15 To declare the existence of an emergency with respect to the need to approve Modification No.
16 M00l to Contract No. CW132368 with Eastern Salt Company, Inc., and to authorize
17 payment for the goods and services received and to be received under the contract.

19 RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
20 resolution may be cited as the "Modification No. M00l to CW132368 with Eastern Salt
21 Company, Inc. Approval and Payment Authorization Emergency Declaration Resolution of
22 2026".
23 Sec. 2. (a) There exists an immediate need to approve Modification No . M00l to
24 Contract No . CW132368 with Eastern Salt Company, Inc., and to authorize payment for the
25 goods and services received and to be received under the contract.
26 (b) The Office of Contracting and Procurement, on behalf of the Department of Public
27 Works, executed Contract No. CW132368 with Eastern Salt Company, Inc. to provide de-icing
28 salt for snow events in the not-to-exceed amount of $1 million for the period from January 22,
29 2026, through December 14, 2026.
30 (c) Emergency Modification No . M00l increased the not-to-exceed amount by $4
31 million, to a total not-to-exceed amount of $5 million.

(d) Under section 451(b)(1) of the District of Columbia Home Rule Act, approved 33
December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51(b)(1)), Council approval is 34
necessary since the modification increased the value of the contract by more than $1 million 35
during a 12-month period. 36
(e) Approval is necessary to pay for these vital goods and services. Without this 37
approval, Eastern Salt Company, Inc. cannot be paid for goods and services provided in excess 38
of $1 million for the period from January 22, 2026, through December 14, 2026. 39
Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute 40
emergency circumstances making it necessary that Modification No. M001 to Contract No. 41
CW132368 with Eastern Salt Company, Inc. Approval and Payment Authorization Emergency 42
Act of 2026 be adopted after a single reading. 43
Sec. 4. This resolution shall take effect immediately. 44
