IN THE COUNCIL OF TH E DISTRICT OF COLUMBIA
15 To declare the existence of an emergency with respect to the need to approve Contract No.
16 DCKA-2026-C-0901 with Strittmatter Metro, LLC and Modification Nos. M00l and
17 M002 thereto, and to authorize payment for the goods and services received under the
18 contract and modifications.

20 RESOLVED , BY THE COUNCIL OF THE DISTRICT OF COLUMBIA , That this
21 resolution may be cited as the "Contract No. DCKA-2026-C-090 l with Strittmatter Metro, LLC
22 Approval and Payment Authorization Emergency Declaration Resolution of 2026".
23 Sec. 2. (a) There exists an immediate need to approve Contract No. DCKA-2026-C-
24 0901 with Strittmatter Metro, LLC, and to authorize payment for the goods and services received
25 under the contract and modifications.
26 (b) On January 23, 2026, the Mayor issued Mayor's Order 2026-005, declaring a public
27 emergency in response to the significant snow and ice event that was forecasted for the
28 Washington metropolitan area.
29 ( c) On January 27, 2026 , the Office of Contracting and Procurement ("OCP "), on behalf
30 of the District Department of Transportation, executed emergency letter contract Contract No.
31 DCKA-2026-C-0901 with Strittmatter Metro, LLC to provide emergency snow removal
32 equipment and operators in the not-to-exceed amount of $1.6 million.

(d) On February 12, 2026, by Modification No. M001, OCP increased the not-to-exceed 33
amount by $1.6 million to a total not-to-exceed amount of $3.2 million. 34
(e) On April 10, 2026, by Modification No. M002, OCP and Strittmatter Metro, LLC 35
acknowledged that Strittmatter Metro, LLC had been paid $3.2 million under Contract No. 36
DCKA-2026-C-0901. 37
(f) Contract No. DCKA-2026-C-0901 expired by its own terms after 90 days. 38
(g) Under section 451(b)(1) of the District of Columbia Home Rule Act, approved 39
December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51(b)(1)), Council approval is 40
necessary since the contract is more than $1 million during a 12-month period. 41
(h) Approval is necessary to pay for these vital services. Without this approval, 42
Strittmatter Metro, LLC cannot be paid for goods and services provided in excess of $1 million 43
for the 90-day period. 44
(i) It is also necessary for the legislation to state that the Council approves the contract 45
notwithstanding the requirements of 27 D.C.M.R § 2425.7 because the letter contract was 46
approved at 100% of the anticipated overall price ceiling. 47
Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute 48
emergency circumstances making it necessary that Contract No. DCKA-2026-C-49
0901 Strittmatter Metro, LLC Approval and Payment Authorization Emergency Act of 2026 be 50
adopted after a single reading. 51
Sec. 4. This resolution shall take effect immediately. 52
