An act relating to animal welfare; amending s. 828.12, 2
F.S.; creating the offense of causing or enticing a 3
minor to commit, or in the presence of a minor 4
committing, animal cruelty; requiring a court to order 5
a minor who commits specified acts of animal cruelty 6
to undergo a psychological evaluation and receive 7
counseling and treatment for a specified time period; 8
requiring the minor's parent or guardian or the state 9
to pay the cost of such evaluation, counseling, and 10
treatment; providing an exception; authorizing the 11
court to hold the parent or guardian in contempt under 12
certain circumstances; requiring the Department of Law 13
Enforcement to post on its website specified 14
information relating to each individual convicted of 15
specified animal cruelty offenses; specifying time 16
periods for which the information shall be posted; 17
requiring the department to develop a procedure to 18
allow a person to petition for the removal of his or 19

Be It Enacted by the Legislature of the State of Florida: 43
44
Section 1. Subsections (4) through (7) of section 828.12, 45
Florida Statutes, are renumbered as subsections (6) through (9), 46
respectively, present subsection (7) is amended, new subsections 47
(4) and (5) are added to that section, and subsections (1) and 48
(2) of that section are republished, to read: 49
828.12 Cruelty to animals.— 50

(1) A person who unnecessarily overloads, overdrives, 51
torments, deprives of necessary sustenance or shelter, or 52
unnecessarily mutilates, or kills any animal, or causes the same 53
to be done, or carries in or upon any vehicle, or otherwise, any 54
animal in a cruel or inhumane manner, commits animal cruelty, a 55
misdemeanor of the first degree, punishable as provided in s. 56
775.082 or by a fine of not more than $5,000, or both. 57
(2) A person who intentionally commits an act to any 58
animal, or a person who owns or has the custody or control of 59
any animal and fails to act, which results in the cruel death, 60
or excessive or repeated infliction of unnecessary pain or 61
suffering, or causes the same to be done, commits aggravated 62
animal cruelty, a felony of the third degree, punishable as 63
provided in s. 775.082 or by a fine of not more than $10,000, or 64
both. 65
(a) A person convicted of a violation of this subsection, 66
where the finder of fact determines that the violation includes 67
the knowing and intentional torture or torment of an animal that 68
injures, mutilates, or kills the animal, shall be ordered to pay 69
a minimum mandatory fine of $2,500 and undergo psychological 70
counseling or complete an anger management treatment program. 71
(b) A person convicted of a second or subsequent violation 72
of this subsection shall be required to pay a minimum mandatory 73
fine of $5,000 and serve a minimum mandatory period of 74
incarceration of 6 months. In addition, the person shall be 75

released only upon expiration of sentence, is not eligible for 76
parole, control release, or any form of early release, and must 77
serve 100 percent of the court-imposed sentence. Any plea of 78
nolo contendere shall be considered a conviction for purposes of 79
this subsection. 80
(4) A person 18 years of age or older commits a felony of 81
the third degree, punishable as provided in s. 775.082, s. 82
775.083, or s. 775.084, if he or she causes or entices a minor 83
to commit, or in the presence of a minor commits, a violation of 84
subsection (2). 85
(5)(a) If a minor commits an act of animal cruelty as 86
described in subsection (1) or subsection (2), the juvenile 87
court must order the minor to undergo a psychological evaluation 88
and, if recommended, receive counseling or treatment for a 89
length of time as prescribed by the juvenile court. 90
(b) The minor's parent or guardian, or the state if the 91
minor is a ward of the state, shall pay the cost of the 92
psychological evaluation, counseling, or treatment as ordered by 93
the juvenile court in paragraph (a). If the juvenile court makes 94
a finding of indigency and significant financial hardship, the 95
court shall waive the fee or reduce it to an amount deemed 96
appropriate. If the minor's parent or guardian willfully refuses 97
to follow the recommended treatment for the minor, the juvenile 98
court may hold the parent or guardian in contempt. 99

Department of Law Enforcement shall post on its website, in a 101
searchable format prescribed by the department, the name and all 102
aliases, date of birth, race, county of conviction, charge or 103
charges, case number, disposition, description of any 104
identifying marks and tattoos, and a photograph taken at the 105
time of booking related to the animal cruelty offense of each 106
individual names of those individuals who has have been 107
convicted of, or who has have entered a plea of guilty or nolo 108
contendere to, regardless of adjudication, a violation of this 109
section. 110
(b) The department shall post the information about each 111
individual as required in paragraph (a) for the following 112
periods: 113
1. Three years from the date of conviction, for a first 114
conviction of a misdemeanor offense. 115
2. Five years from the date of conviction, for a first 116
conviction of a felony offense. 117
3. Ten years from the date of conviction, for a subsequent 118
conviction of either a misdemeanor or felony offense. 119
(c) The department shall develop a procedure to allow a 120
person whose conviction has been overturned or who has received 121
a sealing of the criminal history record for which his or her 122
information was publicly posted as required in paragraph (a) to 123
petition for the removal of his or her information. The 124
department, after receiving a petition with adequate 125

documentation, must remove such information from the website 126
within 30 days. The department may adopt rules to implement this 127
paragraph. 128
(d) Each clerk of court and county detention facility must 129
provide the Department of Law Enforcement with the information, 130
data, and images required in paragraph (a). 131
Section 2. Subsections (4) through (10) of section 132
828.122, Florida Statutes, are renumbered as subsections (5) 133
through (11), respectively, subsection (3) of that section is 134
amended, and a new subsection (4) is added to that section, to 135
read: 136
828.122 Fighting or baiting animals; offenses; penalties.— 137
(3) Any person who knowingly commits any of the following 138
acts commits a felony of the third degree, punishable as 139
provided in s. 775.082, s. 775.083, or s. 775.084: 140
(a) Baiting, breeding, training, transporting, selling, 141
owning, possessing, or using any wild or domestic animal for the 142
purpose of animal fighting or baiting; 143
(b) Owning, possessing, or selling equipment for use in 144
any activity described in paragraph (a); 145
(c) Owning, leasing, managing, operating, or having 146
control of any property kept or used for any activity described 147
in paragraph (a) or paragraph (b); 148
(d) Promoting, staging, advertising, or charging any 149
admission fee to a fight or baiting between two or more animals; 150

(e) Performing any service or act to facilitate animal 151
fighting or baiting, including, but not limited to, providing 152
security, refereeing, or handling or transporting animals or 153
being a stakeholder of any money wagered on animal fighting or 154
baiting; 155
(f) Removing or facilitating the removal of any animal 156
impounded under this section from an agency where the animal is 157
impounded or from a location designated by the court under 158
subsection (5) (4), subsection (6) (5), or subsection (8) (7), 159
without the prior authorization of the court; 160
(g) Betting or wagering any money or other valuable 161
consideration on the fighting or baiting of animals; or 162
(h) Attending the fighting or baiting of animals. 163

Notwithstanding any provision of this subsection to the 165
contrary, possession of the animal alone does not constitute a 166
violation of this section. 167
(4) A person 18 years of age or older commits a felony of 168
the third degree, punishable as provided in s. 775.082, s. 169
775.083, or s. 775.084, if he or she causes or entices a minor 170
to commit, or in the presence of a minor commits, a violation of 171
subsection (3). 172
Section 3. Subsections (4) and (5) of section 828.126, 173
Florida Statutes, are renumbered as subsections (5) and (6), 174

828.126 Sexual activities involving animals.— 177
(2) A person may not: 178
(a) Knowingly engage in any sexual contact with an animal; 179
(b) Knowingly cause, aid, or abet another person to engage 180
in any sexual contact with an animal; 181
(c) Knowingly permit any sexual contact with an animal to 182
be conducted on any premises under his or her charge or control; 183
(d) Knowingly organize, promote, conduct, aid, abet, 184
participate in as an observer, or advertise, offer, solicit, or 185
accept an offer of an animal for the purpose of sexual contact 186
with such animal, or perform any service in the furtherance of 187
an act involving any sexual contact with an animal; or 188
(e) Knowingly film, distribute, or possess any 189
pornographic image or video of a person and an animal engaged in 190
any of the activities prohibited by this section. 191
(4) A person 18 years of age or older commits a felony of 192
the third degree, punishable as provided in s. 775.082, s. 193
775.083, or s. 775.084, if he or she causes or entices a minor 194
to commit, or in the presence of a minor commits, a violation of 195
subsection (2). 196
Section 4. Subsection (2) of section 828.27, Florida 197
Statutes, is amended to read: 198

(2) The governing body of a county or municipality is 201
authorized to enact ordinances relating to animal control or 202
cruelty, which ordinances must provide: 203
(a) That a violation of such an ordinance is a civil 204
infraction. 205
(b) A maximum civil penalty not to exceed: 206
1. Two thousand five hundred dollars for a first 207
violation. 208
2. Five thousand dollars for a second violation. 209
3. Seven thousand five hundred dollars for a third or 210
subsequent violation $500. 211
(c) A civil penalty of less than the maximum civil penalty 212
if the person who has committed the civil infraction does not 213
contest the citation. 214
(d) For the issuance of a citation by an officer who has 215
probable cause to believe that a person has committed an act in 216
violation of an ordinance. 217
(e) For the contesting of a citation in the county court. 218
(f) That, if a person fails to pay the civil penalty, 219
fails to appear in court to contest the citation, or fails to 220
appear in court as required by subsection (6), the court may 221
issue an order to show cause upon the request of the governing 222
body of the county or municipality. This order shall require 223
such persons to appear before the court to explain why action on 224
the citation has not been taken. If any person who is issued 225

(g) Such procedures and provisions as are necessary to 228
implement any ordinances enacted under the authority of this 229
