A RESOLUTION

26-335

IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

February 3, 2026

To declare the existence of an emergency with respect to the need to amend the Fraudulent
Vehicle Tag and Parking Enforcement Modernization Amendment Act of 2024 to amend
the subject to appropriations provision.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Parking Enforcement Modernization Technical Correction
Emergency Declaration Resolution of 2026”.

Sec. 2. (a) On December 17, 2024, the Council approved on final reading Bill 25-435, the
Fraudulent Vehicle Tag and Parking Enforcement Modernization Amendment Act of 2024 (D.C.
Law 25-325; 72 DCR 1284) (“Act”). Along with updating statutes that govern parking
enforcement procedures, the Act enhances the District’s ability to conduct enforcement against
vehicles that use fraudulent or obscured vehicle tags and prioritizes the immobilization and
impoundment of abandoned, unidentifiable, and dangerous vehicles.
(b) Through a combination of funds secured by the Committee on Public Works and
Operations, the Committee on Transportation and the Environment, and the Committee of the
Whole, nearly the entirety of the fiscal impact of the Act was fully funded in the Council’s
approved Fiscal Year 2026 budget at approximately $10 million across the financial plan,
primarily in the Department of Public Works and the Department of Motor Vehicles.
(c) However, certain sections of the Act that are now funded continue to be referenced in
the subject to appropriations section, including provisions that require the Mayor to establish
rules by a date certain.
(d) Emergency legislation is necessary to ensure that all funded provisions of the Act are
in effect within the fiscal year they have been funded, to enable timely implementation of the
law.

Sec. 3. The Council of the District of Columbia determines that the circumstances
enumerated in section 2 constitute emergency circumstances, making it necessary that the
Parking Enforcement Modernization Technical Correction Emergency Amendment Act of 2026
be adopted after a single reading.
