A RESOLUTION

26-88

IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

April 1, 2025

To declare the existence of an emergency with respect to the need to continue foreclosure
protections for homeowners who applied for funding from the DC Homeowner
Assistance Fund program before September 30, 2022, and whose applications remain
under review, pending approval, pending payment, or under appeal, and to require that
notices continue to be sent to homeowners informing them of the DC Homeowner
Assistance Fund before a foreclosure action.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Foreclosure Moratorium and Homeowner Assistance Fund
Coordination Emergency Declaration Resolution of 2025”.

Sec. 2. (a) The Council has passed a series of emergency and temporary measures that,
among other things, have protected from foreclosure certain homeowners who applied for the
DC Homeowner Assistance Fund (“DC HAF”) no later than 2022 and whose applications were
still unresolved.
(b) The most current legislation, the Foreclosure Moratorium and Homeowner Assistance
Fund Coordination Temporary Amendment Act of 2024, effective September 18, 2024 (D.C.
Law 25-212; D.C. Official Code § 42-851.11), will expire on May 1, 2025.
(c) As of March 2025, District legal services providers report that payment administration
and communication issues have prevented final resolution of a small number of cases for
homeowners who continue to benefit from foreclosure protection.
(d) Emergency legislation is necessary to prevent a lapse in the law prior to the
fulfillment of its purpose.

Sec. 3. The Council of the District of Columbia determines that the circumstances
enumerated in section 2 constitute emergency circumstances making it necessary that the
Foreclosure Moratorium and Homeowner Assistance Fund Coordination Emergency Act of 2025
be adopted after a single reading.

Sec. 4. This resolution shall take effect immediately.
