Enclosed for consideration and enactment by the Council of the District of Columbia is an
emergency bill, the “Contract No. CW128161 with OceanPro Industries, Ltd. and Modification
Nos. M001, M002, M003, M004 and M004a Approval and Payment Authorization Emergency
Act of 2026” and the accompanying emergency declaration resolution, not-to-exceed amount of
$1,737,357.81.
The legislation will approve Contract No. CW128161 with OceanPro Industries, Ltd., to provide
groceries for the preparation of meals for youth, and Modification Nos. M001, M002, M003,
M004, and M004a thereto. In addition, the legislation will approve payment for the goods
and services received and to be received under the contract and the modifications.

15 To declare the existence of an emergency with respect to the need to approve Contract No.
16 CW128161 with OceanPro Industries, Ltd., and Modification Nos. M00l, M002, M003,
17 M004 and M004a to Contract No. CW128161, and to authorize payment for the goods
18 and services received and to be received under the contract and modifications.

20 RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
21 resolution may be cited as the "Contract No. CW128161 with OceanPro Industries, Ltd.
22 Approval and Payment Authorization Emergency Declaration Resolution of 2026".
23 Sec. 2. (a) There exists an immediate need to approve Contract No. CW128161 with
24 OceanPro Industries, Ltd., and M00l, M002, M003, M004 and M004a thereto, and to authorize
25 payment for the goods and services received and to be received under the contract.
26 (b) On August 4, 2025, the Office of Contracting and Procurement ("OCP"), on behalf of
27 the Department of Youth Rehabilitation Services ("DYRS"), executed Contract No. CW128161
28 with OceanPro Industries, Ltd., to provide groceries for the preparation of meals for youth, in the
29 amountof$181,031.59.
30 (c) By Modification No. 001, OCP increased the not-to-exceed amount of the contract by
31 $155,000, to a total not-to-exceed amount of$336,031.59.
32 ( d) By Modification No . 002, OCP increased the not-to-exceed amount of the contract by
33 $617,426.42, to a total not-to-exceed amount of $953,458.01.

(e) By Modification No. 003, OCP increased the not-to-exceed amount of the contract by 35
$400,698.88, to a total not-to-exceed amount of $1,354,156.89. 36
(f) By Modification No. 004, OCP increased the amount of the contract by $383,200.92, 37
to $1,737,357.81. 38
(g) Modification No.004a revised the contract amount to a total not-to-exceed amount of 39
$1,737,357.81. 40
(h) Under section 451(b)(1) of the District of Columbia Home Rule Act, approved 41
December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51(b)(1)), Council approval is 42
necessary since the modifications will increase the value of the contract to more than $1 million 43
during a 12-month period. 44
(i) Approval is necessary to allow the continuation of these vital services. Without this 45
approval, OceanPro Industries, Ltd. cannot be paid for goods and services provided in excess of 46
$1 million for the period from August 4, 2025, through August 3, 2026. 47
Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute 48
emergency circumstances making it necessary that the Contract No. CW128161 with OceanPro 49
Industries, Ltd. Approval and Payment Authorization Emergency Act of 2026 be adopted after a 50
single reading. 51
Sec. 4. This resolution shall take effect immediately. 52
