(i.e.,theworktobeperformedisnotperformedbyanyclassificationlistedinthewagedetermination),beclassifiedbythecontractorsoastoprovidea reasonablerelationship(i.e.,appropriatelevelofskillcomparison)betweensuchunlistedclassificationsandtheclassificationslistedinthewagedetermination(See29CFR4,6(b)(2)(i)).Suchconformingproceduresshallbeinitiatedbythecontractorpriortotheperformanceofcontractworkbysuchunlistedclass(es)ofemployees(See29CFR4.6(b)(2)(ii)).TheWageandHourDivisionshallmakea finaldeterminationofconformedclassification,wagerate,and/orfringebenefitswhichshallbepaidtoallemployeesperformingintheclassificationfromthefirstday‘ofworkonwhichcontractworkisperformedbythemintheclassification.Failure‘topaysuchunlistedemployeesthecompensationagreeduponbytheinterestedpartiesand/orfullydeterminedbytheWageandHourDivisionretroactivetothedatesuchclassofemployeescommencedcontractworkshallbea violationoftheActandthiscontract.(See29CFR4.6(b)(2)(v)).Whenmultiplewagedeterminationsareincludedina contract,a separateSF-1444shouldbepreparedforeachwagedeterminationtowhicha class(es)istobeconformed.
‘Theprocessforpreparinga conformancerequestisasfollows:
1)Whenpreparingthebid,thecontractoridentifiestheneedfora conformedoccupation(s)andcomputesa proposedrate(s).
2)Aftercontractaward,thecontractorpreparesa writtenreportlistinginordertheproposedclassificationtitle(s),a Federalgradeequivalency(FGE)foreachproposedclassification(s),jobdescription(s),andrationaleforproposedwagerate(s),includinginformationregardingtheagreementordisagreementoftheauthorizedrepresentativeoftheemployeesinvolved,orwherethereisnoauthorizedrepresentative,theemployeesthemselves.Thisreportshouldbesubmittedtothecontractingofficernolaterthan30daysaftersuchunlistedclass(es)ofemployeesperformsanycontractwork.
3)Thecontractingofficerreviewstheproposedactionandpromptlysubmitsa reportoftheaction,togetherwiththeagency'srecommendationsandpertinentinformationincludingthepositionofthecontractorandtheemployees,totheU.S.DepartmentofLabor,WageandHourDivision,forreview(See29CFR4.6(b)(2)(4i)).
4)Within3@daysofreceipt,theWageandHourDivisionapproves,modifies,ordisapprovestheactionviatransmittaltotheagencycontractingofficer,or

Recipientsofnew contractsorgovernmentassistanceshallpay affiliatedemployeesandsubcontractorswho

EffectiveJanuary1,2025untilJune30,2025,theLivingWage rateis$17.50perhour.
