A RESOLUTION

26-256

IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

December 2, 2025

To declare the existence of an emergency, due to congressional review, with respect to the need
to amend the District of Columbia Health Occupations Revision Act of 1985 and the
Consent for Vaccination of Minors Amendment Act of 2022 to authorize healthcare
providers in the District to order and administer immunizations recommended by
competent medical and public health organizations designated by the Director of the
Department of Health.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Community Health Congressional Review Emergency
Declaration Resolution of 2025”.

Sec. 2. (a) On September 17, 2025, the Council passed the Community Health
Emergency Amendment Act of 2025, effective September 22, 2025 (D.C. Act 26-0149; 72 DCR
010314) (“emergency act”), which expires on December 21, 2025.
(b) The Community Health Temporary Amendment Act of 2025, enacted on October 23,
2025 (D.C. Act 26-162; __ DCR __) (“temporary act”), was approved by the Council on final
reading at the October 7, 2025, legislative meeting. Because the temporary act must undergo
congressional review, it will not be in effect before the emergency measure expires.
(c) Congressional review emergency legislation is necessary to prevent a gap in the law
between the expiration of the emergency act and the effective date of the temporary act.

Sec. 3. The Council of the District of Columbia determines that the circumstances
enumerated in section 2 constitute emergency circumstances making it necessary that the
Community Health Congressional Review Emergency Amendment Act of 2025 be adopted after
a single reading.

Sec. 4. This resolution shall take effect immediately.
