Enclosed for consideration and approval by the Council of the District of Columbia is the
“Transfer of Jurisdiction over a Portion of Lot 1008 in Square 1299, being a Portion of
Reservation 357, S.O. 25-01882, Approval Resolution of 2026.”
The proposed resolution will approve the transfer of jurisdiction over a portion of Lot 1008 in
Square 1299, being a portion of Reservation 357, from the United States Department of the
Interior, National Park Service, to the District, in order to facilitate the private redevelopment of
a vacant office building into a primarily multifamily residential building. The approval resolution
will transfer jurisdiction over a small portion of federally owned land located in the public right
of way to allow for ingress and egress from the building.

14 To approve the transfer of jurisdiction over a portion of Lot 1008 in Square 1299, being a portion
15 of Reservation 357, from the United States to the District.

17 RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
18 resolution may be cited as the "Transfer of Jurisdiction over a Portion of Lot 1008 in Square
19 1299, being a Portion of Reservation 357, S.O. 25-01882, Approval Resolution of 2026".
20 Sec. 2. Pursuant to section 1 of An Act To authorize the transfer of jurisdiction over
21 public land in the District of Columbia, approved May 20, 1932 (47 Stat. 161; D .C . Official
22 Code § 10-111 ), the Council approves the transfer of jurisdiction of approximately 709 square
23 feet of land comprising a portion of Reservation 357, and also being a portion of Lot 1008 in
24 Square 1299, as shown on the Surveyor's plat in S.O. 25-01882, from the United States
25 Department of the Interior, National Park Service, to the District of Columbia.
26 Sec. 3. Transmittal.
27 The Council shall transmit a copy of this resolution, upon its adoption, to the Mayor, the
28 Surveyor of the District of Columbia, the District of Columbia Recorder of Deeds, the Executive
29 Director of the National Capital Planning Commission, the Speaker of the United States House
30 of Representatives, the President Pro Tempore of the United States Senate, and the Regional
31 Director of the National Capital Region of the National Park Service.

Sec. 4. Fiscal impact statement. 32
The Council adopts the fiscal impact statement in the committee report as the fiscal 33
impact statement required by section 4a of the General Legislative Procedures Act of 1975, 34
approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a). 35
Sec. 5. Effective date. 36
This resolution shall take effect immediately. 37

Conclusion
Funds are sufficient in the fiscal year 2026 through fiscal year 2029 budget and financial plan to
implement the proposed resolution.
Background
A private developer is redeveloping an office building located along Whitehaven Road, N.W. into a
multifamily residential building with some ground -floor educational uses. The approval resolution
approves the transfer of jurisdiction over a small, 709 square foot sliver of land located in the public
right-of-way from the National Park Service to the District.1 The land will be greenspace and provide
the necessary ingress and egress from the development.
Financial Plan Impact
Funds are sufficient in the fiscal year 2026 through fiscal year 2029 budget and financial plan to
implement the proposed resolution. The transfer of jurisdiction will add this land to the District’s
public space inventory. Like most public space located between the sidewalk and a private building,

the developer will be responsible for maintenance of the transferred land. The transfer is necessary
for the developer to obtain the necessary building permits to continue the project. There are no costs
to the District to implement the resolution.
