Dear Chairman Mendelson:
Enclosed for consideration and enactment by the Council of the District of Columbia is an
emergency bill, the "Modification Nos. M0008 and M0009 to Contract No. CWI 13639 with
Safeware, Inc. Approval and Payment Authorization Emergency Act of 2026," and the
accompanying emergency declaration resolution for option period two is increase d by $700,000
from $900,000 to $1,600,000 for the period of perform ance of February 27, 2026, t hrough
February 26, 2027.
The legislation will approve Modification Nos. M0008 and M0009 to Contract No. CWI 13639
with Safeware, Inc. to provide firefighting tools, hazardous materials response equipment, and
safety equipment, and to increase the not-to-exceed amount for option year two of the contract. In
addition, the legislation will approve payment for the goods and services received and to be
received under the modifications.

16 M0008 and M0009 to Contract No . CWl 13639 w ith Safeware, Inc., and to authorize
17 payment for the goods and services received and to be received under the modifications.

19 RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA , That this
20 resolution may be cited as the "Modification Nos. M0008 and M0009 to Contract No.
21 CWl 13639 with Safeware, Inc. Appro val and Payment Authorization E mergency Declaration
22 Resolution of 2026".
23 Sec. 2. (a) Th ere exists an imm ediate need to approve Modification Nos. M0008 and
24 M0009 to Contract No . CWl 13639 with Safeware, Inc., and to authorize payment for the goods
25 and services received and to be received under the modifications.
26 (b) By Modification No . M0008 , the Office of Contracting and Procurement, on behalf of
27 the Fire and Emergency Medical Services Department, exercised option year two of Contract
28 No . CWl 13639 with Safeware, Inc. to provide firefighting tools, hazardous materials response
29 equipment, and safety equipment in the not-to-exceed amount of $900,000 for the period
30 February 27, 2026 through February 26, 2027.
31 ( c) Proposed Modification No . M0009 will increase the not-to-exceed amount in option
32 year two by $700,000, to a total not-to-exceed amount of $1.6 million.

(d) Under section 451(b)(1) of the District of Columbia Home Rule Act, approved 33
December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51(b)(1)), Council approval is 34
necessary since the modifications will increase the value of the contract to more than $1 million 35
during a 12-month period. 36
(e) Approval is necessary to allow the continuation of these vital services. Without this 37
approval, Safeware, Inc. cannot be paid for goods and services provided in excess of $1 million 38
for the period from February 27, 2026 through February 26, 2027. 39
Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute 40
emergency circumstances making it necessary that the Modification Nos. M0008 and M0009 to 41
Contract No. CW113639 with Safeware, Inc. Approval and Payment Authorization Emergency 42
Act of 2026 be adopted after a single reading. 43
Sec. 4. This resolution shall take effect immediately. 44
