IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

March 4, 2025

To declare the existence of an emergency with respect to the need to approve Modification Nos.
7, 9, and 13 to Contract No. CW108950 with Stormwater Maintenance, LLC, and to
authorize payment for the goods and services received and to be received under the
contract.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Modification Nos. 7, 9, and 13 to Contract No. CW108950 with
Stormwater Maintenance, LLC Payment Authorization Emergency Declaration Resolution of
2025”.

Sec. 2. (a) There exists an immediate need to approve Modification Nos. 7, 9, and 13 to
Contract No. CW108950 with Stormwater Maintenance, LLC, to perform assessments and
routine, restorative, and reconstructive maintenance on just over 3,000 District-owned and
installed green stormwater infrastructure assets, and to authorize payment for the goods and
services received and to be received under the contract.
(b) On August 13, 2024, by Modification No. 7, the Office of Contracting and
Procurement (“OCP”), on behalf of the Department of Energy and Environment, partially
exercised Option Year One of Contract No. CW108950 for the period of August 14, 2024,
through August 13, 2025, in the not-to-exceed amount of $574,819.
(c) Modification No. 8 was an administrative modification.
(d) On October 9, 2024, by Modification No. 9, OCP increased the not-to-exceed amount
of Option Year One by $415,175.76, from $574,819 to $989,994.76.
(e) Modification No. 10 was withdrawn.
(f) Modification No. 11 was an administrative modification.
(g) Modification No. 12 was an administrative modification.
(h) Proposed Modification No. 13 would:
(1) Rescind Modification Nos. 8, 11, and 12;
(2) Increase the not-to-exceed amount of Option Year One by $5,439,584.35,
from $989,994.76 to $6,429,579.11; and
(3) Fully exercise Option Year One.

(i) Under section 451(b)(1) of the District of Columbia Home Rule Act, approved
December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51(b)(1)), Council approval is
necessary because the modification will increase the value of the contract to more than $1
million during a 12-month period.
(j) Council approval is necessary to allow the continuation of these vital services.
Without Council approval, Stormwater Maintenance, LLC cannot be paid for goods and services
provided in excess of $1 million for the period August 14, 2024, through August 13, 2025.

Sec. 3. The Council of the District of Columbia determines that the circumstances
enumerated in section 2 constitute emergency circumstances making it necessary that the
Modification Nos. 7, 9, and 13 to Contract No. CW108950 with Stormwater Maintenance, LLC
Approval and Payment Authorization Emergency Act of 2025 be adopted after a single reading.

Sec. 4. This resolution shall take effect immediately.
