Dear Chairman Mendelson:

Enclosed for consideration and enactment by the Council of the District of Columbia is an
emergency bill, the “Modification Nos. M0006 and M0008 to Contract No. GAGA-2022-C-0385-
A with Aramark Educational Services, LLC. Approval and Payment Authorization E mergency
Act of 2026,” and the accompanying emergency declaration resolution. in not -to-exceed amount
of $17,004,045.26.

The legislation approves Modification Nos. M0006 and M0008 to Contract No. GAGA -2022-C-
0385-A with Aramark Educational Services, LLC. to provide food services to 37 school sites
classified as school clusters 2, 5, 6, and 7, and to increase the not-to-exceed amount for option year
two of the contract. In addition, the legislation will approve payment for the goods and services
received and to be received under the modifications.

A PROPOSED RESOLUTION
IN THE COUNCIL OF THE DISTRICT OF COLUMBIA
To declare the existence of an emergency with respect to the need to approve Modification Nos.
M0006 and M0008 to Contract No . GAGA-2022-C-0385-A with Aramark Educational
Services, LLC., and to authorize payment for the goods and services received and to be
received under the modifications.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the "Modification Nos. M0006 and M0008 to Contract No. GAGA-
2022-C-0385-A with Aramark Educational Services, LLC , Approval and Payment Authorization
Emergency Declaration Resolution of 2026".
Sec. 2. (a) There exists an immediate need to approve Modification Nos. M0006 and
M0008 to Contract No. GAGA-2022-C-0385-A with Aramark Educational Services, LLC, and
to authorize payment for the goods and services received and to be received under the
modifications.
(b) By Modification No. M0005, the District of Columbia Public Schools, exercised
option year two of Contract No. GAGA-2022-C-0385-A with Aramark Educational Services,
LLC to provide food services to 3 7 assigned school sites in the District of Columbia in the not­
to-exceed amount of $14,078,065.88 for the period of July 1, 2025, through June 30, 2026.

(c) Modification No. M0006 increased the not-to-exceed amount by $694,096.76, to a 33
total not-to-exceed amount of $14,772,162.64. 34
(d) Proposed Modification No. 0008 will increase the not-to-exceed amount by 35
$2,231,882.62 to a total not-to-exceed amount of $17,004,045.26 for option year two. 36
(e) The total increase to option year one under Modification Nos. M0006 and M0008 is 37
$2,925,979.38. 38
(f) Under section 451(b)(1) of the District of Columbia Home Rule Act, approved 39
December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51(b)(1)), Council approval is 40
necessary since the modifications will increase the value of the contract by more than $1 million 41
during a 12-month period. 42
(g) Approval is necessary to allow the continuation of these vital services. Without this 43
approval, Aramark Educational Services, LLC cannot be paid for goods and services provided in 44
excess of $14,078,065.88 for the period from July 1, 2025, through June 30, 2026. 45
Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute 46
emergency circumstances making it necessary that the Modification Nos. M0006 and M0008 to 47
Contract No. GAGA-2022-C-0385-A with Aramark Educational Services, LLC Approval and 48
Payment Authorization Emergency Act of 2026 be adopted after a single reading. 49
Sec. 4. This resolution shall take effect immediately. 50
