A RESOLUTION

IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

December 16, 2025

To declare the existence of an emergency with respect to the need to approve Modification No. 6
and proposed Modification No. 7 to Contract No. DCAM-22-CS-RFP-0019, between the
Department of General Services and Smoot Construction Company of Washington, DC, to
provide construction management at-risk services for DC Infrastructure Academy at
Spingarn High School , and to authorize payment for the services received and to be
received under the contract.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Modification Nos. 6 and 7 to Contract No. DCAM-22-CS-RFP-
0019 with Smoot Construction Company of Washington, DC Approval and Payment
Authorization Emergency Declaration Resolution of 2025”.

Sec. 2. (a) There exists an immediate need to approve Modification No. 6 and proposed
Modification No. 7 to Contract No. DCAM-22-CS-RFP-0019 with Smoot Construction
Company of Washington, DC to provide construction management at-risk services for DC
Infrastructure Academy at Spingarn High School, and to authorize payment for the services
received and to be received under the contract.
(b) On October 2, 2025, via Modification No. 6, the Department of General Services
incorporated the added Costs for Additional Scope of Work to the contract, increasing the total
not-to-exceed amount by $999,990 from $58,363,414 to $59,363,404.
(c) Proposed Modification No. 7 would increase the total not-to-exceed amount by
$2,099,032 from $59,363,404 to $61,462,436. Council approval is required because the
aggregate value of Modification No. 6 and proposed Modification No. 7 is over $1 million.

Sec. 3. The Council of the District of Columbia determines that the circumstances
enumerated in section 2 constitute emergency circumstances making it necessary that the
Modification Nos. 6 and 7 to Contract No. DCAM-22-CS-RFP-0019 with Smoot Construction
Company of Washington, DC Approval and Payment Authorization Emergency Act of 2025 be
adopted after a single reading.

Sec. 4. This resolution shall take effect immediately.
