30 (c) Under section. 451(b)(1) af flie District of Columbia Home Rule A.ct. approved
31 December 24, 1973 (87 Stat :803; D .C. Ofmcial Code§ l-204.5l(b)(l)), Council a.pprovaJ is
32 necessary since flie oommct is. mo re fllan $1 million during a 12-month period.
(d) Approval is necessary to pay for these vital services. Without this approval, Fort 33
Myer Construction Corporation cannot be paid for goods and services provided in excess of $1 34
million for the period from January 27, 2026, through February 19, 2026. 35
(e) It is also necessary for the legislation to state that the Council approves the contract 36
notwithstanding the requirements of 27 D.C.M.R. § 2425.7 because the letter contract was 37
approved at 100% of the anticipated overall price ceiling. 38
Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute 39
emergency circumstances making it necessary that Contract No. DCKA-2026-C-0900 with Fort 40
Myer Construction Corporation Approval and Payment Authorization Emergency Act of 2026 be 41
adopted after a single reading. 42
Sec. 4. This resolution shall take effect immediately. 43
