A RESOLUTION

26-330

IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

February 3, 2026

To declare the existence of an emergency with respect to the need to approve the expenditure of
Change Order No. 2 to Contract No. GF-2021-C-0021 by and between Consys, Inc and
the University of the District of Columbia in the amount of $2,070,224.86 for additions to
construction services, and to authorize payment for services received and to be receive
pursuant to Change Order No. 2d.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “University of the District of Columbia Change Order No. 2 to
Contract No. GF 2021-C-0021 with Consys, Inc. Approval and Payment Authorization
Emergency Declaration Resolution of 2026”.

Sec. 2. (a)Pursuant to section 451 of the District of Columbia Home Rule Act, approved
December 24, 1973 (87 Stat. 803; D.C. Code 1-204.51), the Council seeks to approve Change
Order No. 2 to the University of the District of Columbia (“University”) Contract No. GF 2021-
C-0021 with Consys, Inc., for additions to the construction of the Academic Commons –
Relocation of Learning Resources Division and Center for Advanced Learning Project (LRD &
CAL) Project contract previously deemed approved by the Council as CA24-0382 on February 5,
2022, and Change Order No.1 previously deemed approved on April 15, 2024, as CA25-0675.
(b) Emergency legislation is necessary because the University failed to send Change
Order No. 2 to the Council timely and without Council approval on an emergency basis, the
contractor will not be paid for additional construction services requested by the University. This
subjects the University to potential legal risks. The University seeks retroactive approval of
Change Order No. 2 in the amount of $2,070,224.86.

Sec. 3. The Council of the District of Columbia determines that the circumstances
enumerated in section 2 constitute emergency circumstances making it necessary that the
University of the District of Columbia Change Order No. 2 with Consys, Inc. Approval and

Payment Authorization Emergency Act of 2026 be adopted after a single reading.
