IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

December 2, 2025

To declare the existence of an emergency with respect to the need to approve Modification Nos.
M0014 and M0015 to Contract No. CW100401 with Wheeler Creek Estates Community
Development Corporation, and to authorize payment for the goods and services received
and to be received under the contract.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Modification Nos. M0014 and M0015 to Contract No.
CW100401 with Wheeler Creek Estates Community Development Corporation Approval and
Payment Authorization Emergency Declaration Resolution of 2025”.

Sec. 2. (a) There exists an immediate need to approve Modification Nos. M0014 and
M0015 to Contract No. CW100401 with Wheeler Creek Estates Community Development
Corporation, and to authorize payment for the goods and services received and to be received
under the contract.
(b) On July 1, 2025, by Modification No. M0014, the Office of Contracting and
Procurement, on behalf of the Department of Human Services, exercised a partial option of
option year 3 of the contract, for the period of July 1, 2025, through December 31, 2025, with
Wheeler Creek Estates Community Development Corporation to provide Permanent Supportive
Housing III program case management services in the not-to-exceed amount of $530,066.04.
(c) Proposed Modification No. M0015 will exercise the remainder of option year 3 and
increase the not-to-exceed amount by $536,261, to a total not-to-exceed amount of
$1,066,327.04.
(d) Under section 451(b)(1) of the District of Columbia Home Rule Act, approved
December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51(b)(1)), Council approval is
necessary because the modifications will increase the value of the contract to more than $1
million during a 12-month period.
(e) Council approval is necessary to allow the continuation of these vital services.
Without this approval, Wheeler Creek Estates Community Development Corporation cannot be
paid for goods and services provided in excess of $1 million for the period from July 1, 2025,
through June 30, 2026.

Sec. 3. The Council of the District of Columbia determines that the circumstances
enumerated in section 2 constitute emergency circumstances making it necessary that the
Modification Nos. M0014 and M0015 to Contract No. CW100401 with Wheeler Creek Estates
Community Development Corporation Approval and Payment Authorization Emergency Act of
2025 be adopted after a single reading.

Sec. 4. This resolution shall take effect immediately.
