To declare the existence of an emergency, due to congressional review, with respect to the need 14
to amend the Small and Certified Business Enterprise Development and Assistance Act of 15
2005 to require a business applying for certification as a local business enterprise to be 16
independently owned and operated, to amend minimum certified business enterprise 17
performance requirements in a certified joint venture, and to establish uniform hearing 18
procedures for enforcement actions. 19

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 21
resolution may be cited as the “Certified Business Enterprise Program Compliance and 22
Enforcement Support Congressional Review Emergency Declaration Resolution of 2026”. 23
Sec. 2. (a) On May 5, 2026, the Council unanimously approved the Certified Business 24
Enterprise Program Compliance and Enforcement Support Emergency Amendment Act of 2026, 25
effective May 29, 2026 (D.C. Act 26-334; 73 DCR 8193) (“Emergency Act”). The Emergency 26
Act is set to expire on August 27, 2026. 27
(b) On June 2, 2026, the Council unanimously approved the Certified Business Enterprise 28
Program Compliance and Enforcement Support Temporary Amendment Act of 2026, enacted 29
June 25, 2026 (D.C. Act 26-349; 73 DCR 9206) (“Temporary Act”). The Temporary Act has 30
been transmitted to Congress and has a projected law date of September 19, 2026. 31
(d) This congressional review emergency legislation is necessary to prevent a gap in the law 32
between the expiration of the Emergency Act and the completion of the Temporary Act’s 33
congressional review period. 34

Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute 36
emergency circumstances making it necessary that the Certified Business Enterprise Program 37
Compliance and Enforcement Support Congressional Review Emergency Amendment Act of 38
2026 be adopted after a single reading. 39

Sec. 4. This resolution shall take effect immediately. 41
