A RESOLUTION

26-159

IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

July 1, 2025

To declare the existence of an emergency with respect to the need to amend section 25-113 of
the District of Columbia Official Code to continue the extension of the Streatery Program
endorsements through December 31, 2025, and to clarify endorsement deadlines for
certain classes of licensees; and to amend the Legalization of Marijuana for Medical
Treatment Initiative of 1999 to make a clarifying amendment.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Streatery Program Endorsement Extension and Medical Cannabis
Clarification Emergency Declaration Resolution of 2025”.

Sec. 2. (a) On December 3, 2024, the Council passed the Streatery Program Endorsement
Extension Emergency Amendment Act of 2024, effective December 19, 2024 (D.C. Act 25-669;
71 DCR 16311), and on December 17, 2024, the Council passed the Streatery Program
Endorsement Extension Temporary Amendment Act of 2024, effective March 7, 2025 (D.C.
Law 25-294; 72 DCR 3105) (“temporary act”), to allow licensed establishments that register
with the Alcoholic Beverage and Cannabis Board to offer beer, wine, or spirits for sale on
expanded outdoor space until July 31, 2025 (“Streatery Program”), and to clarify the geographic
requirements for medical cannabis license holders and applicants.
(b) On April 30, 2025, the Committee on Business and Economic Development
(“Committee”) held a hearing on Bill 26-147, the Streatery Program and Protest Process
Amendment Act of 2025. On May 2, 2025, the District Department of Transportation (“DDOT”)
sent the Committee a letter in response to its hearing and released proposed rulemaking for the
permanent Streatery program. The permanent legislation must complete the legislative process.
(c) It is necessary that the provisions of the temporary act continue without interruption
until the permanent legislation is in effect.

Sec. 3. The Council of the District of Columbia determines that the circumstances
enumerated in section 2 constitute emergency circumstances making it necessary that the
Streatery Program Endorsement Extension and Medical Cannabis Clarification Emergency
Amendment Act of 2025 be adopted after a single reading.

Sec. 4. This resolution shall take effect immediately.
