preempting to the state the regulation of gaming, 57

Be It Enacted by the Legislature of the State of Florida: 70

Section 1. Paragraph (a) of subsection (2) of section 72
16.71, Florida Statutes, is amended to read: 73
16.71 Florida Gaming Control Commission; creation; 74
meetings; membership.— 75

(2) MEMBERSHIP.— 76
(a) The commission shall consist of five members appointed 77
by the Governor, and subject to confirmation by the Senate, for 78
terms of 4 years. Members of the commission must be appointed by 79
January 1, 2022. The Governor shall consider appointees who 80
reflect Florida's racial, ethnic, and gender diversity. Of the 81
initial five members appointed by the Governor, and immediately 82
upon appointment, the Governor shall appoint one of the members 83
as the initial chair and one of the members as the initial vice 84
chair. At the end of the initial chair's and vice chair's terms 85
pursuant to subparagraph 1., the commission shall elect one of 86
the members of the commission as chair and one of the members of 87
the commission as vice chair. 88
1. For the purpose of providing staggered terms, of the 89
initial appointments, two members shall be appointed to 4-year 90
terms, two members shall be appointed to 3-year terms, and one 91
member shall be appointed to a 2-year term. 92
2. Of the five members, at least one member must have at 93
least 10 years of experience in law enforcement and criminal 94
investigations, at least one member must be a certified public 95
accountant licensed in this state with at least 10 years of 96
experience in accounting and auditing, and at least one member 97
must be an attorney admitted and authorized to practice law in 98
this state for at least the preceding 10 years. 99

551.104, Florida Statutes, is amended to read: 101
551.104 License to conduct slot machine gaming.— 102
(4) As a condition of licensure and to maintain continued 103
authority for the conduct of slot machine gaming, the slot 104
machine licensee shall: 105
(i) Create and file with the commission a written policy 106
for: 107
1. Creating opportunities to purchase from vendors in this 108
state, including minority vendors. 109
2. Creating opportunities for employment of residents of 110
this state, including minority residents. 111
3. Ensuring opportunities for construction services from a 112
small business as defined in s. 288.703 minority contractors. 113
4. Ensuring that opportunities for employment are offered 114
on an equal, nondiscriminatory basis. 115
5. Training for employees on responsible gaming and 116
working with a compulsive or addictive gambling prevention 117
program to further its purposes as provided for in s. 551.118. 118
6. The implementation of a drug-testing program that 119
includes, but is not limited to, requiring each employee to sign 120
an agreement that he or she understands that the slot machine 121
facility is a drug-free workplace. 122

The slot machine licensee shall use the Internet-based job-124
listing system of the Department of Commerce in advertising 125

employment opportunities. Each slot machine licensee shall 126
provide an annual report to the Florida Gaming Control 127
Commission containing information indicating compliance with 128
this paragraph in regard to minority persons. 129
Section 3. Section 838.12, Florida Statutes, is amended, 130
to read: 131
838.12 Bribery in athletic contests.— 132
(1) Whoever gives, promises, offers or conspires to give, 133
promise or offer, to anyone who participates or expects to 134
participate in any professional or amateur game, contest, match, 135
race or sport; or to any umpire, referee, judge or other 136
official of such game, contest, match, race or sport; or to any 137
owner, manager, coach or trainer of, or to any relative of, or 138
to any person having any direct, indirect, remote or possible 139
connection with, any team, individual, participant or 140
prospective participant in any such professional or amateur 141
game, contest, match, race or sport, or the officials aforesaid, 142
any bribe, money, goods, present, reward or any valuable thing 143
whatsoever, or any promise, contract or agreement whatsoever, 144
with intent to influence him or her or them to lose or cause to 145
be lost any game, contest, match, race or sport, or to limit his 146
or her or their or any person's or any team's margin of victory 147
in any game, contest, match, race, or sport, or to fix or throw 148
any game, contest, match, race or sport, commits shall be guilty 149
of a felony of the third degree, punishable as provided in s. 150

775.082, s. 775.083, or s. 775.084. 151
(2) Any participant or prospective participant in any 152
professional or amateur game, contest, match, race or sport; or 153
any umpire, referee, judge or other official of such game, 154
contest, match, race or sport; or any owner, manager, coach or 155
trainer of, or any relative of, or any person having any direct, 156
indirect, remote or possible connection with, any team, 157
individual, participant or prospective participant in any such 158
professional or amateur game, contest, match, race or sport, or 159
the officials aforesaid; who in any way solicits, receives or 160
accepts, or agrees to receive or accept, or who conspires to 161
receive or accept, any bribe, money, goods, present, reward or 162
any valuable thing whatsoever, or any promise, contract or 163
agreement whatsoever, with intent to lose or cause to be lost 164
any game, contest, match, race or sport, or to limit his, her, 165
their or any person's or any team's margin of victory in any 166
game, contest, match, race or sport, or to fix or throw any 167
game, contest, match, race or sport, commits shall be guilty of 168
a felony of the third degree, punishable as provided in s. 169
775.082, s. 775.083, or s. 775.084. 170
(3) A person who stakes, bets, or wagers any money or 171
other thing of value upon the result of any professional or 172
amateur game, contest, match, race, or sport with knowledge that 173
the results of such professional or amateur game, contest, 174
match, race, or sport are prearranged or predetermined as 175

described in subsection (1) or subsection (2) commits a felony 176
of the third degree, punishable as provided in s. 775.082, s. 177
775.083, or s. 775.084. 178
Section 4. Section 843.08, Florida Statutes, is amended to 179
read: 180
843.08 False personation.—A person who falsely assumes or 181
pretends to be a firefighter, a sheriff, an officer of the 182
Florida Highway Patrol, an officer of the Fish and Wildlife 183
Conservation Commission, an officer of the Department of 184
Environmental Protection, an officer of the Department of 185
Financial Services, any personnel or representative of the 186
Division of Criminal Investigations, any personnel or 187
representative of the Florida Gaming Control Commission, an 188
officer of the Department of Corrections, a correctional 189
probation officer, a deputy sheriff, a state attorney or an 190
assistant state attorney, a statewide prosecutor or an assistant 191
statewide prosecutor, a state attorney investigator, a coroner, 192
a police officer, a lottery special agent or lottery 193
investigator, a beverage enforcement agent, a school guardian as 194
described in s. 30.15(1)(k), a security officer licensed under 195
chapter 493, any member of the Florida Commission on Offender 196
Review or any administrative aide or supervisor employed by the 197
commission, any personnel or representative of the Department of 198
Law Enforcement, or a federal law enforcement officer as defined 199
in s. 901.1505, and takes upon himself or herself to act as 200

such, or to require any other person to aid or assist him or her 201
in a matter pertaining to the duty of any such officer, commits 202
a felony of the third degree, punishable as provided in s. 203
775.082, s. 775.083, or s. 775.084. However, a person who 204
falsely personates any such officer during the course of the 205
commission of a felony commits a felony of the second degree, 206
punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 207
If the commission of the felony results in the death or personal 208
injury of another human being, the person commits a felony of 209
the first degree, punishable as provided in s. 775.082, s. 210
775.083, or s. 775.084. In determining whether a defendant has 211
violated this section, the court or jury may consider any 212
relevant evidence, including, but not limited to, whether the 213
defendant used lights in violation of s. 316.2397 or s. 843.081. 214
Section 5. Section 849.01, Florida Statutes, is amended to 215
read: 216
849.01 Keeping gambling houses, etc.—Whoever by herself or 217
himself, her or his servant, clerk or agent, or in any other 218
manner has, keeps, exercises or maintains a gaming table or 219
room, or gaming implements or apparatus, or house, booth, tent, 220
shelter or other place for the purpose of gaming or gambling or 221
in any place of which she or he may directly or indirectly have 222
charge, control or management, either exclusively or with 223
others, procures, suffers or permits any person to play for 224
money or other valuable thing at any game whatever, whether 225

heretofore prohibited or not, commits a felony misdemeanor of 226
the third second degree, punishable as provided in s. 775.082, 227
or s. 775.083, or s. 775.084. 228
Section 6. Section 849.02, Florida Statutes, is amended to 229
read: 230
849.02 Agents or employees of keeper of gambling house.—A 231
person who Whoever acts as servant, clerk, agent, or employee of 232
any person in the violation of s. 849.01 commits: 233
(1) For a first offense, a misdemeanor of the first 234
degree, punishable as provided in s. 775.082 or s. 775.083. 235
(2) For a second offense, a felony of the third degree, 236
punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 237
(3) For a third or subsequent offense, a felony of the 238
second degree, punishable as provided in s. 775.082, s. 775.083, 239
or s. 775.084 shall be punished in the manner and to the extent 240
therein mentioned. 241
Section 7. Section 849.03, Florida Statutes, is amended to 242
read: 243
849.03 Renting house for gambling purposes.—A person who 244
Whoever, whether as owner or agent, knowingly rents to another a 245
house, room, booth, tent, shelter or place for the purpose of 246
gaming commits: 247
(1) For a first offense, a felony of the third degree, 248
punishable as provided in s. 775.082, s. 775.083, or s. 775.084 249
shall be punished in the manner and to the extent mentioned in 250

Section 8. Section 849.08, Florida Statutes, is amended to 255
read: 256
849.08 Gambling.— 257
(1) As used in this section, the term: 258
(a) "Internet gambling" means to play or engage in any 259
game in which money or other thing of value is awarded based on 260
chance, regardless of any application of skill, that is 261
available on the Internet and accessible on a mobile device, 262
computer terminal, or other similar access device and simulates 263
casino-style gaming, including, but not limited to, slot 264
machines, video poker, and table games. 265
(b) "Internet sports wagering" means to stake, bet, or 266
wager any money or other thing of value upon the result of any 267
trial or contest of skill, speed, power, or endurance of human 268
or beast that is available on the Internet and accessible on a 269
mobile device, computer terminal, or other similar access 270
device. 271
(2) A person who Whoever plays or engages in Internet 272
gambling, any game at cards, keno, roulette, faro or other game 273
of chance, at any place, by any device whatever, for money or 274
other thing of value, commits shall be guilty of a misdemeanor 275

of the second degree, punishable as provided in s. 775.082 or s. 276

(3) A person who plays or engages in Internet sports 278
wagering commits: 279
(a) For a first offense, a misdemeanor of the second 280
degree, punishable as provided in s. 775.082 or s. 775.083. 281
(b) For a second or subsequent violation, a misdemeanor of 282
the first degree, punishable as provided in s. 775.082 or s. 283
775.083. 284
(4) A person who operates, conducts, or promotes Internet 285
gambling or Internet sports wagering, or receives in any manner 286
whatsoever any money or other thing of value offered for the 287
purpose of Internet gambling or Internet sports wagering, or 288
whoever knowingly becomes the custodian or depositary of any 289
money or other thing of value so offered, or whoever aids, 290
assists, abets, or influences in any manner in any of such acts, 291
all of which are hereby forbidden, commits a felony of the third 292
degree, punishable as provided in s. 775.082, s. 775.083, or s. 293
775.084. 294
(5) This section does not apply to participation in, or 295
the conduct of, any gaming activities authorized under s. 296
285.710(13) and conducted pursuant to a gaming compact ratified 297
and approved under s. 285.710(3). 298

(12) PROHIBITED ACTIVITIES.— 302
(e) A person who manipulates or attempts to manipulate the 303
playing cards, outcome, or payoff of a card game in a licensed 304
cardroom by physical tampering or by use of any object, 305
instrument, or device, whether mechanical, electrical, magnetic, 306
or involving other means, commits a felony of the third degree, 307
punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 308
Section 10. Section 849.11, Florida Statutes, is amended 309
to read: 310
849.11 Plays at games of chance by lot.— 311
(1) A person who Whoever sets up, promotes or plays in 312
person or by the use, at least in part, of the Internet, at any 313
game of chance by lot or with dice, cards, numbers, hazards or 314
any other gambling device whatever for, or for the disposal of 315
money or other thing of value or under the pretext of a sale, 316
gift or delivery thereof, or for any right, share or interest 317
therein, commits shall be guilty of a misdemeanor of the second 318
degree, punishable as provided in s. 775.082 or s. 775.083. 319
(2) A person who sets up, operates, conducts, promotes, or 320
receives in any manner whatsoever any money or other thing of 321
value offered for the purpose of conduct prohibited in 322
subsection (1), or whoever knowingly becomes the custodian or 323
depositary of any money or other thing of value so offered, or 324
whoever aids, assists, abets, or influences in any manner in any 325

of such acts, commits a felony of the third degree, punishable 326
as provided in s. 775.082, s. 775.083, or s. 775.084. 327
Section 11. Section 849.13, Florida Statutes, is amended 328
to read: 329
849.13 Punishment on Second or subsequent conviction.—A 330
person who commits a second or subsequent violation of the same 331
Whoever, after being convicted of an offense forbidden by law in 332
connection with lotteries for which there is no penalty 333
specified for a second or subsequent violation, shall have the 334
offense reclassified to an offense of the next higher degree, 335
commits the like offense, shall be guilty of a misdemeanor of 336
the first degree, punishable as provided in s. 775.082, or s. 337
775.083, or s. 775.084. For purposes of sentencing under chapter 338
921, a felony offense that is reclassified under this subsection 339
is ranked one level above the ranking under s. 921.0022 or s. 340
921.0023 of the felony offense committed. 341
Section 12. Section 849.14, Florida Statutes, is amended 342
to read: 343
849.14 Unlawful to bet on result of trial or contest of 344
skill, etc.—A person who Whoever stakes, bets, or wagers any 345
money or other thing of value upon the result of any trial or 346
contest of skill, speed or power or endurance of human or beast, 347
or whoever receives in any manner whatsoever any money or other 348
thing of value staked, bet, or wagered, or offered for the 349
purpose of being staked, bet, or wagered, by or for any other 350

person upon any such result, or whoever knowingly becomes the 351
custodian or depositary of any money or other thing of value so 352
staked, bet, or wagered upon any such result, or whoever aids, 353
or assists, or abets, or influences in any manner in any of such 354
acts all of which are hereby forbidden, commits a felony of the 355
third degree, punishable as provided in s. 775.082, or s. 356
775.083, or s. 775.084. 357
Section 13. Section 849.15, Florida Statutes, is amended 358
to read: 359
849.15 Manufacture, sale, possession, etc., of slot 360
machines or devices prohibited.— 361
(1) As used in this section, the term: 362
(a) "Conviction" means a determination of guilt that is 363
the result of a plea or a trial, regardless of whether 364
adjudication is withheld or a plea of nolo contendere is 365
entered. 366
(b) "Person of authority" means a person who, at any 367
business, establishment, premises, or other location at which a 368
slot machine or device is offered for play, has: 369
1. Actual authority to act on behalf of the business, 370
establishment, premises, or other location where a slot machine 371
or device is offered for play; or 372
2. Any ownership interest in the business, establishment, 373
premises, or other location. The term "ownership interest" 374
includes being an officer, director, or managing member of the 375

business, establishment, premises, or other location. 376
(2)(1) It is unlawful: 377
(a) To manufacture, own, store, keep, possess, sell, rent, 378
lease, let on shares, lend or give away, transport, or expose 379
for sale or lease, or to offer to sell, rent, lease, let on 380
shares, lend or give away, or permit the operation of, or for 381
any person to permit to be placed, maintained, or used or kept 382
in any room, space, or building owned, leased or occupied by the 383
person or under the person's management or control, any slot 384
machine or device or any part thereof; or 385
(b) To make or to permit to be made with any person any 386
agreement with reference to any slot machine or device, pursuant 387
to which the user thereof, as a result of any element of chance 388
or other outcome unpredictable to him or her, may become 389
entitled to receive any money, credit, allowance, or thing of 390
value or additional chance or right to use such machine or 391
device, or to receive any check, slug, token or memorandum 392
entitling the holder to receive any money, credit, allowance or 393
thing of value. 394
(3)(a) Except as provided in paragraphs (b) and (c), a 395
person who violates subsection (2) commits a misdemeanor of the 396
first degree, punishable as provided in s. 775.082 or s. 397
775.083. 398
(b) A person commits a felony of the third degree, 399
punishable as provided in s. 775.082, s. 775.083, or s. 775.084, 400

if he or she violates subsection (2), and: 401
1. At the time of the violation, the person was a person 402
of authority; or 403
2. The person has one prior conviction for a violation of 404
this section. 405
(c) A person commits a felony of the second degree, 406
punishable as provided in s. 775.082, s. 775.083, or s. 775.084, 407
if he or she violates subsection (2), and: 408
1.a. At the time of the violation, the person was a person 409
of authority; and 410
b. The violation involves five or more slot machines or 411
devices; or 412
2. The person has two or more prior convictions for a 413
violation of this section. 414
(4)(2) Pursuant to section 2 of that chapter of the 415
Congress of the United States entitled "An act to prohibit 416
transportation of gaming devices in interstate and foreign 417
commerce," approved January 2, 1951, being ch. 1194, 64 Stat. 418
1134, and also designated as 15 U.S.C. ss. 1171-1177, the State 419
of Florida, acting by and through the duly elected and qualified 420
members of its Legislature, does hereby in this section, and in 421
accordance with and in compliance with the provisions of section 422
2 of such chapter of Congress, declare and proclaim that any 423
county of the State of Florida within which slot machine gaming 424
is authorized pursuant to chapter 551 is exempt from the 425

provisions of section 2 of that chapter of the Congress of the 426
United States entitled "An act to prohibit transportation of 427
gaming devices in interstate and foreign commerce," designated 428
as 15 U.S.C. ss. 1171-1177, approved January 2, 1951. All 429
shipments of gaming devices, including slot machines, into any 430
county of this state within which slot machine gaming is 431
authorized pursuant to chapter 551 and the registering, 432

the Internet, any advertisement, circular, bill, poster, 566
pamphlet, list, schedule, announcement, or notice for the 567
purpose of promoting or facilitating illegal gambling. 568
(b) Except as otherwise specifically authorized by law, a 569
person may not set up any type or plate for any type of 570
advertisement, circular, bill, poster, pamphlet, list, schedule, 571
announcement, or notice when he or she knows or reasonably 572
should know that such material will be used for the purpose of 573
promoting or facilitating illegal gambling. 574
