Pursuant to D.C. Official Code § 2-352.02, I have enclosed, for consideration by the Council of the District of Columbia,
the (a) Council Contract Summary for the contract between the District of Columbia Housing Authority (“DCHA”) and
Vigil Contracting Inc., and (b) the Contract Number DJ98-54-2024S with Vigil Contracting, Inc.
DCHA proposes to enter into a contract for the Phase 3 unit renovations at the Greenleaf Family DCHA property with

igil Contracting, Inc. for one (1) year with four (4) one-year options. Under the proposed contract, Vigil Contracting,
Inc. will receive up to $4,550,000.00.

Pursuant to D.C. Official Code § 2 -352.02(b)(2), as amended, I have enclosed for consideration the
Indefinite-quantity Job Order Contract for general construction, repair, and demolition services.
(3) A d escription of the selection p rocess, including the number of of ferors, the eval uation
criteria, the evaluation results, and the basis for selecting the proposed contractor:
The District of Columbia Housing Authority (DCHA), responsible for providing affordable housing
solutions within the District, initiated a competitive bidding process to procure general construction,
repair, and demolition services. This process was set in motion with the release of a Request for Proposal
(RFP) on August 19, 2024.
To ensure maximum visibility and encourage a wide range of participation, the RFP was advertised
extensively in both print and online media. Prominent publications such as The Washington Post,
Washington Informer, Washington Times, and El Tiempo Latino carried the advertisement, reaching a
diverse audience across the District. Additionally, the RFP Notification was prominently displayed on
the
DCHA website and the RFP posted to the Housing Agency Marketplace, providing easy online
access to potential bidders.
The DCHA received thirty five (35) proposals from vendors in response to the RFP. To ensure a fair
and impartial evaluation, a dedicated review panel was convened. This panel comprised experienced
staff members from DCHA's Capital Construction and Design department, bringing their expertise in
construction projects. The evaluation process was rigorous, focusing not only on the technical
requirements outlined in the RFP but also on the vendors' Section 3 plan. This plan is a key component
of the evaluation, aimed to promote job training and employment opportunities for low-income
residents, aligning with DCHA's commitment to social and economic upliftment within the District.
Based on this comprehensive evaluation, the vendor was identified as having successfully met the
technical requirements and
demonstrating the capability to deliver the general construction, repair, and
demolition services. This vendor was Vigil Contracting LLC.
To ensure compliance with government regulations and maintain the highest standards of integrity,
DCHA staff conducted a further review of the qualified vendors using the System for Award
Management.
This crucial step ensured that none of the vendors were debarred or suspended from doing
business with either the federal or District government, safeguarding the procurement process from
potential legal or ethical complications.
Ul
timately, after careful consideration and thorough evaluation, Vigil Contracting, Inc. emerged as the
propos
ed contractor. Their proposal was evaluated based on the firm's technical capability, capacity,
performance history, and proposed pricing coefficients/factors, which are applied to the Construction
Task Catalog. The selection was based on offering the best value while meeting all technical, social
responsibility, and JOC requirements outlined in the RFP.
The contract is an Indefinite-quantity Job Order Contract (JOC) for general construction, repair, and
demolition services. The contract term is one (1) base year with four (4) one-year options. The base year
runs from May 1, 2025, through April 30, 2026. The minimum total amount that may be ordered under
this Contract is $25,000.00, and the maximum total amount that may be ordered during the base year
shall not exceed $8,000,000.00. Work is initiated only upon issuance of a Job Order and a
corresponding Notice to Proceed. A specific Job Order (DJ98-DC02.01) has been issued for the Phase
3 unit renovations at Greenleaf Family with a value of $4,550,000 and an estimated duration of 270
days.

4) Background and qualifications of the proposed contractor:
Vigil Contracting , LLC brings over three decades of comprehensive experience to the general
contracting industry, consistently delivering high-quality construction projects across a diverse
range of
sectors. Their extensive history is built on a foundation of deep industry knowledge, a
commitment to regulator y compliance, and a proven track record of successful project
execution. Throughout their 30-ye ar tenure, they have cultivated a reputation for reliability and
excellence, successfully navigating complex projects while adhering to stringent safety and
environmental standards. They understand the critical importance of integrating regulatory
knowledge with practical construction expertise to ensure project success.
Vigil Contracting , LLC possesses the robust qualifications necessary to effectively mobilize
and manage projects of any scale. Their financial stability is demonstrated through consistently
strong financial statements and recent independent audits, showcasing their capacity to handle project
costs and ensure timely completion. Their team comprises seasoned professionals with extensive
experience in all facets of construction, from planning and design to execution and final
delivery. They maintain rigorous quality control measures and prioritize clear communication
with clients and stakeholders throughout the project lifecycle. This commitment to
excellence, coupled with their deep understanding of regulatory requirements, positions
Vigil Contracting , LLC as a reliable and capable partner for any construction endeavor.
(5) Performance standards and expected outcomes of the proposed contract:
The
expected outcomes of this Job Order Contract (JOC) are the efficient and timely completion of
repair, demolition, and general construction projects for DCHA and its affiliated facilities. The
work performed under individual Job Orders is expected to be executed in strict accordance with the
Contract, which includes the Construction Task Catalog® (CTC), Technical Specifications, and all
applicable Federal and District laws, regulations, and codes. Key performance standards include
adhering to project
schedules, maintaining site safety and preparation, providing quality assurance, and performing all work
with experienced labor and high-quality mate rials.
Performance will be rigorously controlled and monitored by the Authority's designated Project Manager.
The Contractor must furnish all necessary management, documentation, labor, materials, equipment,
and design support to complete each Job Order. Quality is maintained through the requirement for
t
echnical submittals such as safety plans, detailed construction schedules, and shop drawings within five
da
ys of receiving the Job Order/Notice to Proceed. Furthermore, all work must align with the
Modernization Principles and Redevelopment Principles adopted by the DCHA Board of
C
ommissioners.
A critical outcome of this contract is the fulfillment of DCHA's commitment to social responsibility.
T
he Contractor is required to comply with Section 3 requirements, which mandate providing training,
e
mployment, and contracting opportunities to low and very low income reside nts of the District of
Columbia, to the greatest extent feasible. Additionally, the Contractor must adhere to the prevailing
w
age rates set forth in the Davis Bacon wage determinations for the Metropolitan Washington D.C.
area, as applicable to the type of construction and working hours specified in each Job Order.
Further ensuring project integrity and completion, the Contractor is required to provide a 100%
P
erformance Bond and a 100% Payment Bond for any individual Job Order exceeding $150,000. Failure
to
submit these acceptable bonds at the time the Notice to Proceed is issued can result in the cancellation
of
the Job Order and possible termination of the Contract for default. This bonding requirement
guarantees faithful performance and payment for all labor and materials used in the performance of the
Work.

6) Description of the funding source for the proposed agreem ent and a certification that th e
proposed agreement is consistent with the District's f inancial plan and budget:

e funding source is the capital funds allocated to DCHA in the Fiscal Year 2025 budget. The
certification that the proposed contract is consistent with the District's financial and budget is attached.

tax laws:
The District tax law compliance certification is attached.

Vigil Contracting, LLC's subcontractor, Cobra Contracting LLC, is a Certified Business Enterprise
(CBE). This designation reflects Vigil Contracting, LLC's ’s commitment to diversity and inclusion in
business opportunities. Vigil Contracting, LLC meets the District’s criteria for CBE participation in
government contracting.
(10) A s t atement i ndicating w hether the p roposed con tractor i s cu rrently d ebarred from
providing services or good to th e District o r federal government:
DCHA’s Office of Administrative Service has conducted a federal and local search of Vigil Contracting,
LLC
and has found no evidence of federal or District debarment.

Contract Summary for a proposed contract, in an amount up to $4,550,000.00 between DCHA
and Vigil Contracting, LLC. This proposed contract is for the Phase 3 unit renovations services at
the Greenleaf Family DCHA project. DCHA issued a Request for Proposal (RFP) Solicitation No.:
54-2024 on August 19, 2024. To ensure maximum visibility and encourage a wide range of

2. Description
of Proposed Contract
This
proposed contract
between DCHA and Vigil Contracting, LLC is for the Phase 3 unit renovations
services at
the Greenleaf Family DCHA project. A contract will be entered into with Vigil C ontracting,
Inc.
The length of the Contract will be
a one year contract with four (4) one year options. The scope of

work in the Contract contains sufficient details and plans. DCHA will fund the Contract with
capital funds allocated to DCHA in the Fiscal Year 2025 budget which is in compliance with the
applicable Federal and District of Columbia regulations and DCHA’s policies and procedures.
3. Legal
Review
The DCHA
Office of the General Counsel (OGC) has reviewed the proposed Contract with Vigil
Contracting
, LLC for legal sufficiency. OGC’s review of the Contract indicated that it is legally
sufficient. In
addition, we are not aware of any pending legal claims of Vigil Contracting, LLC.
against the
District of Columbia or DCHA.

up to Four Million Five Hundred Fifty Thousand Dollars ($4,550,000) to provide Phase Three

TO AUTHORIZE THE EXECUTION OF MULTIPLE JOB ORDER CONTRACTING
(JOC) CONTRACTS
WHEREAS, District of Columbia Housing Authority (“DCHA”), its instrumentalities
and affiliates require a large capacity of contracts to accomplish various projects for
repair, alteration, modernization, maintenance, rehabilitation, demolition, construction
and environmental services at various properties; and
WHEREAS, on August 18, 2024 , DCHA advertised a Request for Proposals
(“RFP”) in was placed in The Washington Post Sunday Edition , Washington Informer,
Afro American, The Washington Times, El Tiempo Latino and East of the River. Copies
were emailed to LSDBE Vendors Email Blast, Section 3 Vendors Email Blast, all District
Government Certified Business Entity members and all District of Columbia Department
of Housing and Community Development (“DHCD”) Section 3 vendors; and
WHEREAS, on August 19, 2024, Solicitation No. 54 -2024 Job Order Contracting
(JOC) was posted on the DCHA website, and the Agency’s e-procurement system; and
WHEREAS, Solicitation No.’s 54 -2024, 54 -2024A through 54 -2024I for JOC
General Construction, Electrical, Mechanical and Plumbing, and Electrical and Fire Alarm
for the repair, alteration, modernization, maintenanc e, rehabilitation, demolition and
construction of infrastructure, buildings and structures by means of Job Orders issued
under JOC Indefinite Delivery Indefinite Quantity (IDIQ) contracts (“JOC Contract”) was
posted to the Agency’s e-procurement system Bonfire, issued to the Department of Small
and Local Business Development, bidders interested in doing business with DCHA,
posted to the DCHA Website; and
WHEREAS, by November 20, 2024, DCHA received thirty -five (35) proposals for
evaluation; and
WHEREAS, the solicitation stated that DCHA would make an award to the firms
that were deemed technically qualified in accordance with the solicitation requirements
for the repair, alteration, modernization, maintenance, rehabilitation, demolition and
construction of infrastructure, buildings and structures, and in the best interest of DCHA;

WHEREAS, based on the proposals and the results of the evaluation process,
DCHA determined that A.L. Merton, ARS Design Build, Autumn General Contracting,
LLC, Bennett Group, C & A Electric, Inc, Centennial Contractors Enterprises, Inc.,
Consys Inc., Delkan Group, First Choice Construction, HEP Construction, Irreno
Construction Company, JAP Construction LLC, Landivar and Associates, Metropolitan
Engineering Inc., Micon Construction, Inc, Mo Construction Inc., One-Kare Enterprise
LLC, S-Works Construction Corporation, TMG Construction Corporation, Vigil
Contracting Inc., Walker Construction have met the technical requirements of the RFP
as a qualified firms capable of providing the repair, alteration, modernization,
maintenance, rehabilitation, demolition and construction of infrastructure, buildings and
structures by means of Job Orders issued under JOC Contracts; and
WHEREAS, DCHA performed a review of the Federal Systems Award
Management and the District’s Excluded Parties List on March 10, 2025, and has
determined that A.L. Merton, ARS Design Build, Autumn General Contracting, LLC,
Bennett Group, C & A Electric, Inc, Centennial Contractors Enterprises, Inc., Consys Inc.,
Delkan Group, First Choice Construction, HEP Construction, Irreno Construction

TO AUTHORIZE THE EXECUTION
OF MULTIPLE JOB ORDER CONTRACTING
(JOC) CONTRACTS
NOW, THEREFORE, BE IT RESOLVED , that the Board of Commissioners of
District of Columbia Housing Authority hereby authorizes the Executive Director to
execute twenty -one (21) contracts to provide repair, alteration, modernization,
maintenance, rehabilitation, demolition and construction of infrastructure, buildings and
structures by means of Job Orders issued under JOC Indefinite Delivery Indefinite
Quantity (IDIQ) contracts (“JOC Contract”) at various pro perties owned by or done on
behalf of, the Authority or any of its instrumentalities or affiliates, for a period of five (5)
years consisting of one (1) base year with four (4) one -year options, in the minimum
aggregate amount of Five Hundred Twenty -Five Thousand Dollars ($525,000.00) not to
exceed the maximum aggregate amount of Five Hundred Thirty -Five Million Dollars
($535,000,000.00), subject to the availability of funding.

Vigil Contracting, Inc , shall acknowledge receipt of this addendum, by returning it. Failure to
acknowledge receipt of this addendum may be cause for rejection of your contract.
Contractor’s are informed that the above-named contract is modified as follows:
The District of Columbia Housing Authority hereby issues Addendum No. 1 is hereby
amended to include the following:
A. Contract Documents, Article 4 Item 17, page 2, Bid Bond Form (Sample) Delete
“Form” and (“Sample”)
B. Payment and Performance Bond Requirements
WHEREAS, in accordance with 2 C.F.R. § 200.326 and the DCHA Procurement and
Contracting Policy § 7203.5(a), DCHA requires Payment and Performance Bonds for
construction contracts exceeding $150,000; and
WHEREAS, DCHA is clarifying its requirements to ensure uniform application and
enforceability across all Job Order Contracts;
NOW, THEREFORE, the following shall apply and be binding on the Contractor as part of its
Contract with DCHA:
1. Performance Bond Requirement
The Contractor shall provide a Performance Bond in the amount of 100% of the Job
Order price prior to commencement of any work authorized by an individual Job Order
issued under this Contract. The Performance Bond shall guarantee the faithful
performance of the work in accordance with the terms and conditions of the Contract.
2. Payment Bond Requirement
The Contractor shall provide a Payment Bond in the amount of 100% of the Job 3.
