Dear Chairman Mendelson:
Enclosed for consideration and enactment by the Council of the District of Columbia is an
emergency bill, the “Modification Nos. M01, M02 and M03 to Contract No. CW131646
with Shaw Solutions LLC Approval and Payment Authorization Emergency Act of 2026,” and
the accompanying emergency declaration resolution.
The legislation will approve emergency Modification Nos. M01, M02 and M03 to Contract No.
CW131648 with Shaw Solutions LLC to provide equipment and qualified operators for snow
plowing and removal for the period from January 20, 2026, through January 19, 2027. The
legislation will approve payment for the goods and services received and to be received under the
contract in the not-to-exceed amount of $3,000,000.

A PROPOSED RESOLUTION
IN THE COUNCIL OF THE DISTRICT OF COLUMBIA
To declare the existence of an emergency with respect to the need to approve Modification Nos.
M0l, M02 and M03 to Contract No. CW131646 with Shaw Solutions LLC, and to
authorize payment for the goods and services received and to be received under the
contract.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the "Modification Nos. M0l, M02 and M03 to CW131646 with Shaw
Solutions LLC Approval and Payment Authorization Emergency Declaration Resolution of
2026".
Sec. 2. (a) There exists an immediate need to approve Modification Nos. M0l, M02 and
M03 to Contract No. CW131646 with Shaw Solutions LLC, and to authorize payment for the
goods and services received and to be received under the contract.
(b) On January 20, 2026, the Office of Contracting and Procurement ("OCP"), on behalf
of the Department of Public Works, executed Contract No. CWl 31646 with Shaw Solutions
LLC to provide equipment and qualified operators for snow plowing and removal in the not-to
exceed amount of $1 million for the period from January 20, 2026, through January 19, 2027.
(c) On January 22, 2026, by Emergency Modification No. M0l, OCP increased the not
to-exceed amount by $4 million, to a total not-to-exceed amount of $5 million.

(d) On April 27, 2026, by Emergency Modification No. M02, OCP decreased the not-to-33
exceed amount by $2 million, to a total not-to-exceed amount of $3 million. 34
(e) On June 2, 2026, OCP executed Emergency Modification No. M03, an administrative 35
modification to clarify the price schedule, but did not change the total not-to-exceed amount of 36
$3 million. 37
(f) Under section 451(b)(1) of the District of Columbia Home Rule Act, approved 38
December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51(b)(1)), Council approval is 39
necessary since the modifications increased the value of the contract by more than $1 million 40
during a 12-month period. 41
(g) Approval is necessary to pay for these vital goods and services. Without this 42
approval, Shaw Solutions LLC cannot be paid for goods and services provided in excess of $1 43
million for the period from January 20, 2026, through January 19, 2027. 44
Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute 45
emergency circumstances making it necessary that Modification Nos. M01, M02 and M03 to 46
Contract No. CW131646 with Shaw Solutions LLC Approval and Payment Authorization 47
Emergency Act of 2026 be adopted after a single reading. 48
Sec. 4. This resolution shall take effect immediately. 49
