To approve an amendment to the term sheet for the disposition for the Hill East Phase II Budle 2 15
property located at 1900 Massachusetts Avenue, SE. 16

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 18
resolution may be cited as the “Hill East Phase II Bundle 2 Disposition Term Sheet Amendment 19
Approval Resolution of 2026”. 20
Sec. 2. (a) The Council approved the Hill East Phase II Bundle 2 Surplus Declaration and 21
Disposition Approval Act of 2022, effective March 10, 2023 (D.C. Law 24 -0322; 70 DCR 3553) 22
(“the Hill East Phase II Bundle 2 Act”), which was accompanied by a term sheet, dated September 23
20, 2022, that was executed by the Deputy Mayor for Planning and Economic Development and 24
the proposed developer. The term sheet outlined certain terms and conditions of the disposition 25
of real property located at 1900 Massachusetts Avenue, SE, in Washington, DC, and known for 26
taxation and assessment purposes as a portion of Lot 7 in Square E-1112 (“Property”). 27
(b) Section 3(k) of the Hill East Phase II Bundle 2 Act states that the term sheet for the 28
disposition of the Property was submitted by the Mayor to the Council in accordance with section 29
1(b-1)(2) of An Act Authorizing the sale of certain real estate in the District of Columbia no longer 30
required for public purposes, approved August 5, 1939 (53 Stat. 1211; D.C. Official Code § 10-31
801(b-1)(2)) (the “Property Disposition Act”). 32

(c) Term sheets submitted to Council in accordance with section 1(b-1)(2) of the Property 33
Disposition Act (D.C. Official Code § 10-801(b-1)(2)), may be substantively modified pursuant to 34
section 1(b-4) of the Property Disposition Act (D.C. Official Code § 10-801(b-4)). 35
(d) Pursuant to such section 1(b- 4) of the Property Disposition Act (D.C. Official Code § 36
10-801(b-4)), the Mayor submitted to the Council, along with this resolution, an amended term 37
sheet, in redline form, that reflects certain substantive changes related to the business terms of the 38
transaction of the Property (“amended term sheet”). 39
(e) The Council approves the amended term sheet submitted with this resolution. 40
Sec. 3. Transmittal. 41
The Council shall transmit a copy of this resolution, upon its adoption, to the Mayor. 42
Sec. 4. Fiscal impact statement. 43
The Council adopts the fiscal impact statement of the Chief Financial Officer as the fiscal 44
impact statement required by section 4a of the General Legislative Procedures Act of 1975, 45
approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a). 46
Sec. 5. Effective date. 47
This resolution shall take effect immediately. 48
