A RESOLUTION

26-197

IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

October 7, 2025

To declare the existence of an emergency, due to congressional review, with respect to the need
to amend section 25-113 of the District of Columbia Official Code to continue the
extension of the Streatery Program endorsements through December 31, 2025, and to
clarify endorsement deadlines for certain classes of licensees; and to amend the
Legalization of Marijuana for Medical Treatment Initiative of 1999 to make a clarifying
amendment.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Streatery Program Endorsement Extension and Medical Cannabis
Clarification Congressional Review Emergency Declaration Resolution of 2025”.

Sec. 2. (a) There exists an immediate need to allow licensed establishments that register
with the Alcoholic Beverage and Cannabis Board to offer beer, wine, or spirits for sale on
expanded outdoor space through December 31, 2025, and to clarify the geographic requirements
for medical cannabis license holders and applicants.
(b) In July 2025, the Council enacted the Streatery Program Endorsement Extension and
Medical Cannabis Clarification Emergency Amendment Act of 2025, effective July 21, 2025
(D.C. Act 26-117; 72 DCR 8173) (“emergency legislation”), and passed on first reading the
Streatery Program Endorsement Extension and Medical Cannabis Clarification Temporary
Amendment Act of 2025, passed on 2nd reading on October 7, 2025 (Enrolled version of Bill 26-
300) (“temporary legislation”), to address the above-referenced needs.
(c) The emergency legislation expires on October 19, 2025. The temporary legislation
must still complete the 30-day review period required by section 602(c)(1) of the District of
Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Official Code § 1-
206.02(c)(1)), and will not become law until after the emergency legislation has expired.
(d) It is necessary that the provisions of the emergency legislation continue in effect,
without interruption, until the temporary legislation is in effect.

Sec. 3. The Council of the District of Columbia determines that the circumstances
enumerated in section 2 constitute emergency circumstances making it necessary that the

Sec. 4. This resolution shall take effect immediately.
