A RESOLUTION

26-370

IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

March 31, 2026

To declare the existence of an emergency with respect to the need to approve Contract No.
CW127336 with Compost Crew, Inc., and to authorize payment for the goods and
services received and to be received under the contract.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Contract No. CW127336 with Compost Crew, Inc. Approval and
Payment Authorization Emergency Declaration Resolution of 2026”.

Sec. 2. (a) There exists an immediate need to approve Contract No. CW127336 with
Compost Crew, Inc. and to authorize payment for the goods and services received and to be
received under the contract.
(b) On January 15, 2025, the Office of Contracting and Procurement (“OCP”), on behalf
of the Department of Public Works, executed a letter contract (Contract No. CW127336) with
Compost Crew, Inc. in the not-to-exceed amount of $1 million to provide organic waste
collection, hauling, and processing services from single-family residential households in the
District, including the provision of waste bins to participating households.
(c) According to the terms of the letter contract, OCP must definitize Contract No.
CW127336 by April 15, 2025, for the period of January 15, 2026 through January 14, 2027. The
not-to-exceed amount of Contract No. CW127336 is $4,120,588.45 and the minimum amount is
$117.35.
(d) It has come to the attention of OCP that Compost Crew, Inc.’s contract proposal for
Contract No. CW127336 should have been rejected as non-responsive because it failed clearly to
confirm in its subcontracting plan that 35% of the base year contract price would be
subcontracted to small business enterprises and certified business enterprises as required by
section 2346(d)(1),(3) and (e) of the Small and Certified Business Enterprise Development and
Assistance Act of 2005, effective October 20, 2005 (D.C. Law 16-33; D.C. Official Code § 2-
218.46(d)(1),(3) and (e)). The Office of the Attorney General has requested the subject
legislation to correct this error.

(e) Council approval is now necessary to allow the continuation of these vital services.
Without this approval, Compost Crew, Inc. cannot be paid for goods and services provided in
excess of $1 million for the period from January 15, 2026, through January 14, 2027.

Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
emergency circumstances making it necessary that the Contract No. CW127336 with Compost
Crew, Inc. Approval and Payment Authorization Emergency Act of 2026 be adopted after a
single reading.

Sec. 4. This resolution shall take effect immediately.
