A RESOLUTION

IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

December 2, 2025

To declare the existence of an emergency with respect to the need to approve Modification Nos.
M0002 and M0003 to Contract No. CW121533 with Brandywine Valley SPCA to
provide comprehensive animal control services, including operation of the District of
Columbia’s animal shelter and animal disease prevention services, and to authorize
payment for the goods and services received and to be received under the contract.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Modification Nos. M0002 and M0003 to Contract No.
CW121533 with Brandywine Valley SPCA Approval and Payment Authorization Emergency
Declaration Resolution of 2025”.

Sec. 2. (a) There exists a need to approve Modification Nos. M0002 and M0003 to
Contract No. CW121533 with Brandywine Valley SPCA to provide comprehensive animal
control services, including operation of the District of Columbia’s animal shelter and animal
disease prevention services, and to authorize payment for the goods and services received and to
be received under the contract.
(b) By Modification No. M0002, dated October 28, 2025, the Office of Contracting and
Procurement, on behalf of the Department of Health, exercised a partial option for option year
one of the contract for the period of October 29, 2025, through December 2, 2025, in the amount
of $743,083.
(c) Modification No. M0003 is now necessary to exercise the remainder of option year
one for the period of December 3, 2025, through September 30, 2026, increasing the total not-to-
exceed amount to $8,173,916.
(d) Council approval is required because the modifications will increase the value of the
contract to more than $1 million during a 12-month period.
(e) Council approval is necessary to allow the continuation of these vital services.
Without this approval, Brandywine Valley SPCA cannot be paid for goods and services provided
in excess of $1 million for the contract period of October 29, 2025, through September 30, 2026.

Sec. 3. The Council of the District of Columbia determines that the circumstances
enumerated in section 2 constitute emergency circumstances making it necessary that the

reading.

Sec. 4. This resolution shall take effect immediately.
