741.31, F.S.; providing that a person commits a felony 4
of the third degree if such person commits a violation 5
of an injunction or foreign protection order against a 6
victim after having been convicted of any assault, 7
battery, or violation of an injunction or foreign 8
protection order against the same victim; requiring a 9
minimum term of imprisonment for such offense; 10
providing applicability; providing an effective date. 11

Be It Enacted by the Legislature of the State of Florida: 13
14
Section 1. Paragraph (c) of subsection (4) of section 15
741.31, Florida Statutes, is amended to read: 16
741.31 Violation of an injunction for protection against 17
domestic violence.— 18
(4) 19
(c) A person who has one two or more prior convictions for 20
any assault, battery, or violation of an injunction or foreign 21
protection order, and who subsequently commits a violation of 22
any injunction or foreign protection order against the same 23
victim, commits a felony of the third degree, punishable as 24
provided in s. 775.082, s. 775.083 or s. 775.084. A person 25

convicted of violating this paragraph must be sentenced to a 26
minimum of 10 days in the county jail for each violation, unless 27
the court sentences the person to a nonsuspended period of 28
incarceration in a state correctional facility. For purposes of 29
this paragraph, the term "conviction" means a determination of 30
guilt which is the result of a plea or a trial, regardless of 31
whether adjudication is withheld or a plea of nolo contendere is 32
entered. 33
Section 2. This act shall take effect October 1, 2026. 34
