Enclosed for consideration and enactment by the Council of the District of Columbia is an
emergency bill, the "Modification 0001 to Contract No. CW132711 with Total Civil
Construction Approval and Payment Authorization Emergency Act of 2026," and the
accompanying emergency declaration resolution in not-to-exceed amount of $3,741,619.20.
The legislation will approve Modification No.0001 to Contract No. CW132711 with Total Civil
Construction to provide emergency snow removal equipment and operators for period from
January 29, 2026, through February 13, 2026. The legislation will approve payment for the goods
and services received under the contract.

IN TH E COUNCIL OF THE DISTRICT OF COLUMBIA
To declare the existence of an emergency with respect to the need to approve Modification No.
0001 to Contract No. CW13271 l with Total Civil Construction, and to authorize payment
for the goods and services received under the contract and modification.
RESOLVED , BY THE COUNCIL OF THE DISTRICT OF COLUMBIA , That this
resolution may be cited as the "Modification No. 0001 to Contract No . CWl 32711 with Total
Civil Construction Approval and Payment Authorization Emergency Declaration Resolution of
2026 ".
Sec. 2. (a) There exists an immediate need to approve Contract No . CW132711 with
Total Civil Construction, and to authorize payment for the goods and services received under the
contract.
(b) The Office of Contracting and Procurement, on behalf of the Department of Public
Works, executed emergency Contract No. CW13271 l with Total Civil Construction to provide
emergency snow removal equipment and operators in the not-to-exceed amount of $4,674,240
for the period January 29, 2026 , through February 13, 2026. By Modification 0001 , on February
26, 2016, the contract price was reduced to $3,741,619.20 to reflect the actual labor hours used
and include a line item for the 3% surcharge for credit card payments.

(c) Under section 451(b)(1) of the District of Columbia Home Rule Act, approved 32
December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51(b)(1)), Council approval is 33
necessary since the contract is more than $1 million during a 12-month period. 34
(d) Approval is necessary to pay for these vital services. Without this approval, Total 35
Civil Construction cannot be paid for goods and services provided in excess of $1 million for the 36
period from January 29, 2026, through February 13, 2026. 37
Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute 38
emergency circumstances, making it necessary that the Contract No. CW132711 with Total Civil 39
Construction Approval and Payment Authorization Emergency Act of 2026 be adopted after a 40
single reading. 41
Sec. 4. This resolution shall take effect immediately. 42
