Enclosed for consideration and enactment by the Council of the District of Columbia is an
emergency bill, the “Modification Nos. M0026 and M0027 to Contract CW90941 with Aramark
Correctional Services, LLC Approval and Payment Authorization Emergency Act of 2026,” and
the accompanying emergency declaration resolution, not-to-exceed $7,812,415.

The legislation will approve Modification Nos. M0026 and M0027 to Contract No. CW90941 with
Aramark Correctional Services, LLC to provide inmate food management services and to increase
the not -to-exceed amount for option year four of the contract. In addi tion, the legislation will
approve payment for the goods and services received and to be received under the modifications.

A PROPOSED RESOLUTION
IN THE COUNCIL OF THE DISTRICT OF COLUMBIA
To declare the existence of an emergency with respect to the need to approve Modification Nos.
M0026 and M0027 to Contract No. CW90941 with Aramark Correctional Services, LLC,
and to authorize payment for the goods and services received and to be received under
the contract and modifications.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the "Modification Nos . M0026 and M0027 to Contract No. CW90941
with Aramark Correctional Services, LLC Approval and Payment Authorization Emergency
Declaration Resolution of 2026".
Sec. 2.(a) There exists an immediate need to approve Modification Nos. M0026 and
M0027 to Contract No. CW90941 with Aramark Correctional Services, LLC, and to authorize
payment for the goods and services received and to be received under the contract and
modifications.
(b) On July 11, 2025, by Modification No. M0022, the Office of Contracting and
Procurement ("OCP"), on behalf of the Department of Corrections, exercised a full option of
option year four of Contract No. CW90941 with Aramark Correction Services, LLC to provide
inmate food management services in the not-to-exceed amount of $6,107,415 for the period
September 15, 2025 through September 14, 2026 (CA26-0303).

(c) By Modification No. M0026, OCP increased the not-to-exceed amount for option year 33
four by $955,000, to a total not-to-exceed amount of $7,062,415. 34
(d) Proposed Modification No. M0027 will increase the not-to-exceed amount for option 35
year four by $750,000, to a total not-to-exceed amount of $7,812,415. 36
(e) Under section 451(b)(1) of the District of Columbia Home Rule Act, approved 37
December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51(b)(1)), Council approval is 38
necessary since the modifications will increase the value of the contract to more than $1 million 39
during a 12-month period. 40
(f) Approval is necessary to allow the continuation of these vital services. Without this 41
approval, Aramark Correctional Services, LLC cannot be paid for goods and services provided in 42
excess of $1 million for the period September 15, 2025, through September 14, 2026. 43
Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute 44
emergency circumstances making it necessary that the Modification Nos. M0026 and M0027 to 45
Contract No. CW90941 with Aramark Correctional Services, LLC Approval and Payment 46
Authorization Emergency Act of 2026 be adopted after a single reading. 47
Sec. 4. This resolution shall take effect immediately. 48
