IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

May 6, 2025

To declare the existence of an emergency with respect to the need to approve Modification No. 8
and proposed Modification No. 9 to Contract No. DCAM-20-CS-RFQ-0002F, and to
authorize payment for the goods and services received and to be received under the
contract.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Modification Nos. 8 and 9 to Contract No. DCAM-20-CS-RFQ-
0002F with American Combustion Industries, Inc. Approval and Payment Authorization
Emergency Declaration Resolution of 2025”.

Sec. 2. (a) There exists an immediate need to approve Modification No. 8 and proposed
Modification No. 9 to Contract No. DCAM-20-CS-RFQ-0002F, and to authorize payment for the
goods and services received and to be received under the contract.
(b) On June 6, 2024, via Modification No. 8, the Department of General Services
partially exercised Option Year 4 for the period June 8, 2024, through June 7, 2025, in the not-
to-exceed amount of $990,000.
(d) Proposed Modification No. 9 would fully exercise Option Year 4, increasing the not-
to-exceed amount by $9,010,000 to $10 million.
(e) Council approval is necessary because the modifications will increase the value of the
contract to more than $1 million during a 12-month period.
(f) Council approval is necessary to allow the continuation of these vital services.
Without Council approval, American Combustion Industries, Inc., cannot be paid for goods and
services in excess of $1 million for the period June 8, 2024, through June 7, 2025.

Sec. 3. The Council of the District of Columbia determines that the circumstances
enumerated in section 2 constitute emergency circumstances making it necessary that the
Modification Nos. 8 and 9 to Contract No. DCAM-20-CS-RFQ-0002F with American
Combustion Industries, Inc. Approval and Payment Authorization Emergency Act of 2025 be
adopted after a single reading.

Sec. 4. This resolution shall take effect immediately.
