IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

February 3, 2026

To declare the existence of an emergency with respect to the need to approve Modification Nos.
M0007, M0008, and M0009 to Contract No. CW108152 with Keefe Commissary
Network, LLC, and to authorize payment for the goods and services received and to be
received under the contract.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Modification Nos. M0007, M0008, and M0009 to Contract No.
CW108152 with Keefe Commissary Network, LLC Approval and Payment Authorization
Emergency Declaration Resolution of 2026”.

Sec. 2. (a) There exists an immediate need to approve Modification Nos. M0007, M0008,
and M0009 to Contract No. CW108152 with Keefe Commissary Network, LLC to provide
inmate commissary services, and to authorize payment for the goods and services received and to
be received under the contract.
(b) On October 5, 2025, by Modification No. M0007, the Office of Contracting and
Procurement (“OCP”), on behalf of the Department of Corrections, exercised a partial option of
Option Year 2 in the not-to-exceed amount of $675,000 for the period from October 6, 2025,
through December 31, 2025.
(c) On November 24, 2025, by Modification No. M0008, OCP further exercised a partial
option of Option Year 2, increasing the not-to-exceed amount by $325,000 for the period from
January 1, 2026, through February 28, 2026.
(d) Modification No. M0009 would exercise the remainder of Option Year 2 and increase
the not-to-exceed amount by $1 million for the period from March 1, 2026, through October 5,
2026.
(e) Council approval is necessary because the modifications will increase the value of the
contract to more than $1 million during a 12-month period.
(f) Council approval is necessary to allow the continuation of these vital services.
Without Council approval, Keefe Commissary Network, LLC cannot be paid for goods and
services provided in excess of $1 million for the period from October 6, 2025, through October
5, 2026.

Sec. 3. The Council of the District of Columbia determines that the circumstances
enumerated in section 2 constitute emergency circumstances making it necessary that the
Modification Nos. M0007, M0008, and M0009 to Contract No. CW108152 with Keefe
Commissary Network, LLC Approval and Payment Authorization Emergency Act of 2026 be
adopted after a single reading.

Sec. 4. This resolution shall take effect immediately.
