creating s. 110.1185, F.S.; defining the term "living 3
organ donor"; requiring state agencies to grant 4
administrative leave, not to exceed a specified number 5
of days, to allow an employee to serve as a living 6
organ donor; specifying that such leave is in addition 7
to other leave authorized by law; creating s. 381.865, 8
F.S.; defining the terms "employer" and "living organ 9
donor"; requiring certain employers to grant an unpaid 10
leave of absence to allow an employee to serve as a 11
living organ donor under certain circumstances; 12
specifying the length of such leave of absence; 13
authorizing employers to grant paid or unpaid leave 14
for a period longer than the required period of time; 15
providing an effective date. 16

Be It Enacted by the Legislature of the State of Florida: 18

Section 1. Section 110.1185, Florida Statutes, is created 20
to read: 21
110.1185 Administrative leave for living organ donation.— 22
(1) As used in this section, the term "living organ donor" 23
means a person who donates all or part of a human organ while he 24
or she is alive for transplantation into another person. 25

(2) Each state agency shall grant administrative leave, 26
with pay, not to exceed 30 working days, to allow an employee to 27
serve as a living organ donor. Administrative leave granted 28
under this section is in addition to any medical, personal, or 29
other leave otherwise authorized by law. 30
Section 2. Section 381.865, Florida Statutes, is created 31
to read: 32
381.865 Leave for living organ donation by employees of 33
private employers and local governments.— 34
(1) As used in this section, the term: 35
(a) "Employer" means a private employer, including a sole 36
proprietor, partnership, corporation, limited liability company, 37
or other entity, or a political subdivision of the state, that 38
employs 50 or more employees. 39
(b) "Living organ donor" means a person who donates all or 40
part of a human organ while he or she is alive for 41
transplantation into another person. 42
(2)(a) An employer shall grant an employee an unpaid leave 43
of absence to allow the employee to serve as a living organ 44
donor if the employee submits a written request for such leave, 45
including written documentation from the attending physician 46
confirming the date of the donation. The leave shall continue 47
until the attending physician provides medical clearance for the 48
employee to resume work duties. 49
(b) The unpaid leave of absence granted pursuant to 50

paragraph (a) is in addition to any medical, personal, or other 51
paid leave provided by the employer. 52
(c) An employer may grant paid or unpaid leave for a 53
period longer than required by paragraph (a). 54
Section 3. This act shall take effect July 1, 2026. 55
